RSSOLVED, That upon and pursuant to the pertinent appeal,
under the Zoning Code, by John D. Thomas, owner of the subject
real estate, situate in the City of Saint Paul and described
as :
Lots 21 and 22, Block 2, Brokmeier's
Sub of Cruikshank's Garden Lots;
that the provisions of said Zoning Code hereby are determined
and varied as and to the extent necessary therefor and the
setback requirements for said premises are hereby relaxed so
as to accommodate an addition for two bedrooms ove� an exist-
ing porch, subject to the condition that said appellant, and
his successors and assigns, otherwise, shall make due compliance
with all applicable provisions of municipal ordinances, state
statutes and rules and regulations of public authorities having
cognizance.

Dear Madam:
This is written in response to the appeal of John D. Thomas to relax
setback requirements on property located on the north side of York
between Hazelwood and Barclay. This property is further described as
follows:
Lots 21 and 22, Block 2, Brokmeier's Sub of Cruikshank's Garden
Lots.
This matter was heard by the Board of Zoning on September 5, 1974, at
which time staff explained that the proposed addition would extend 1�
feet more over the house than the existing overhang. Because he could
not see how a hardship would be caused because substantial improvement
of the property could be accomplished without the need for a variance,
staff recommended denial of the appeal.
Mr. Thomas, the appellant, explained his proposal was to construct an
addition for two bedrooms over an existing porch.
After discussion, a motion to recommend approval of the appeal carried
unanimously.

A. HISTORY: There is no zoning history for this site. �
B. PROPOSAL: The appellant proposes to construct an addition for two bedrooms
over an existing porch.
C. VARIANCE: The legal setback for this lot is 23 feet. The existing home
with its 1'� foot overhang is set back 20'� feet. The proposed addition
would extend 1� feet more over the house than the existing overhang, making
the setback 19 feet.
D. AREA ZONING: With the exception of Cau�mercial zoning along East Seventh
and small parcels zoned "C" Residential on York and Stillwater, the area east
of Bixmingham is zoned "A" Residential.
E. SITE CONDITIONS: The site is developed with an older wood frame structure
in fair condition. The lot is at street grade.
F. AREA CONDITIONS: The area is residentially developed, There are large
parcels of vacant land across York near Barclay.
