WHEREAS, the licensee Cash-N-Pawn of Minnesota, Ltd. /a Cash-N-Pawn, located at
490 University Avenue West in Saint Paul has a Pawn Shop licen (license ID No. 55747)
issued by the City of Saint Paul; and
WHEREAS, Saint Paul Legislative Code §344.04(a�6)b. requires that the videotapes of

Please take notice that a hearing concerning the above-named establishment has been scheduled
for 5:30 p.m., Wednesday, December 14, 2001 in the City Council Chambers, Third Floor,
Saint Paul City Hail and Ramsey County Courthouse.
Enclosed are copies of the proposed resolution and other documents which will be presented to
the City Council for their consideration. This is an uncontested hearing, in that the facts
concerning the failure to videotape several pawn transactions have not been disputed. You wil]

The Office of License, Inspections and Environmental Protection has recommended
adverse action against the Pawnshop License held by Cash-N-Pawn of Minnesota, Ltd., d/b/a
Cash-N-Pawn for the premises located at 490 West University Avenue in Saint Paul. The basis
for the recommendation is as follows:
Sgt. Simmons of the Saint Paul Police Department went to the
premises of Cash-N-Pawn, located at 490 University Avenue
West, to retrieve the videotape of a transaction from
September 7, 2001, which involved stolen property. When he
requested the tape, he was toid by the manager that the video
of that date could not be found. Pursuant to Saint Paul
Legislative Code §344.04(a)(�(b) a pawnshop licensee must
keep videotapes of all transactions for a period of four months.
While investigating a transaction in which a Compaq computer
was pawned by an individual naraed Bee Vang, Sgt. Simmons
learned that the transaction report filed by the licensee had
used information on a previous customer named Bee Vang.
The employee stated that she used the information in the
computer, believing that these were the same people, althongh
the identification shown by the person pawning the computer
had the correct date of birth and address, which did not match
the information in the store records. Saint Paul Legislative
Code §344.04 (a)(2) requires that the licensee must accurately
record the information about a customer who pawns
merchandise.

The recommendation of the license office will be for a 10 day suspension of the
pawnshop license, with the suspension being stayed for eighteen months on the condition that
there be no fiirther violations during the eighteen month period, and a fine of $2,000.00.
If you do not dispute the above facts please send me a letter with a statement to that
effect. The matter will then be scheduled for a hearing before the St. Paul City Council to
determine what penalty, if any, to impose. You will have an opporiunity to appeaz and speak on
your own behalf, or to have someone appeaz there for you.
On the other hand, if you wish to dispute the above facts, I will schedule an evidentiary
hearing before an Administrative Law Judge (ALI): If you wish to have such a hearing, please
send me a letter stating that you aze contesting the facts. You will then be sent a"Notice of
Hearing;' so you will know when and where to appear, and what the basis for the hearing will be.
In either case, please let me know in writing no later than Monday, November 5,
2001, how you would like to proceed. If I have not heard from you by that date, I will
assume that you are not contesting the facts. The matter will then be scheduled for the
hearing before the St. Paul City Council.

I, Sgt. Simmons monitor the Pawn shops within the City of St. Paul. On 9-7-2001,
stolen property from Eau Claire Wisc., reported under CN- O1-21977 was brought into Cash-n-
Pawn 4, 490 W. University, 651- 227-5080. I went to this location to retrieve the video-tape of
the transaction, # 013175, and was was told by Mgr: 7ack Preston that he couldn't find the video
tape for 9-7-2001.This is a violation of their operating regulations. Under Pawn Shops
Regulations, chapter 344.04 (6b), the licensee or Pawn shop must keep videotapes of all
transactions for four months. Preston is fuily aware of this ren lation.
There is another violation concerning this shop. On 8-31-01 a vang, Bee, I i-21-78,
398 Sims, 651-776-7640 brought in a Compaq computer under transaction # 013149. Uang
admitted to me that he brought in this computer to Cash-n-Pawn, and showed them his ID. . I
was investigating this transaction and found out that Cash-n- Pawn had Vang, Bee, 8-1-74, 2076
Margazet as the one who brought in this computer. I talked to employee Coleman, Misry who
handled this transaction. She admitted to me that she took a Bee Uang who was aiready in their
computer from an earlier transaction, and used this name as the one doing the pawning of the
computer. She had no reason foz doing this, expect to say that she thought they were the same
person. This is also a violation of their operating regulations, under 344.OA (2).

The Office of License, Inspections and Environmental Protection has recommended
adverse action against the Pawnshop License held by Cash-N-Pawn of Minnesota, Ltd., d/b/a
Cash-N-Pawn for the premises located at 490 West University Avenue in Saint Paul. The basis
for the recommendation is as follows:
Sgt. Simmons of the Saint Paul Police Department went to the
premises of Cash-N-Pawn, located at 490 University Avenue
West, to retrieve the videotape of a transaction from
September 7, 2001, which involved stolen property. When he
requested the tape, he was toid by the manager that the video
of that date could not be found. Pursuant to Saint Paul
Legislative Code §344.04(a)(�(b) a pawnshop licensee must
keep videotapes of all transactions for a period of four months.
While investigating a transaction in which a Compaq computer
was pawned by an individual naraed Bee Vang, Sgt. Simmons
learned that the transaction report filed by the licensee had
used information on a previous customer named Bee Vang.
The employee stated that she used the information in the
computer, believing that these were the same people, althongh
the identification shown by the person pawning the computer
had the correct date of birth and address, which did not match

The recommendation of the license office will be for a 10 day suspension of the
pawnshop license, with the suspension being stayed for eighteen months on the condition that
there be no fiirther violations during the eighteen month period, and a fine of $2,000.00.
If you do not dispute the above facts please send me a letter with a statement to that
effect. The matter will then be scheduled for a hearing before the St. Paul City Council to
determine what penalty, if any, to impose. You will have an opporiunity to appeaz and speak on
your own behalf, or to have someone appeaz there for you.
On the other hand, if you wish to dispute the above facts, I will schedule an evidentiary
hearing before an Administrative Law Judge (ALI): If you wish to have such a hearing, please
send me a letter stating that you aze contesting the facts. You will then be sent a"Notice of

I, Sgt. Simmons monitor the Pawn shops within the City of St. Paul. On 9-7-2001,
stolen property from Eau Claire Wisc., reported under CN- O1-21977 was brought into Cash-n-
Pawn 4, 490 W. University, 651- 227-5080. I went to this location to retrieve the video-tape of
the transaction, # 013175, and was was told by Mgr: 7ack Preston that he couldn't find the video
tape for 9-7-2001.This is a violation of their operating regulations. Under Pawn Shops
Regulations, chapter 344.04 (6b), the licensee or Pawn shop must keep videotapes of all
transactions for four months. Preston is fuily aware of this ren lation.
There is another violation concerning this shop. On 8-31-01 a vang, Bee, I i-21-78,
398 Sims, 651-776-7640 brought in a Compaq computer under transaction # 013149. Uang
admitted to me that he brought in this computer to Cash-n-Pawn, and showed them his ID. . I
was investigating this transaction and found out that Cash-n- Pawn had Vang, Bee, 8-1-74, 2076
Margazet as the one who brought in this computer. I talked to employee Coleman, Misry who
handled this transaction. She admitted to me that she took a Bee Uang who was aiready in their
computer from an earlier transaction, and used this name as the one doing the pawning of the
computer. She had no reason foz doing this, expect to say that she thought they were the same
person. This is also a violation of their operating regulations, under 344.OA (2).
