The staPf of the Bureau of Valuations has revierored the complaints in con- nection with the subject matter. The report on the two properties ixivolved is attached. It is n�r apinion that adequate damages have been awarded in regard to slope damages for said i.mprovement. Mr. Ekha.ml of 158]. Payne Avenue has filed. a formal cla.im against the City, which claim is being investigated by the City Attorney's 0�'f'ice. Since the slope problem and claim have no affect on the sub�ect ratification order, I recommend tY1at the order be approved.. Bredahl, Jr. Date: October 31, 1975 Subject: Report oa Alley in Block 4, Ufton Grove, Plat 1 Camplaints of Mr. Clarence Schultz and Mr. Louis Ekhaml Lot 3, Block �+, Ufton Grove, Plat l: This is the property owned by Mr. Clarence Sahultz. The slope construction adjacent to this property consisted of cut amountin� to approxim�.tely 6 inches at the north property line to less than 12 feet at the south property line. The extent of said slopes being confined entire]y within the City's Right-of Way and the grade not being detrimental to the �arage access on this property. Therefore, in a�y opinion, there was no dama�e to the sub3ect property because of the slope constructionirivolved. Lots 5, 6 and 7, Block �+, Uf`ton Grove, Plat 1: This property is vwned by Mr. Louis Ekhaml. The slope con- struction ad�acent to this property consisted of fill amounting to a maximum of approximately 4 feet. A viewing of this pro�ect prior to a11ey construction, indicated that the southwesterly p�rt of this tract of land was lcyw in relation to the ad3acent street �rades of Payne Avenue and Hoyt Avenue. This law area was covered with wild grawth, old tires, other debris, bruah and trees. This office esti�ted dama�es in the amount of $100 to provide for protection to the existin� shed or garage and for sodding of improved yard area. This amount would restore the property to a condition equivalent to arhat existed priar to the alley construction. The City's contractar� also furnished this tract with the excess dirt material that was available on the project to partial]y fill the lvw area, and the trees and brush were also removed. for the property o�rner. The property was viewed this date and the clearing and fi11 provided, consider- ab�y improved the aesthetics ar�d property values for this tract. It is �y opinion that the allowances for the slopes ci,amages in- volved were generously adequate and would reco�end that ar�y additional claim be denied.
