WHEREAS, The City of Sai,nt Paul and American Hoist & Derrick
� Company have entered into a Lease Agreement dated August 21, 1970,
whereby American Hoist Company was leased a portion of City-owned
propexty in the vicinity of Midway Stadium for the purpose of
constructing, operating and maintaining a solid waste transfer
station only, the said Lease Agreement commencing on the 21st day
of August, 1970 and terminating the 20th day of August, 1974,
with the option to renew for a further term of four years, at a
monthly rental of Two Hundred Fifty ($250. 00) Dollars; and
WHEREAS, The Mayor and City Council have granted the request
of American Hoist & Derrick Company to extend the Lease Agreement
for an additional period of four years at the same rental of Two
Hundred Fifty ($250, 00) Dollars per month; and
WHEREAS, the City Council, pursuant to Resolution C.F.
263773, adopted June 28, 1974, approved the request of American
Hoist & Dexrick Company authorizing the compan� tq sublet the
premises to Occupational Training Center, Inc. , -p�ovided, hbwever,
that the American Iio�,se & Derrick Company shall co�t.inue to' be
primarily responsible to the City of Saint Paul for the compliance
of all the terms and conditions of the underlying lease agreement;
and
WHEREAS, American Hoist & Derrick Company has now requested
permission to assign its Lease Agreement with the City of Saint
Paul to its wholly owned subsidiary, Crosby American Properties,
Inc. , a Minnesota corporation, and the Mayor recommends that the
City Council approve this assignment; and
WHEREAS, The said Lease Agreement between the City of Saint

Agreement may not be assigned without the approval and consent of
the City Council expressed by its Resolution; now, therefore, be

RESOLVED, That the Council of the City of Saint Paul does
hereby give its consent and approval to the assignment by American
Hoist & Derrick Company of the underlying Lease Agreement with the
C�.ty of Saint Paul for the City property used as a solid waste
transfer station, the said assignment to the wholly own�d.
