WHEREAS, the Office of License, Inspections and Emironmental Protecriott (LIEP) has recommended the
denial of the applicarion for a Restaurant (A) license by D& M Tuscany, Inc., d/b/a Tuscany Grill & Pizzaria for
the premises at 1051 Hudson Road in Saint Paul; and
WHEREAS, a Norice of Intent to Deny the License was sent to the license applicant on June 21, 2001
staring that the recommendation was based upon the premises not being available for inspecrion and the licensee's
failure to respond to a letter from the Office of LIEP asking for the status of the project, and in response to the
Notice the applicant ananged for an inspecrion; and
WHEREAS, a second Norice of Intent to Deny the License was sent to the applicant based upon the fact
thaE the premises were not in compliance with the food code and the applicant responded that all changes would be
made by September 1, 2001; and
WHEREAS, an inspecrion on September 7, 2001 of the premises showed considerable repair work still to
be done in the restaurant arza, and the premises srill in violation of the food code, with no likelihood the premises
would be in compliance in the neaz future; and
WHEREAS, the application was first received on August 10, 2000, and the matter has been pending for
over a year without the premises being in compliance; now, therefore be it
RESOLVED, that the application for a Restaurant (A) license by D& M Tuscany, Inc., d/b/a Tuscany
Grill & Pizzaria for the premises at 1051 Hudson Road in Saint Paul be and hereby is denied.

Dear Mr. Ubel:
The Office of License, Inspections and Environmental Protection (LIEP) has
recommended that the license application by D& M Tuscany, Inc., dlbia Tuscany Grill &
Pizzaria for the premises at 1051 Hudson Road in Saint Paul be denied. The basis for the
recommendation is as follows:
On June 21, 2001 you were advised that the Office of LIEP was
recommending denial of your license application because the
Healh inspector could not gain access to the business and the
aQproval was still lacking. Tn response you informed this office
that the premises would be available for inspection. On July
10, 2001, an inspection was done of the facility and you were
informed that the premises were not in compliance with the
food code. Accordingly, LIEP is still recommending denial of
your license application.
If you do not dispute the above facts, please send me a letter �vith a statement to that
effect. The matter will then be scheduled for a hearing before the Saint Paul City Council to
determine what penalty, if any, to impose. You will have an opportunity to appear before the
Council and make a statement on your own behalf. The recommendation from the licensin�
office is for the denial of your license application.

On the other hand, if you wish to dispute the above facts, you are entitled to an
evidentiary hearing before an administrative law jud�e. If you wish to have such a hearin�,
please send a letter stating that you are contesting the facts. You will then be sent a"Notice of
Hearing" with the date, time and place for the hearing, the name of the administrative law judge,
and an explanation of the procedures.
In either case, please let me know in writing no later than Thursday, Au�ust 2, 2001, how
you would like to proceed. If you have not co.ntacted me by Thursday, August 2, 2001, I will
assume that you are not contesting the facts. I will then schedule this matter for the St.
Paul City Council and have it placed on the Consent Agenda during which no public
discussion is allowed and the recommended penalty will be imposed.

Mark Kaisersatt and I inspected the Tuscany Grill this moming at approximately 10:00 AM. The grill is attached to a liquor store and uses a common
front entry door. When we entered the building the restaurant xas not open, but there was a man at the counter of the liquor store. 1 asked him about
the resiaurant and he said they donY have sit down sales but deliver food heginning at 4:00 PM. I told him we want to inspect the resfaurant. He said
the ownerwas in the liquor store.
Mr. Uhet came to ihe Nont of the liquor store and f asked him what had been done since f was here in January. He staAed g'rving excuses about his
injury. I asked him if anything had actually been done. He said he has cleaned the ezhaust hood and has a fiend who is going to repair the walis and
fix the place.
As we vraiked through the narrow kitchen, between the cook line and the dishmachine there was a very sVOng odor of garbage. Mark K. notcied a
garbage can full of garbage that had live maggots in it. I asked Mr. Ubei how long that had been there. He said they had a problem with their garbage
on 7/04/Ot. I told him to get it out of fhe kitchen. He did.
We walked thmugh the whole restaurant and ihere was rro significant improvement, in fact, tt�e place was much dirtier than when I inspected in
January and Ne walk-in cooler has continued to deferiorata. I taW Mr. Ubef that l would not approve his license. He said he undecstootl and he will
close the restaurant and completeiy remodel it I told him that he needs to submit plans and equipment specifiptions and receive approval
before he does any remodeling. He said he will.
I am not certain that he will foilow through as wiliingty as he implied he is willing to do while I was conducting my inspection today.

The Office of License, Inspections and Environmental Protection (LIEP) has
recommended that the license application by D& M Tuscany, Inc., d/b/a Tuscany Grill &
Pizzaria for the premises at 1051 Hudson Road in Saint Paul be denied. The basis for the
recommendation is as follows:
On August 10, 2000 you applied for a Restaurant license at
1047 Hudson Road. This license has never been issued and
Health approval is sti11 required. The inspector cannot gain
access to the business. On April 23, 2001 your were advised by
a letter from LIEP that they wished to know the status of your
project and that if they had not heard from you by �iay 4, 2001
that the £te on the application would be closed. As of today's
date they have had no response and the license cannot be
issued until all of the requirements are met. Accordingly, they
are recommending denial of your license application.
If you do not dispute the above facts, please send me a letter �vith a statement to that
effect. The matter will then be scheduled for a hearing before the Saint Paul City Council to
determine what penalty, if any, to impose. You will have an opportunity to appear before the
Council and make a statement on your o�vn behalf. The recommendation from the licensing
office is for the denial of your license application.

WHEREAS, the Office of License, Inspections and Emironmental Protecriott (LIEP) has recommended the
denial of the applicarion for a Restaurant (A) license by D& M Tuscany, Inc., d/b/a Tuscany Grill & Pizzaria for
the premises at 1051 Hudson Road in Saint Paul; and
WHEREAS, a Norice of Intent to Deny the License was sent to the license applicant on June 21, 2001
staring that the recommendation was based upon the premises not being available for inspecrion and the licensee's
failure to respond to a letter from the Office of LIEP asking for the status of the project, and in response to the
Notice the applicant ananged for an inspecrion; and
WHEREAS, a second Norice of Intent to Deny the License was sent to the applicant based upon the fact
thaE the premises were not in compliance with the food code and the applicant responded that all changes would be
made by September 1, 2001; and
WHEREAS, an inspecrion on September 7, 2001 of the premises showed considerable repair work still to
be done in the restaurant arza, and the premises srill in violation of the food code, with no likelihood the premises
would be in compliance in the neaz future; and
WHEREAS, the application was first received on August 10, 2000, and the matter has been pending for
over a year without the premises being in compliance; now, therefore be it
RESOLVED, that the application for a Restaurant (A) license by D& M Tuscany, Inc., d/b/a Tuscany

Dear Mr. Ubel:
The Office of License, Inspections and Environmental Protection (LIEP) has
recommended that the license application by D& M Tuscany, Inc., dlbia Tuscany Grill &
Pizzaria for the premises at 1051 Hudson Road in Saint Paul be denied. The basis for the
recommendation is as follows:
On June 21, 2001 you were advised that the Office of LIEP was
recommending denial of your license application because the
Healh inspector could not gain access to the business and the
aQproval was still lacking. Tn response you informed this office
that the premises would be available for inspection. On July
10, 2001, an inspection was done of the facility and you were
informed that the premises were not in compliance with the
food code. Accordingly, LIEP is still recommending denial of
your license application.
If you do not dispute the above facts, please send me a letter �vith a statement to that
effect. The matter will then be scheduled for a hearing before the Saint Paul City Council to
determine what penalty, if any, to impose. You will have an opportunity to appear before the
Council and make a statement on your own behalf. The recommendation from the licensin�
office is for the denial of your license application.

On the other hand, if you wish to dispute the above facts, you are entitled to an
evidentiary hearing before an administrative law jud�e. If you wish to have such a hearin�,

and an explanation of the procedures.
In either case, please let me know in writing no later than Thursday, Au�ust 2, 2001, how
you would like to proceed. If you have not co.ntacted me by Thursday, August 2, 2001, I will
assume that you are not contesting the facts. I will then schedule this matter for the St.
Paul City Council and have it placed on the Consent Agenda during which no public
discussion is allowed and the recommended penalty will be imposed.

Mark Kaisersatt and I inspected the Tuscany Grill this moming at approximately 10:00 AM. The grill is attached to a liquor store and uses a common
front entry door. When we entered the building the restaurant xas not open, but there was a man at the counter of the liquor store. 1 asked him about
the resiaurant and he said they donY have sit down sales but deliver food heginning at 4:00 PM. I told him we want to inspect the resfaurant. He said
the ownerwas in the liquor store.
Mr. Uhet came to ihe Nont of the liquor store and f asked him what had been done since f was here in January. He staAed g'rving excuses about his
injury. I asked him if anything had actually been done. He said he has cleaned the ezhaust hood and has a fiend who is going to repair the walis and
fix the place.
As we vraiked through the narrow kitchen, between the cook line and the dishmachine there was a very sVOng odor of garbage. Mark K. notcied a
garbage can full of garbage that had live maggots in it. I asked Mr. Ubei how long that had been there. He said they had a problem with their garbage
on 7/04/Ot. I told him to get it out of fhe kitchen. He did.
We walked thmugh the whole restaurant and ihere was rro significant improvement, in fact, tt�e place was much dirtier than when I inspected in
January and Ne walk-in cooler has continued to deferiorata. I taW Mr. Ubef that l would not approve his license. He said he undecstootl and he will
close the restaurant and completeiy remodel it I told him that he needs to submit plans and equipment specifiptions and receive approval
before he does any remodeling. He said he will.
I am not certain that he will foilow through as wiliingty as he implied he is willing to do while I was conducting my inspection today.

The Office of License, Inspections and Environmental Protection (LIEP) has
recommended that the license application by D& M Tuscany, Inc., d/b/a Tuscany Grill &
Pizzaria for the premises at 1051 Hudson Road in Saint Paul be denied. The basis for the
recommendation is as follows:
On August 10, 2000 you applied for a Restaurant license at
1047 Hudson Road. This license has never been issued and
Health approval is sti11 required. The inspector cannot gain
access to the business. On April 23, 2001 your were advised by
a letter from LIEP that they wished to know the status of your
project and that if they had not heard from you by �iay 4, 2001
that the £te on the application would be closed. As of today's
date they have had no response and the license cannot be
issued until all of the requirements are met. Accordingly, they
are recommending denial of your license application.
If you do not dispute the above facts, please send me a letter �vith a statement to that
effect. The matter will then be scheduled for a hearing before the Saint Paul City Council to
determine what penalty, if any, to impose. You will have an opportunity to appear before the
Council and make a statement on your o�vn behalf. The recommendation from the licensing
office is for the denial of your license application.

WHEREAS, the Office of License, Inspections and Emironmental Protecriott (LIEP) has recommended the
denial of the applicarion for a Restaurant (A) license by D& M Tuscany, Inc., d/b/a Tuscany Grill & Pizzaria for
the premises at 1051 Hudson Road in Saint Paul; and
WHEREAS, a Norice of Intent to Deny the License was sent to the license applicant on June 21, 2001
staring that the recommendation was based upon the premises not being available for inspecrion and the licensee's
failure to respond to a letter from the Office of LIEP asking for the status of the project, and in response to the
Notice the applicant ananged for an inspecrion; and
WHEREAS, a second Norice of Intent to Deny the License was sent to the applicant based upon the fact
thaE the premises were not in compliance with the food code and the applicant responded that all changes would be
made by September 1, 2001; and
WHEREAS, an inspecrion on September 7, 2001 of the premises showed considerable repair work still to
be done in the restaurant arza, and the premises srill in violation of the food code, with no likelihood the premises
would be in compliance in the neaz future; and
WHEREAS, the application was first received on August 10, 2000, and the matter has been pending for
over a year without the premises being in compliance; now, therefore be it
RESOLVED, that the application for a Restaurant (A) license by D& M Tuscany, Inc., d/b/a Tuscany

Dear Mr. Ubel:
The Office of License, Inspections and Environmental Protection (LIEP) has
recommended that the license application by D& M Tuscany, Inc., dlbia Tuscany Grill &
Pizzaria for the premises at 1051 Hudson Road in Saint Paul be denied. The basis for the
recommendation is as follows:
On June 21, 2001 you were advised that the Office of LIEP was
recommending denial of your license application because the
Healh inspector could not gain access to the business and the
aQproval was still lacking. Tn response you informed this office
that the premises would be available for inspection. On July
10, 2001, an inspection was done of the facility and you were
informed that the premises were not in compliance with the
food code. Accordingly, LIEP is still recommending denial of
your license application.
If you do not dispute the above facts, please send me a letter �vith a statement to that
effect. The matter will then be scheduled for a hearing before the Saint Paul City Council to
determine what penalty, if any, to impose. You will have an opportunity to appear before the
Council and make a statement on your own behalf. The recommendation from the licensin�
office is for the denial of your license application.

On the other hand, if you wish to dispute the above facts, you are entitled to an
evidentiary hearing before an administrative law jud�e. If you wish to have such a hearin�,
please send a letter stating that you are contesting the facts. You will then be sent a"Notice of
Hearing" with the date, time and place for the hearing, the name of the administrative law judge,
and an explanation of the procedures.
In either case, please let me know in writing no later than Thursday, Au�ust 2, 2001, how
you would like to proceed. If you have not co.ntacted me by Thursday, August 2, 2001, I will
assume that you are not contesting the facts. I will then schedule this matter for the St.
Paul City Council and have it placed on the Consent Agenda during which no public
discussion is allowed and the recommended penalty will be imposed.

Mark Kaisersatt and I inspected the Tuscany Grill this moming at approximately 10:00 AM. The grill is attached to a liquor store and uses a common
front entry door. When we entered the building the restaurant xas not open, but there was a man at the counter of the liquor store. 1 asked him about
the resiaurant and he said they donY have sit down sales but deliver food heginning at 4:00 PM. I told him we want to inspect the resfaurant. He said
the ownerwas in the liquor store.
Mr. Uhet came to ihe Nont of the liquor store and f asked him what had been done since f was here in January. He staAed g'rving excuses about his
injury. I asked him if anything had actually been done. He said he has cleaned the ezhaust hood and has a fiend who is going to repair the walis and
fix the place.
As we vraiked through the narrow kitchen, between the cook line and the dishmachine there was a very sVOng odor of garbage. Mark K. notcied a
garbage can full of garbage that had live maggots in it. I asked Mr. Ubei how long that had been there. He said they had a problem with their garbage
on 7/04/Ot. I told him to get it out of fhe kitchen. He did.
We walked thmugh the whole restaurant and ihere was rro significant improvement, in fact, tt�e place was much dirtier than when I inspected in
January and Ne walk-in cooler has continued to deferiorata. I taW Mr. Ubef that l would not approve his license. He said he undecstootl and he will
close the restaurant and completeiy remodel it I told him that he needs to submit plans and equipment specifiptions and receive approval
before he does any remodeling. He said he will.
I am not certain that he will foilow through as wiliingty as he implied he is willing to do while I was conducting my inspection today.

All af the changes that are being made regardig the
inspection repor�t, have taken longer than ex�ected due
to personal injury: In febuary of 200i I had su�fered a
broken Ieg, followed by majorortho�copic surgery to rebuild
my left ankle. Time and money were both wasted �n the
completion of the changes at hand. Sti11, the renovation
cotinues regarding the inspection report. The updates in
equipment and other ehanges will be met by this business
and its landlord Property iVianagement Inc.( building owners).
Access to this bui�ing is available Mon-Fri 9-5

The Office of License, Inspections and Environmental Protection (LIEP) has
recommended that the license application by D& M Tuscany, Inc., d/b/a Tuscany Grill &
Pizzaria for the premises at 1051 Hudson Road in Saint Paul be denied. The basis for the
recommendation is as follows:
On August 10, 2000 you applied for a Restaurant license at
1047 Hudson Road. This license has never been issued and
Health approval is sti11 required. The inspector cannot gain
access to the business. On April 23, 2001 your were advised by
a letter from LIEP that they wished to know the status of your
project and that if they had not heard from you by �iay 4, 2001
that the £te on the application would be closed. As of today's
date they have had no response and the license cannot be
issued until all of the requirements are met. Accordingly, they
are recommending denial of your license application.
If you do not dispute the above facts, please send me a letter �vith a statement to that
effect. The matter will then be scheduled for a hearing before the Saint Paul City Council to
determine what penalty, if any, to impose. You will have an opportunity to appear before the
Council and make a statement on your o�vn behalf. The recommendation from the licensing
office is for the denial of your license application.

evidentiary hearing before an administrative law jud�e. If you wish to have such a hearin�,

and an explanation of the procedures.
In either case, please let me laiow in writing no later than Monday, July 2, 2001, how you
would like to proceed. If you have aot conta�ted me by Monday, July 2, 2001, I will assume
that you are not contesting the facts. I will then schedule this matter for the St. Paul City
Council and have it placed on the Consent Agenda during which no public discussion is
allowed and the recommended penalty will be imposed.
