265977 WHITE - CITV CLERK PINK - FINANCE GITY OF SAINT PAUL Council t��C1Qt-�`� CANqRY - DEPARTMENT BLUE� - MAYOR File NO. ��n C.Sa.7 � � � ou ci Resolution Presented By `� • Referred To Committee: Date Out of Committee By Date WHEREAS, The Charter o� the City of Saint Paul requires that the City Council adopt final orders authorizing public improvements for which assessments are to be levied, and the Charter requires that notice of public hearings concerning proposed public improvements be mailed to each owner of property that may be affected by the improvement; and WHEREAS, Chapter 14 of the City Charter requires that prior to the levying of special assessments for these public improvements, notices of hearings on the assessments be dela.vered to owners of property to be assessed; and WHEREA5, Both Chapters 13 and 14 of the City Charter require that notices be sent to property owners subject to a proposed improvement or proposed assessment, and that such notices need not be given to property owners who will not be assessed nor affected by the improvement; and WHEREAS, In the reconstruction or construction of side- walks, notices of hearings have been mailed or delivered to owners of property on the block on which the proposed sidewalk or assessment was to be made, and some of the owners' property � was not subject to the sidewalk construction nor assessment; now, therefore, be it RESOLSIED, That the Counci,l of the City of Saint Paul does hereby direct that notices of proposed sidewalk recon- struction or constructi.on and proposed assessments for sidewalk construction and reconstruction be mailed only to owners of property, which property will be subject to the sidewalk construction or reconstruction or sidewalk assessment and that such notices not be sent to adjacent property owners unless their property will be subject to sidewalk reconstruction or sidewalk assessment. REGNIER Honorable President and Members of the Council of the City of Saint Paul The City Attorney was requested to prepare resolution of the City Council providing that notices of sidewalk con- struction or reconstruction be mailed only to property owners whose property would be receiving either a new sidewalk or reconstructed sidewalk and, therefore, notices would not have to be mailed to adj.oining property owners whose sidewalk does not need replacement. I have discussed this with J. William Donovan, Valuation Engineer, and Hartley Thomas, Public Works 5idewalk Construction Engineer, and they both indicated that this proposed Council policy would not be difficult for them to comply with and that from their standpoint they would have no objection to this proposal.
