That the Saint Paul Legislative Code be and is hereby amended so as to add the following chapter thereto: . Building Code - Permits and Inspection. . O1 Definitions. The following words and phrases �`' when used in this chapter shall have the meanings respectively ascribed to them in this section. ' Building Official. The head of the Division of Housing and Building Code Enforcement of the Department of Community Services of the City of Saint Paul . . 02 Minnesota Uniform Building Code - Adoption. (a) Pursuant to Minnesota Statutes, 1971, Section 471 .62, Minnesota State Regulations of the Department of Administration, Chapter 11, relating to the Minnesota Uniform Building Code as adopted pursuant to Minnesota Statutes 1971, Chapter 561, as filed with the Commissioner of Administration of the State of Minnesota and the Secretary of State on January 6, 1972, and' thereafter as may be amended from_ time to time , are hereby adopted by reference. (b) The City Clerk shall mark and keep on file in the office of the City Clerk three copies of said regulations for use and examination by the public and shall furnish a copy of this ordinance and said regulations at cost to any person upon request. . 03 Permits Not Required. Permits shall not be required for repairs for maintenance only, or for minor alterations provided they are not required under paragraph . 04 of this section; and provided the cost of such repairs and minor alterations do not exceed the present market value of One Hundred Dollars ($100. 00) . . 04 Permits Required. Application for Permits. (a) Permits Required. No person, firm, or corporation shall erect, construct, enlarge, alter, repair, move, improve, remove, convert, or demolish any building or structure in the city, or cause the same to be done, or construct or cause to be constructed, any fence in the City of Saint Paul , without first obtaining .�a separate building permit for each such b�ilding or structure from the Building Official . (b) Application. To obtain a permit the applicant shall first file an application therefor in writing on a form furnished for that purpose. Every such application shall : 1 . Identify and describe the work to be covered by the permit for which application is made; 2 . Describe the land on which the proposed work is to be done , by lot, block, tract, and house and street address, or similar description that will readily identify and definitely locate the proposed building or work; 3 . Tndicate the use or occupancy for which the proposed work is intended; 4 . Be accompanied by plans and specifications as rec{uired in Subsection (c) of this section; . .' , , . ' ���� �� ��� �5 ?30 Page 3 . 5 , State the valuation of the proposed work; 6. Be signed by the permittee, or his authorized agent, who may be required to submit evidence to indicate such authority; 7 . Give such other information as reasonably may be rec{uired by the Building Official . (c) Plans and Specifications . With each application for a building permit and when required by the Building Official for enforcement of any provisions of this code, two sets of plans and specifications shall be submitted. The Building Official may rec{uire plans and specifications to be prepared and designed by an engineer or architect licensed by the state to practice as such. EXCEPTION: When authorized by the Building Official , plans and specifications need not be submitted for the following: 1 . One-story build`ings of Type V conventional woodstud construction with an area not exceeding 600 square feet. 2. Group J, Division 1 , Occupancies of Type V con- ventional woodstud construction. 3 . Small and unimportant work. (d) Information on Plans and Specifications. Plans and specifications shall be drawn to scale upon substantial paper or clo�th and shall be of sufficient clarity to indicate the nature and extent of the work proposed and show in detail that it will confor�. to the provisions of this code and all relevant laws, ordinances , rules and regulations . The first sheet of each set of plans shall give the house and street address of the work and the name and address of the owner and person who prepared them, Plans shall include a plot plan showing the location of the proposed building and of every existing building on the property. In lieu of detailed specifications, the Building Official may approve references on the plans to a specific section or part of this code or other ordinances or laws. , � . • , , . ' ���� �� Page 4. Computations, stress diagrams, and other data sufficient to show the correctness of the plans , shall be submitted when required by the Building Official. Plans for buildings more than two stories in height of other than Groups I and J Occupancies shall indicate how required structural and fire- resistive integrity will be maintained where a penetration will be made for electrical, mechanical , plumbing, and communications conduits, pipes and similar systems . . 05 Building Permits . (a) Issuance. The application, plans and specifications filed by an applicant for a permit shall be checked by the Building Official, or by such other officers , inspectors and assistants and other employees as shall be designated by the Building Official from time to time. The Building Official may deputize such employees as may be necessary to carry out the functions of the Building Department. Such plans may be reviewed by other departments of the City to check compliance with the laws and ordinances under their jurisdiction. If the, Building Official is satisfied that the work described in an application for permit and the plans filed therewith conform to the requirements of this code and other pertinent laws and ordinances and that the fee specified in this chapter has been paid, he shall issue a permit there- for to the applicant. When the Building Official issues the permit, he shall endorse in writing or stamp on both sets of plans and specifications "APPROVED". Such approved plans and speci- fications shall not be changed, modified, or altered without authorization from the Building Official, and all work shall be done in accordance with the approved plans . The Building Official may issue a permit for the construction of part of a building or structure before the entire plans and specifications for the whole building or structure have been submitted or approved provided adec{uate information and detailed statements have been filed comply- ing with all pertinent rec{uirements of this code. The holder of such permit shall proceed at his own risk without assur- ance that the permit for the entire building or structure will be granted. � . � � � - 2����� ���o /5�36 Page 5 , �b) Retention of Plans . One set of approved plans, specifications, and computations sha.11 be retained by the Building O�ficial for a period of not less than 9U days from date of completion of the work covered therein, and one set of approVed plans and specifications shall be returned to the applicant, which set shall be kept on such building or work at all times during which the work author- ized thereby is in progress . (c) Validity. The issuance or granting of a permit or approval of plans and specifications shall not be construed to be a permit for, or an approval of, any violation of any of the provisions of this code. No permit presuming to give authority to violate or cancel the provisions of this code shall be valid, except insofar as the work or use which it authorizes is lawful . The issuance of a permit based upon plans and specifi- cations shall not prevent the Building Official from there- after requiring the correction of errors in said plans and specifications or from preventing building operations being carried on thereunder when in violation of this code or of any other ordinance of the city. (d) Expiration. Every permit issued by the Building Official under the provisions of this code shall expire by limitation and become null and void if the building or work authorized by such permit is not commenced� within 120 days from the date of such permit or if the building or work authorized by such permit is suspended or abandoned at any time after the work is commenced for a period of 120 days . Before such work can be recommenced a new permit shall be first obtained. so to do, and the fee therefor shall be one-half the amount required for a new permit for such work, provided no changes have been made or will be made in the original plans and specifications for such work; and provided further that such suspension or abandon- ment has not exceeded one year. (e) Suspension or Revocation. The Building Official may, in writing, suspend or revoke a permit issued under provisions of this code whenever the permit is issued in error or on the basis of incorrect information supplied, or in v�iolation of any ordinance or regulation or any of tY�e prov�isions of this code , . . ' � . . ������ Page 6. .06 Establishment of Permit Fees . (a) Fees Required. Before issuing any permit for the erection, addition, alteration, repair, moving, wrecking or occupancy, the fee as indicated in the following schedule sha.l l be paid. Where work for which a permit is required by this ordinance is started or proceeded with prior to obtaining said permit, the fees specified shall be doubled, provided tha.t in no event will such double fee exceed Three Hundred Dollars ($300.00) . The pa.yment of such double f ee sha.l l not re lieve any persons from fully complying with the requirements of the Building Codes in the execution of the work or from any other pena.lties prescribed herein. Building valua.tion for the purpose of establishing build- ing permit fees sha.11 be as set forth by the valua.tion data published by the Building Code Division, Department of Admin- istration, State of Minnesota, as ma.y be amended from time to time. (b� Plan Checking Fees. When the valuation of the prvposed construction exceeds $1 ,000 . 00, a plan-checking fee shall be paid to the Building Official at the time of sub- mitting plans and specifications for checking. � Plan checking fees for group I and J occupancy shall be one-�ourth of the building permit fee . Plan checking fees for a11 other buildings shall be 65 per cent of the building permit fees as set forth in Table A above. Where plans are incomplete or changed so as to require additional plan checking, an additional plan check fee shall be charged at the rate of one-fourth of the original plan checking fee. (c) Expiration of Plan Check. Applications for which no permit is issued within 180 days following the date of application shall expire by limitation and plans submitted for �hecking may thereafter be returned to the applicant or destroyed by the Building Official . The Building Official may extend the time for action by the applicant for a period not exceeding 180 days upon written request ..by the applicant showing that circumstances b�yond the control of the appli- cant have prevented action from being taken. In order to renew action on an application after expiration, the appli- cant shall resubmit plans and pay a new plan-check fee of Ten Dollars ($10. 00) . �►.V� �d) The minimum fee for any permit shall be �e�e�--�� 5-�fr D o 11 a r s ($�-:5-8�) . �'S. a a � � '� � . ��4414 i' Page 8 . (e) Cha.pter 70 of the Minnesota Uniform Building Code, being an appendix cha.pter thereto, is hereby adopted by reference. (f) Permit fees for other tha.n general construction sha.11 be as follows: 1. Wrecking of Buildings or Structures. Seventy-five ($ .75) cents per thousand cubic feet or fraction thereof. 2. Moving of Buildings or Structures. Buildings larger tha.n 12 feet high, 14 feet wide, 25 feet long other tha.n buildings used for J occupancies: $75 per move . J occupa.ncy buildings larger tha.n 12x14x25 ft. : $35 per move . Buildings or structures sma.11er than size indicated above: ' $15 per move. 3. Drywall (where used to provide required fire resis- ' tance rating, except I and J occupancies) : $8 for first thousand squa.re yards and $4 for each additiona.l thousand square yards or fraction thereof. 4. Elevators, Dumbwaiters and Moving Stairways . (a) Power-driven passenger and freight elevators: $50 for each installation, plus $3 for each story served by such elevator. (b) Ha.nd-powered freight elevators: $30 for each installation, plus $3 for each story served. (c) Sidewalk lift, dock lifts and manlifts: $30 per installation. (d) Moving stairways : $65 per unit. (e) Dumb Waiters : (1) Power-driven: $25 plus $2 .50 for each story served. (2) Hand-powered: $7 .50 plus $1.50 for each story served. (f) Annua.l Inspection Fee: (1) Power-driven passenger or freight elevator: $15 per year. (3) Hand-powered dumbwaiters : $7 . 50 per year. 5 . Electrical Work. For electrical work the permit fee charge shall be made at the following rates : (a) Service - New service, change of service, tem- porary service, addition, alteration or repair on either primary or secondary service shall be computed as follows : Up to and including 60 ampere service $4 . 50 61 ampere to and including 100 ampere capacity 6. 00 101 ampere to and including 200 ampere capacity 7 . 50 For each additional 100 ampere capacity or fraction thereof 3. 00 (b) Circuits - Installation of new circuits, and or subfeeder additions, alterations or repairs to existing circuits shall be computed as follows : Up to and including 30 ampere capacity 1 . 50 31 to and including l00 ampere capacity 3. 00 For each additional 100 ampere capacity or fraction thereof 1 . 00 (c) Transformers and Generation for Light, Heat and Power : � Transformers and generation for light, heat and power shall be computed separately at $2 . 00 per unit plus ten cents per KVA or fraction thereof up to 100 KVA, plus five cents per KVA or fraction thereof in excess of 100 KVA. The maximum permit fee for any transformer or generator shall be $50 . 00. The above fee for transformers include its secondary circuit to the first part of distribution. In addition to the above fees, all transformers for signs and outline lighting shall be computed at $2 . 00 for the first 500 V A or fraction thereof per unit, plus $0. 20 for each additional 100 V A or fraction thereof. . , I • ������ �age 10 . �d� AlterationS� Repairs or Extension of Electrical Work: Fox any alterations , repairs or extension of an exist- ing electrical system where tlie work is of such a nature that the £ees for permit cannot be determined from the above schedule, the permit fee charge shall be made at the rate of ten dollars �$10 ,00) for the first one thousand dollars ($1,000. 00) or fraction thereof, plus two dollars ($2, 00) for each additional five hundred dollars ($500 . 00) or fraction thereof of the total market value of such alteration, repair or extension. (e) Remote-Control Circuits, Signal Circuits and Lo�r-Energy or Low-Voltage Power, Circuits: For remote-control circuits, signal circuits and low- energy or low-voltage power circ�zits (in other than single- family and two-family dwellings) , the permit fee charge shall be made at the rate above for circuits , which will include ten (10) openings , plus one dollar ($1 . 00) for each additional ten (10) openings or fraction thereof, (f) For permits on transient projects including but not limited to Carnivals and Circuses , the inspection fees sha.11 be computed as follows : Power supply units - accor.ding to Items (a) and (b) of the Fee Schedule. A like fee will be required on power supply units at each engagement during the season. Rides, Devices, or Concessions : Shall be inspected at their first appearance of the season and the inspection fee shall be $3, 00 per unit. 6 . Gas Burner, Oil Burner, Coal Burner. $10. 00 for the first 100,000 b .t.u, per hour input or fraction there- o�, plus $1.75 for each additional 100,000 b.t.u. Maximum fee for each individual burner shall be $150 . 00 . Where dual fuel installations are made the maximum combined permit �ee shall not exceed $250 . 00 . � �6���4 6� ?� r,��3o �age ll , 7. Plastering and Stucco. $8 .00 the first 1 ,000 square yards or fraction thereof, and $4 . 00 for each additional 1 , 000 square yards . 8 . Plumbing. (a) Fixtures, devices and connections : $5 . 00 for each permit plus $2. 50 for each fixture, device and connection. (b) House or building sewer: $10 . 00 for each installation. (c) Private disposal system: $20. 00 for each installation. 9. Refrigeration. (a) Installations less than 100,000 b.t.u. per hour capacity: $7 . 50 for the first 10 , 000 b. t.u. , plus $1 . 25 for each additional 10, 000 b.t.u. (b) Refrigeration installation: Over 100, 000 b .t.u. : $20. 00 for the first 100,000 b.t.u. per hour, plus $2 . 50 for each additional 100 ,000 b. t.u. per hour or fraction thereof. 10. Air Conditioning. Inasmuch as the term Air Conditioning is very general and normally includes several types of work, each type of work involved shall require certificates of competency as provided for under each of the following classifications : Electrical Work, Gas Burner Installing and Repairing, Oil Burner Installing and Repair- ing, Plumbing Work, Refrigeration Equipment Installing and Repairing, Steam Fitting, Warm Air Heating, Ventilation and General Sheet Metal Work Installing and Repairing, or others. 11 . Signs, Billboards, Marquees and Awnings . (a) Wall signs and roof signs : $15. 00 for the first 100 square feet or fraction thereof, plus $7 . 50 for each additional 100 square feet or fraction thereof. �s���� Page 12, (b) Projecting signs and free-standing signs : $7 . 50 for each 25 square feet up to 100 sc{uare feet, plus $3 . 75 for each additional 25 square feet in excess of 100 square feet. (c) Marquees over public property: $50 . 00 for each installation. (d) Billboards up to and including 600 square feet : $35. 00 plus $3. 50 for each 100 square feet in excess of 600 square feet or fraction thereof. (e) Awnings, fixed or dropped awnings projecting over public property: $15 , 00 for each installation. 12 , Steamfitting Work. (a) Steam or hot-water systems : $20 . 00 for the first 200, 000 b.t.u, per hour or fraction thereof, plus $2 . 50 for each additional 100,000 b ,t,u. 13 , Warm Air, Heating and Ventilation. (a) Gravity systems : $15 . 00 for each installation. (b) Mechanical warm air heating systems : $20 . 00 for the first 200,000 b.t.u. per hour or fraction thereof, plus $2 . 50 for each additional 100, 000 b.t.u. per hour or fraction thereof. (c) Multiple fan ventilation system: Each fan under 250 c.f.m. : $3. 50 for the first fan, plus $1. 50 for each additional fan. (d) Ventilation systems , dust collection systems , etc, : $15. 00 for the first 3,000 c .f.m. or fraction thereof, plus $2, 00 for each additional 1 ,000 c.f.m. capacity or fraction thereof, 14, General Sheet Metal, ��4��� ���Za�S�,�a Page 13 . (a) Metal roof decks and metal siding : $7 . 50 for the first 1, 000 square feet, plus $2 , 50 for each additional 1, 000 square feet. 15 . Incinerators. ,�s;ao (a) Domestic portable incinerators : �$ for each installation. (b) Commercial and industrial incinerators : $25. 00 for each installation. 16 . Fire Extinguishing Systems . (a) Standpip�s: $15 . 00 for each standpipe, plus $1. 50 for each floor served above five. (b) Automatic fire extinguishing systems : $7 . 50 for the first IO sprinklerheads or fraction thereof, plus $1 . 50 for each additianal 10 sprinklerheads or fraction thereof. �5,00 17 . Fences . �-59 for the first 100 lineal feet erected and $2 . 50 for each additional 100 lineal feet. 18 . For alterations , repairs or extensions for which the fee charge cannot be determined by items 1-17 above , the fee charge shall be based on market value of the work as indicated in Table A as set forth above. . 07 Certificate of Occupancy. (a) Use or Occupancy. No building or structure in Groups A to H, inclusive, shall be used or occupied, and no change in the existing-occupancy classification of a build- ing or structure or portion thereof shall be made until the Building Official has issued a Certificate of Occupancy therefor as provided herein. (b) Change in Use . Changes in the character or use of a building shall not be made without the approval of the Building Official, and the building may be occupied for purposes in other groups provided the new or proposed use is less hazardous, based on life and fire risk, than the existing use. • .. . . : . ��'���� Page 14 . (c) Certificate Issued. After final inspection, when it is found that the building or structure complies with the provisions of this code, the Building Official shall issue a Certificate of Occupancy. (d) Existing buildings. Within a reasonable time as fixed by written order of the Division of Housing and Building Code Enforcement Division, every building except groups T and J occupancies heretofore erected shall have a Certificate of Occupancy issued by the division and posted on the premises . Before such Certificate can be issued, such buildings shall be inspected by the Division and found to conform to the requirements of the Building Code at the time of construction or at the time of con- version to its present use and to the provisions of the Saint Paul Legislative Code. No building which is required to have a Certificate of Occupancy shall continue to be occupied without such Certificate after the time fixed above has elapsed. (e) Reinspection required, An annual inspection shall be made by the Division of all buildings of A through G occupancies which have a Certificate of Occupancy. Inspection shall be required by the division on a three-year cycle for all buildings of H occupancy which have a Certificate of Occupancy. If it is found that such buildings do not conform to the applicable rec{uirements , the Certificate of Occupancy may be revoked and the building shall not be occupied until such time as the building is again brought into compliance with such requirement . (f) Fees for Certificate of Occupancy. 1. Original Issue. New Buildings . There shall be no £ee charged for an issuance of the Certificate of Occupancy for new buildings at the completion of their construction covered by a building permit. 2 . Existing H Occupancies , $7 . 50 per residential unit; minimum fee $35 .00, maximum fee $150. 00. j`'{ ������ ����s�� Page 15 , 3 , Existing Buildings of A through G . Occupancies . $5 , 00 per thousand square £eet; minimum fee $35 . 00, maximum fee $150. 00. 4 . Reinspection Fee. One-half the original fee established by (2) and (3) above with a minimum fee of $20 , 00 and a maximum fee of $50 . 00. . 08 Certificate of Compliance. The Building Of£a,cial may issue a Certificate of Compliance for any building or structure in Group I or J occupancy when he finds that such building or structure complies with the provisions of this chapter, and/or the requirements of Chapter 54 of the Saint Paul Legislative Code. The fee required for issuance of a Certificate of CompTiance shall be $35 . 00. There shall be no fee charged for the issuance of a Certificate of Compliance for new buildings at the completion of their construction covered by a building permit. . 09 Fences - requirements . 1 . Height of Fences. No fence shall be erected exceed- ing six feet six inches (6t6") in height above the sidewalk or finished grade of any lot in a residence district or on any lot occupied residentially, All fences erected between front property line and building line shall comply with Section 62 .02 of the Saint Paul Legislative Code. If after investigation it is found that site or terrain conditions make it necessary to exceed the above height restrictions, the Building Official may vary the limitations accordingly. 2, Swimming Poo1 Fences , All yards containing swimming pools shall be completely enclosed by a fence not less than four feet (4 �) in height . The gates shall be of a self- closing and latching type , with the latch on the inside of the gate, not readily available for children to open. Gates shall be capable of being securely locked when the pool is not in use for extended periods . • � - - ,� ���� �� Page 18 . 3. Lath and/or Wallboard Inspection: To be made after all lathing and/or wallboard, interior and exterior, is in place; but before any plastering is applied or before wallboard joints and fasteners are taped and finished. 4. Final Inspection: To be made after building is completed and ready for occupancy. (e) Other Inspections . In addition to the called inspections specified above, the Building Official may make or require any other inspections of any construction work to ascertain compliance with the provisions of this code and other laws which are enforced by the Building Department. For the purpose of determining compliance with Section 104 (h) of the Uniform Building Code, 1973 addition, the Building Official may cause any structure to be reinspected. (f) Reinspections . A reinspection fee may be assessed for each inspection or reinspection when such portion of work for which inspection is called is not complete or when corrections called for are not made. This subsection is not to be interpreted as rec{uiring reinspection fees the first time a job is rejected for failure to comply with the requirements of this code, but as controlling the practice of calling for inspections before the job is ready for such inspection or reinspection. Reinspection fees may be assessed when the permit card is not properly posted on the work site, the approved plans are not readily available to the inspector , for failure to provide access on the date for which inspection is requested, or for deviating from plans requiring the approval of the Building Official. To obtain a reinspection, the applicant shall file an application therefor in writing upon a form furnished for that purpose, and pay the reinspection fee in accordance with Section , ' . � , " . -- . ������ U�c�(. �j3'�3 0 Page 19 , In instances where reinspection fees have been assessed, no additional inspection of the work will be performed until the required fees h.ave been paid, . 09. Special Inspections . (a) General. In addition to the inspections to be made as specified in Section ,IO of this chapter, the owner or his agent shall employ a special inspector who shall be present at all times during construction on the following types of work: 1, Concrete: On concrete work when the structural design is based on an f�� in excess of Z000 pounds. 2 , Masonry: Masonry work shall have special in- spection when required in Chapter 24 of the Uniform Build- ing Code, 1973 edition. 3 , Welding: On all structural welding. 4 , Reinforced Gypsum Concrete : When cast-in-place Class B rein£orced gypsum concrete is being mixed or deposited, 5 . Special Cases : On special construction or work involving unusual hazards or rec{uiring constant inspection. EXCEPTION: The Building Official may waive the re- quirement for the employment of a special inspector if he finds that the construction or work is such that no unusual hazard exists. (b) Special Inspector. The special inspector shall be a qualified person approved by the Building Official. The special inspector shall furnish continuous in- spection on the construction and work requiring his employment. He shall report to the Building Official in writing, noting all code violations and other information as rec{uired.
