F. 116409, adopted September 28, 1939, did vacate a portion of Texa.s Street and alley in Block 13, F. Amb's Addition, the said vacation being subject to all of the terms and conditions contained in Ordina.nce No. 3394 (Cha.pter 228 of the Saint Paul Legislative Code) ; and WHEREAS, The Council of the City of Saint Paul ha.s been re- quested to waive any retained utility easements in the vacated street and alley, and the effective City Depa.rtments, Northern States Power Company, and Northwestern Bell Company have filed written certificates of intended non-use of reserved rights and easements within the vacated street and alley, which certificates are on file in the Office of the City Clerk; now, therefore, be it RESOLVED, Tha.t the Council of the City of Saint Paul, pursu- ant to Section 228.06 of the Saint Paul Legislative Code, as amended, does hereby waive retained easements contained in Resolu- tion Council File 116409, adop�ed September 28, 1939, �� the following described property: Texa.s Street from an extension of the West line of Lot 2 in Block 18, and Lot 9 in Block 13, F.
