Dear Madam:
This is written in response to the appeal of the Urban Affairs Committee
of the Archdiocese of St. Paul to relax setback requirements on property
located on the east side of Westminster between Cottage and Hyacinth.
This property is further described by the legal description on file.
This matter was heard by the Board of Zoning on August 7, 1975. Staff
stated that if the block was divided norma.11y, a variance would not be
needed.
It was suggested that the Archdiocese get together with the neighbors
to explain the proposal.
A motion to recommend approval of the variance providing that no more
than 100 units are built on the site carried unanimously.

A. HISTORY: The north 100 feet and the south 75 feet of this property was rezoned to
"�"—�idence on September 4, 1971 . The rest of this property was reioned to "C"
Residence on September 26, 1970, after the District Court ruled that the Council
action denying the petition to rezone was improper. In April , 1972, an appeal to
vary the setback requirements and an application for a permit to construct a 254-
car parking lot for a 135-unit apartment building were granted. An app1ication
for a permit to install a 150-car parking lot is currently pending for this site.
B. PROPOSAL: The appellant proposes to construct three apartment buildings, two
having�6-units and the third with 28 units. The developer proposes to construct
the stairwells to the building fronting on Westminster, entirely within the
setback, putting the building itself at the setback line, in order to provide
the maximum amount of open space in the center of the buildings.
C. VARIANCE: The Zoning Ordinance requires a setback of 27 feet. The proposal is
to construct the stairwells at 15 feet, which is 12 feet closer to the street
line than is allowed. The actual building would be constructed at the legal
setback line.
D. SITE CONDITIONS: The site is vacant and is two or three feet below the grade of
Westminster Street.
E. AREA ZONING: The majority of the block across Westminster is zoned "C" Residential
with the remainder of the block being "A" Residential . Blocks south of the
subject 61ock are zoned "6" Residential . The remainder of the subject block is
"A" Residential .
F. AREA CONDITIONS: Adjoining to the north is a single-family residence; to the east
are scattered single-family residences; south fronting on Westminster Street are
single-family residences. Most of these residences are on large lots. West across
Westminster is a 6-building, 102-unit apartment complex and single-family residences.
Edgemont Street is platted to the north line of Lot 27. The possibility of
opening Edgemont Street south to Hyacinth Avenue could not be determined by a
field investigation.

ON THURSDAY, AUGIIST 7, 1975, AT 3:00 P.M.
PRESENT: Mme. Showalter, Messrs. Bryan, Hummer, Willits, and Rupp of
the Board; Mr. Philip B. Byrne of the City Attorney's Office;
Mr. McGuire, Mr. Miller, and Miss Jacobson of the Planning
Department Staff.
URBAN AFFAIRS C�Il�IITTEE OF THE ARCHDIOCESE OF ST. PAUL (7790): An appeal
to relax setback requirements on property located on the east side of
Westminster between Cottage and Hyacinth.
Mr. McGuire gave the staff report. He stated that if the block was divided
normally, they would not require a variance of the Ordinance; but the
unusual way in which the block is divided is the only reason the setback
requirements need to be relaxed,
Mr. Rupp asked if the neighbors had been invi.ted to any of the meetings
regarding the plans for the complex and Mr. Michael said that they had
not. There was no testimony on the relaxation variance.
Mr. Rupp suggested that the Archdiocese talk it over with the residents
to convince them and show them how they can cooperate.
Mr. Hummer moved approval of the setback relexation providing not more
than 100 units. are built on that site. Mrs. Showalter seconded the
motion and it carried unanimously.
