CASE N0. PROPERTY APPELLANT
41-75-B 1954 Rome Michael J. McGough
SUBJECT:
Request for garage variance from St. Paul Legislative Code, Section 40.00 (i) ,
pertaining to the requirement that any garage which is to the rear of the residence
shall not be closer than two feet (2 ft.) to the side lot line, so as to utilize
existing retaini.g wall on the east property line as the back wall of the new
garage to be built thereon.
APPEARANCE:

= Michael J. McGough
PROCEEDINGS•
Mr. McGough said that his garage burned down two years ago and he had installed
a retaining wall of re-inforced concrete block on frost footings at the side
property line. He wanted to build a garage now, using the retaining wall as the
back wall of the garage. With a 40 ft. lot, and because garages and hedges
of his neighbors were on the alley line, this would be the only way he could glace
the new garage so that he could get his car into and out of it. He therefore
was asking for a variance from the two ft. requirement from the side lot Iine.
rir. Person said that there were no objections from the Code Enforcement Division
to the granting of such a variance.
BOARD ACTION: _
Chairman Wozniak moved that a garage variance from St. Paul Legislative Code,
Section 40.00 (i) , pertaining to the requirement that any garage which is to the
rear of a residence shall not be closer than two ft, to the side lot Iine, be
granted. Mrs. Peake seconded. Pi0TI0N CARRIED AND SO ORDERED.

CASE N0. PROPERTY APPELLANT
40-75-B 1816 AShland Ave. Jon Bjornnes
SUBJECT:
Request for Garage Variance from St. Paul Legislative Code, Section 33.04 (2) ,
pertaining to Rear Yard Clearance requirement of a minimum distance of 25 ft. from
main portion of the dwelling, so as to build rear-attached garage.
APPEARAN E:
Jon Bjornnes
PROCEEDINGS:
Mr. Bjornnes stated that because the rear 50 feet of the original lot his home was
built on was sold, he could not attach a garage to the rear of his house and still
have a 25 ft. clearance to the rear line. He could build a detached garage within
ttie space, and thereby conform to the Building Coe, but he preferred an attached
structure.
Mr. Person explained that rir. Bjornnes' lot was what is known as a back lat, which
requires 25 ft. of clearance, whereas a side lot would require only two ft. of
clearance. He did not have any objection to Mr. Bjornnes' plan to build an attached
garage with less than the amount of clearance required by the Euilding Code.

Request for Garage Variance from St. Paul Legislative Code, Section 40.00 (i),
requiring 2 ft. side lot clearance fror property line for any garage which is to
the rear of the residence so as to permit 4-car garage to be built in rear of
property facing alley.
PROCFEDINGS:
Mr. Zappa said that Mr. Walk wanted to build a 36 ft. wide, four-car garage.
Because the garage next door on one side was on the property line,
Mr. Walk wanted to build his garage three feet from the line on that side, bur
this would leave only one foot clearance on the other side. On any bTiilding
closer than three feet of the property line, fireproofing was required on the wall
facing the line, and Mr. Walk was prepared to have this done.
Chairman Wozniak asked Mr. Person if his department considered such a placement
of a garage to be a problem, and Mr. Person said his department had no objection
as long as the wall nearest the property line was fireproofed. There were also
no objections from Mr. Walk's neighbors.
BOARD ACTION:
Chairman Wozniak moved that a garage variance from St. Paul Legislative Code,
Section 40.00 (i), requiring 2 ft. side lot clearance from property line for any
garage which i.s to the rear of the residence so as to permit a four-car garage
to be built in rear of property facing alley, be granted. Mr. Glassman seconded.
