WHEREAS, the Joint Powers Board created to study the Battle Creek
drainage area through the joint exercise of the powers agreement hired
Eugene A. Hickok and Associates as a consultant to prepare a plan for
the improvement and control of the Battle Creek drainage area, and;
WHEREAS, such plan has been prepared and accepted by the Joint Powers
Board, and; '
WHEREAS, the Joint Powers Board has met on numerous oc�asions since
that time to develop an agreeable cost split in connection v�j_th the five
year construction program included in the plan for such impr�ovement and
control facilities, and;
WHEREAS, no mutual agreement has been reached on such �ost split
to date, and;
WHEREAS, the delay of such agreement can only result in delay of
the much needed improvements and control facilities, thus creating a
threat to life and propert�r in the Battle Creek drainage ar�a, and;
WHEFEAS, the Joint Powers Board could continue to meet, if so desired,
to continue to negotiate a mutually acceptable cost split w�hile a watershed
district is being considered by the Minnesota Water Resources Board, and;
WHEREAS, fifty percent of the counties involved in the drainage
area can petition for a watershed district in accordance with Minnesota ,
Statutes, Chapter 112. ',
NOW, THEREFORE, be it resolved that the Council of the ',City of St. Paul
hereby requests the Ramsey County Board of County Commissioners to
petition the Minnesota Water Resources Board for a watershed district in
accordance with Chapter 112 of -the Minnesota Statutes.
