Dear Madam:
This is written in response to the application of Midas Corporation
for a permit to install a 43-car parking lot on property located on
the southwest corner of St. Peter and Exchange. This property is
further described as follows:
Northerly 147.6 feet of Lots 1 and 2, Block 9, Bazil and
Guerin's Addition to Saint Paul.
This matter was first heard by the Board of Zoning on July 17, 1975.
Mr. Cahill, representing the Church of the Assumption, expressed concern
over the proposed parking facility as their property adjoins the subject
site. Due to the absence of the applicant, the matter was tabled to
the next Board meeting.
This matter was again heard on August 7, 1975, at which time staff
reco�nended approval of the permit contingent upon the developer's
capacity to meet design standards, and the requirements of various
City departments. Staff also recommended that a rail be placed along
the entire length of th'e adjacent building to protect it from damage.
The applicant explained that a compromise had been reached with the
Church of the Assumption on the easement.
A motion was made to recommend approval of the permit subject to the
requirements set forth by the various City departments. The motion
was seconded and carried unanimously.
Revised plans received August 28, 1975, meet design standards.

PRESENT: Mme. Showalter, Messrs. Bryan, Hummer, Willits, and Rupp
of the Board; Mr. Sipkins, Assistant City Attorney;
Mr. McGuire, Mr. Miller, and Miss Jacobson of the Planning
Department Staff.
MIDAS CORPORATION (7780): An application to install a 43-car parking lot on
property located at the southwest corner of St. Peter and Exchange.
Mr. McGuire gave the staff report. The a.pplicant was not present.
Mr. Jim Cahill of the Church of the Assumption expressed a desire to ask
some questions regarding the proposed parking lot, which property adjoins
the school of the Church of the Assumption. Mr. Cahill requested curb stops
or the like to protect the building. He also asked about signs and Mr. McGuire
explained the sign situation as set forth by the Traffic Engineer. Mr. Cahill
asked about landscaping of the area, and Mr. McGuire said that there was no .
landscaping included in the plans.
Mr. Hummer made a motion to table the matter due to the absence of the
applicant. Mr. Bryan seconded the motion to table and it carried unanimously.
Mr. Rupp asked for a memo on the Midas Corporation application.
Mr. Rupp requested that the City Attorney and the Building Department prosecute
�� Knox Lumber Company and the Midas Corporation for not appearing at the meeting
after having been properly notified of the hearing.

The petitioner stated that he had spoken to Mr. Cahill of the Church of
the Assumption and had agreed upon`a compromise on �he easement, and would
consider closing the driveway adjacent to the Church and putting ina bumper
stops. Mr. Rupp asked for a revised plan from the petitioner.
Mr. Hummer moved that the Board recommend approval of the permit subject
to the requirements which had been set forth. Mr. Willits seconded the
motion and it carried unanimously.
