2 WHEREAS, Payless Cashways Corporation, d/b/a Knox Lumber, is selling a parcel of
3 property near the intersection of Prior and University. The subject parcel is presently zoned I-1

WHEREAS, the parcel of ]and in question is approximately 8 acres in size and is located
along major transportation corridors which affords easy access to the site; and
WHEREAS, the Midway Chamber of Commerce indicated in a letter to the City Council
dated August 17, 2001, that "Prior and University has seen little redevelopment activity" and that
the Chamber believed that "thoughtful redevelopment of The Knox site may be a catalyst To
revitalization of this entire intersection." Given, in its opinion, the potential for revitalization in
the area, the Chamber requested that the City Council place a skort term moratorium on the
parcel in order for the City to study its redevelopment or rezoning options for the parcel; and
WHEREAS, such a study may lea@ to the adoption of amendments to the City's
comprehensive municipal plan and to its official zoning controls over the parcel; and
WFIEREAS, development of the parcel while the study is in progress could result in land
uses which would not be consistent with the present goals of the City's comprehensive municipal
plan; and
WHEREAS, the potential for incompatible or inconsistent development of the parcel raises
substantial questions relating to the ability of the City's present official controls to assure
compliance with the City's comprehensive plans ar amendments thereto; and
WHEREAS, in light of the need for a study of the redevelopment or rezoning options for
the pazcel and for the purpose of identifying an overall vision for this large pazcel area and the
immediate need to preserve the status quo with respect to its present land use classification in
order to protect the general health, welfare and safety of the public pending the conclusion of a
study of the parcel, the Council of the City of Saint Paul desires to immediately temporarily
prohibit development of the parcel or any part thereof until such time as the aforementioned
study has been completed and the Council of the City of Saint Paul has taken action on the
recommendations contained therein:
2 NOW, THEREFORE, BE'� RE � 0���; that the Council of the City of Saint Paul � �' 9 ��
3 requests the Department of Planning and Economic Development to commence a study
4 analyzing the redevelopment opportunities and zoning options for the properiy north of
5 University and west of Prior and presently occupied by the Knox Lumber Company; AND,
6
7 BE IT F[TRTHER RESOLVED, that under separate ordinance, the Council of the City of
8 Saint Paul will prohibit on any parcel of land or part thereof within the azea presently occupied
9 by the Knox Lumber Company, the issuance or approval of zonin� and building permits, plat
10 approvals or lot splits, until the expiration of three months as provided in Minn. Stat. § 462.355,
11 Subd.(4), or until such earlier time as the Council of the City of Saint Paul has taken action on
12 the recommendations contained in the study; AND,
13
14 BE IT FURTHER RESOLVED, that pending the adoption of the interim ordinance
15 prohibiting any development inconsistent with the pending study and any amendments to the
16 City's zoning code within the boundaries of the described areas, no zoning or building permits,
17 plat approvals or lot splits may be issued or approved, unless exempted as provided under the
18 terms set forth in Section Three of that same separate ordinance from this date and until the
19 expiration of three months as allowed by Minn. Stat. § 462355, Subd.(4), or until such earlier
20 time as the Council of the City of Saint Paul has taken action on the recommendations contained
21 in the study; AND
22
23 BE IT FINALLY RESOLVED, that the restrictions contained in this resolution and in the
24 said interim ordinance may be extended by action of the Council of the City of Saint Paul for
25 those additional time periods not to exceed the time provided in Minn. Stat. § 462.355, Subd. (4)
26 in the event such study and recommendations and the deliberations of the Council requires such
27 extensions of time.

The Midway Chamber of Commerce is requesting that the City Council
place a short term moratorium on redevelopment or rezoning of the
approximataly 8 acre site currently occupied by Knox Lumber at 573 Prior
Avenue in Ward 4 in order for the city and community to study the options
for the site.
Knox Lumber has recently announced that it is seeking bankruptcy
protection and that its assets will be liquidated. The Chamber believes
that this large site has strong redevelopment potential but that in the
bankruptcy process a new use for the site could prevail that does not
maximize this potential. ln past bankruptcy situations, such as that
involving Wintz Trucking on Energy Park Drive three years ago, large
Midway I1 sites have been sold to uses that do not represent the highest
and best use of our scarca land. To prevent this situation from occurring
at the I{nox site, the Chamber would tike to see a short term moratorium
in place to allow the city and the community to unde�take an analysis of
the best land use and market potantial,
The Chamber recognizes that moratoriums are unusuai but generally
we believe that large urban sites, such as the Knox site, represent unusual
opportunities that are legitimate for public sector study. The goal of this
study would be to examine the options to maximize the sita in terms of
employment, private investment, tax generation, etc. We suggest that a
small Task Force of stakeholders, including the Hamline Midway
Coalition and Chamber, be charged with overseeing a brief study of the
redevelopment potential of the site and report back to the City Council on
their findings.
The intersection of Prior and University is one of few in the wast
Midway that has not seen new investment in recent years. Fairview and
University is undergoing a transformation thanks to Episcopal Homes,
Goodwill and Griggs Midway. Vandalia and University has seen a former
gas station uansformed into a new branch bank. Raymond and University

The Midway Chamber of Commerce is requesting that the City Council
place a short term moratorium on redevelopment or rezoning of the
approximataly 8 acre site currently occupied by Knox Lumber at 573 Prior
Avenue in Ward 4 in order for the city and community to study the options
for the site.
Knox Lumber has recently announced that it is seeking bankruptcy
protection and that its assets will be liquidated. The Chamber believes
that this large site has strong redevelopment potential but that in the
bankruptcy process a new use for the site could prevail that does not
maximize this potential. ln past bankruptcy situations, such as that
involving Wintz Trucking on Energy Park Drive three years ago, large
Midway I1 sites have been sold to uses that do not represent the highest
and best use of our scarca land. To prevent this situation from occurring
at the I{nox site, the Chamber would tike to see a short term moratorium
in place to allow the city and the community to unde�take an analysis of
the best land use and market potantial,
The Chamber recognizes that moratoriums are unusuai but generally
we believe that large urban sites, such as the Knox site, represent unusual
opportunities that are legitimate for public sector study. The goal of this
study would be to examine the options to maximize the sita in terms of
employment, private investment, tax generation, etc. We suggest that a
small Task Force of stakeholders, including the Hamline Midway
Coalition and Chamber, be charged with overseeing a brief study of the
redevelopment potential of the site and report back to the City Council on
their findings.
The intersection of Prior and University is one of few in the wast
Midway that has not seen new investment in recent years. Fairview and
University is undergoing a transformation thanks to Episcopal Homes,
Goodwill and Griggs Midway. Vandalia and University has seen a former
gas station uansformed into a new branch bank. Raymond and University

has seen the Specialty Manufacturing building and Midtown Commons 3 attracting new
office tenants. Prior and University has seen little redevelopment activity and the
Chamber believae that thoughtful redevelopment of the Knox site may be a catalyst to
revitalization of this entire intersection.

we can ensura increased economic vitality for the Midway and St. Paul.
