Pursua.nt to Minnesota Statutes, Section 410. 12, Subdivision 7, and upon the recommendation of the Charter Commission of the City of Saint Paul, and following a public hearing upon which two weeks' published notice containing the text of the proposed amendment ha.s been provided, the Cha.rter of the City of Saint Paul is hereby amended by striking Section 10. 16 therefrom in its entirety, and substituting in lieu and in place thereof, the following: Sec. 10. 16. Tax Antici tion Certificates. The council by resolution may, wit out a vote o t e electorate, from time to time as the cash in the city's treasury is in- adequa.te to meet city obl�ga�ions as they �ecome due, borrow money by issuing its notes, bonds, tax anticipation certificates or other obligations evidencing the indebted- ness of the city therefor and in amounts as the council ma.y prescribe. Pursua.nt to Minnesota Statutes, Section 410.12, Subdivision 7, and upon the recommendation of the Cha.rter Commission of the City of Saint Paul, the Cha.rter of the City of Saint Paul is hereby amended by striking Section 10. 16 therefrom in its entirety and substituting in lieu and in place thereof the following: Sec. 10. 16. Tax Antici tion Certificates. The council by resolution ma.y, wit out a vote o t e elector- ate, from time to time as the cash in the city' s treasury is ina.dequa.te to meet city obligations as they become due, borrow money and execute note5, bonds, tax anticipa.tion certificates or other evidence of indebted- ness of the city therefor and in amounts as the council may prescribe. The notes or tax anticipation certificates sha.11 be payable in the calendar year in which they are issued and ma.y bear interest at a rate as the council shall determine. The loans sha.11 at no time exceed the uncollected portion of the tax� levy for the current year. The essence of the paragraph is substantially the same as the origina.l Section 10. 12 . The above phrase is added to Section 10. 12 to make it clearer that the . general State legislation permitting sale of bonds w�` '::h- . out a vote of the electorate will supersede the City Charter. - Section 10. 13 .is proposed to be amended so as to provide that Tax Anticipation Certificates may be negotiated without the necessity of a public sale and, further, to provide that the full faith and credit of the City is pledged for the repayment of Tax Anticipation Certificates . The proposed change to Section 10. 16 again deals with Tax Anticipation Certificates, and the amendment is intended to provide that both the principa.l and interest f or re- payment of tax anticipation obligations shall be a first � charge on the moneys to be received by the City f or taxes levied during that year. The present Section 10. 16 pro- vides th.at only the principa.l of the tax antici�a.tion obligations will be secured by the cur.rent year s taxes . We respectfully suggest that these Charter amendments be . ' referred to a Council subcommittee, probably the Legisla- tive subcommittee, and that our office be notified when � the committee will be hearing the proposals so that we may have our bond counsel preserit to explain the reasons � for the requested changes . As you know, if the City Council concurs in the need for � Charter amendment, the proposed changes should be sub-- mitted to the Charter Commission for its consideration and recommendation back to the City Council .
