WHEREAS, ON January 16, 1975 Simon Ortega filed a
claim against the City of St. Paul for injuries he is alleged
to have sustained on January 4, 1975 due to a fall on ice
on the sidewalk on East Isabel adjacent to the West-Sider
Bar, 429 South Robert Street, and
WHEREAS, Simon Ortega sustained a fracture of his
right hip, incurred medical expense in excess of $4,800,
and
WHEREAS, a probable liability for said injury does
exist as to the City of St. Paul and the West-Sider Bar,
Now therefo�re, be it resolved that upon the said -
Simon Ortega furnishing a properly executed release dis-
charging and rel�easing all possible claims against the City
of St. Paul and the West-Sider Bar for a consideration of
$7,500, the proper city officers are hereby authorized and
directed to p�y out of the Tort Liability Fund 09070-420-000
to Simon Ortega and Lester D. Walters, his attorney, the
sum of $2,333 .33� the West-Sider Bar being obligated to
pay the balance of $5166.67.
