situated on those premises legally
described as Except the East 2 feet,
Lot 16, Block 9, Nininger and Donnelly' s
Addition to Holcombe's Addition to Saint
Paul, according to the plat on file and
of record in the office of the Register
of Deeds in and for the County of Ra�sey,
State of Minnesota
WHEREAS� pursuant to Resolution, C.F. 266331, approved
November 6� 1975� a public hearing was scheduled for 10:00 a.m.
on November 20, 1975 before the Gouncil of the City of Saint
Paul, said hearing pertaining to the condition of the structure
located at 833 Hague Avenue, Saint_:Paul, Minnesota; and
WHEREAS, upon facts presented at said hearing consisting
of photographs inspection reports and the recommendation of
the Division of Housing and Building Code Enforcement, it is
found and determined by the City Council that according to
the records and f iles in the offi.ce of the Register of Deeds,
the last record owners of the above described property are
John Kotlar, Esther Fishman and Revella Optowitzer Apton; and
that there are no lien holder� o� record; and that it is further
determined that the above described building constitutes a
ha.zardous building within the definition of Minnesota Statutes
Section 463.15 for the following reasons:

� a. The bu'ilding is standing vacant, abandaned, and
� is subject to being entered by unauthorized persons;
b. The condition of the building is as follows� Due
to age and lack of proper maintenance, the dwelling is in
a dilapidated and hazardous condition. The windows are open
and some have been removed. The floors are heawed and
deteriorated. The front and rear porches are decayed and
hazardous. The building has been vandalized to such an
extent that the Division of Housing and Building Code Enforce-
ment deems it is beyond feasible rehabilitation and should
be removed as soon as possible;
c. The building is unfit for human habitatia.n in its
present condition;
d.. The bui,lding consti�utes a nuisance and a hazard
to the public health� safety and welfare because of its -
physical damage, dil�.pidation and ina.dequate maintenance;

RESOLVED., That �n accord�ncE with Minnesota Statutes Sections
463. 15 through 4fi3. 26, a�d based upon the foregoing findings of
the City Council, the Council of the City of Sain,t Paul does
hereby ma.ke tl�e following Order:

the same safe and nQt .detrimental, ta .the public pe�.ce, :��a�.�t]�,
safety and welfare by .Yiaviang= the��sa�d bui�ci'ing razed and the
materials �herefrom removed from the premises within thirty (30)
days from th� date of the service of �his Order;
2, Unless such corrective action is taken �6 comply
with this Order �r an answer served upon the City of Saint
Paul and filed in the Office of the Clerk of District Court
of Ram:sey County, Minnesota within twenty (20} days frofn �
the date of the service of this Order, a Motion for� 5ucr�ary
Enforcement of this Order to raze and remove the said building
will be made to the Ramsey Ca�ty District Court;

3. In the event that the building is to be razed by
the City of Saint Paul pursuant to judgment of the District
Court, all personal property or fixtures whi�ch ma.y unreason-
ably interfere with the razing and removal of this bu ilding
shall be removed within ten (10) days from the entry of
judgment; and if not so removed, the City of Saint Paul shall
remove and dispose of such personal property and fixtures
as provided by law;
4. If the City of Saint Paul is compelled to take any
corrective action herein, all necessary costs and expenses
of the City will be assessed against the above described real
estate and collect as other taxes; and be it
FURTHER RESOLVED, that a certified copy of this resolution
and incorporated Order herein be served upon the lasti record
owners of the above described property in the manner provided
by law.

The Division of Housing and Building Code Enforcement is hereby sub-
mitting its report on the: condition of the structure at the location
referred to above.
The owners of record are John Kotlar, Esther Fishman and Revella Op-
towitzer Apton, 161 N. Dale Street, St. Paul, Minnesota.
The legal description of the property is:
Exeept the East 2 feet of I,ot 16, Block 9,
Nininger and Donnelly's Addition. -
