01-940Council File # 41- g y0 Crreen Sheet # ( O '1 e1 $' 1 l Presented By Referred To Committee: Date WHEREAS, Chapter 293 of the Saint Paul Legislative Code was enacted to regulate the subject of noise in the City of Saint Paul; and WHEREAS, §293.11 provides for the granting of variances from the sound level limitations contained in §293.09, upon a finding by the City Council that full compliance with Chapter 293 would constitute an unreasonable hardship on an applicant, other persons or on the community; and WAEREAS, McGough Construction, represented by Rick Steinberger, Superintendent, who has been designated as the responsible person on the application, has applied for a variance to allow concrete pouring as part of construction work to take place at 236 Smith Avenue, on seven dates between September 1, 2001 through December 31,2001, the approximate dates, weather permitting, being September 4th, September 12 September 25 October 4`", October 16th, October 30 and November 20 and wHEREAS, applicant is seeking a variance for the hours of 3:00 a.m. to 3:00 p.m. for each of the days on which the concrete work is to be performed during the course of the project; and WHEREAS, granting a variance will reduce traffic congestion during the work and will contribute to a safer operation; and WHEREAS, the Office of License, Inspections, and Environmental Protection has reviewed the application and has made recommendations regarding issuing the variance; now, therefore, be it RESOLVED, that the Council of the City of Saint Paul hereby grants a variance to McGough Construction to allow concrete pumping and operation of concrete trucks as necessary to complete the work at 236 N.
