F. 266107, approved October 3, 1�75, a public hearing was scheduled for 10:00 a.m. on October 9, 1975 before the Council of the City of Saint Paul, �aid hearing pertaining to thE condition of the structure located at Z72 Dayton Avenue, Saint Paul, Minnesota; and WHEREAS, upon facts presented at said hearing consisting Y. of photographs, inspection reports and the recommendation of the Division of Housing and Building Code Enforcec�ent, it is found and determ:i.ned by the City Council that according to the records and files in the office of the Register of Deeds, the last record owner of the above described property is University Motors, Inc. , and tha.t there are no lien holders of record; and that it is further determined tha.t the above described building constitutes a ha.zardous building within the definition of Minnesota Statutes Section 463.15 for the following reasons: a. The building constitutes a nuisance and a hazard . to the public health, safety and welfare because of` its physiE�l damage, dilapidation and inadequate ma.intenance; now, therefore, be it RESOLVEI}, That in accordance with Minnesota Statutes Sectio�.s 463.15 through 463.26, and based upon the foregoing findings of the City Council, the Council of the City of Saint Paul does hereby ma.ke the following Order: ORDER 1. The� owner of the above described building shall ma.ke the same safe and not detrimental to the public peace, health, safety and welfare by having the said building razed and the ma.terials therefrom removed from the premises within thirty (30) days from the date of the service of this Order; 2. Unless such corrective action is taken to comply with this Order or an answer served upon t�ie City of saint Paul and filed in the Office of the Clerk of D�strict Gourt of Ramsey County, Minnesota within twenty (20) �ays from the date of the service of this Order, a Motion for Summary Enforcement of this Order to raze and remove the said building will be ma.de to the Ramsey County District Court; 3. ' Phone 612-298-4212 , September 12, 1975 Members of the City Council Re: 772 Dayton Avenue File Na. 2521, Honorable Council: The Division of Housing and Building Code Enfoxcement is hereby submitting its report on the condition of the structure at the location referred to above. The owners of record are University Motors , 712 N. W. National Bank Building, St. Paul, Minnesota, 5510T. The legal description of the property is Lot 8, Block 6 , Nininger & Donnelly's Addition. We believe this building to be beyond rehabilitation. The roof is rotten and has holes in it, the chimney is in hazardous condition, the basement is in poor condition as the joists and supports are poor and the walls are cracked. The first and second floors have been damaged by fire, the plaster is cracked and falling throughout, the floors are warped and decayed and the electrical wiring, plumbing and heating systems have been vandal- ized and burned. The Building Department reco�nends the condemnation and removal of this two-story frame dwelling as soon as possible. Inasmuch as the conditions outlined above constitute a public hazard and the owner has made no attempt to satisfactorily repair the dam- age despite our warnings, and the continued vacant and boarded up condition contributes a blighting influence on the neighborhood, it � � T�f ���,_ 1 . � Members of City Council 9/1�/75 is the recommendation of this bureau that this matter be referred to the City Attorney's office for razing and removal through Dis- tric Court proceedings.
