Dear Madam:
This is written in response to the application of Franchise Realty
Interstate Corporation for a permit to operate a fast food restaurant
on property located on the north side of Suburban between Ruth and
White Bear Avenue. This property is further described as follows;
The east 150 feet of Tract B, Registered Land Survey
Number 276,
This matter was heard by the Board of Zoning on April 3, 1975. Staff
reported that plans received April 3, 1975, meet design standards and
staff recommended approval of the permit.
Marilyn Lantry appeared in opposition to this matter because of the
anticipated increase in traffic and debris in the area this facility
could cause.
After discussion about the traffic problems in the area, a motion was
made to recommend approval of the permit. The motion was seconded and
carried by a vote of 3 to 1.

MINUTES OF THE PUBLIC HEARING BEFORE THE BOARD OF ZONING
ON THURSDAY, APRIL 3, 1975, AT 3:00 P.M.
PRESENT: Mme. Showalter, Messrs. Willits, Bryan and Rupp of the Board;
Mr. Iannacone, Assistant City Attorney; Mr. McGuire and Mrs.
Beseman of the Planning Department Staff.
FRANCHISE REALTY INTERSTATE CORPORATION (7758) : An application for a
permit to operate a fast food restaurant on property located on the north
side of Suburban between Ruth and White Bear Avenue.
Mr, McGuire showed slides of the site and gave the staff report. Plans
received April 2, 1975, meet design standards and staff's recommendation
was for approval of the permit.
Richard Engstrom, representing McDonalds, said he had nothing to add at
that time, but would be glad to answer any questions.
Marilyn Lantry, 2050 Suburban, stated that she lives 2 blocks from the
proposed site, and that two years ago in June the Council denied a permit
for a fast food restaurant because of the strong opposition of the residents
in the area. The street in question is one long commercial street which
runs into 2 residential areas. She did not know what the Traffic Department
had to say, but she as an individual wondered what they were going to do
if they added more traffic there. There is a steep grade at the intersection
of Suburban and Ruth and they have accidents there every day, most of
which are fender benders and are not reported. She said there is much
debris in the area now from the Zapata and Burger King restaurants, and
another fast food restaurant in the area would only increase this problem.
She stated that McDonalds has a heavy volume of take out food and they �
would have a huge increase in traffic.
Mr. McGuire read a report dated April 3, 1975, signed by Captain Jyrkas
of the Traffic and Accident Section of the Police Department in which
they stated their approval of this restaurant, and suggesting some specific
consideratians regarding traffic control.
Marilyn Lantry asked Mr. McGuire if he had talked with Captain Jyrkas
personally, because he had told her the traffic was very bad there.
Mr. Rupp asked if the applicant would be willing to stipulate that he
would come up with an officer to control traffic indefinitely.
Richard Engstrom said he could not say that an officer would be warranted,
but that some of their stores have employees set aside for directing on-site
traffic only. Some of their stores do have off-duty policeman directing
traffic. If the situation warranted it, he would say yes; but at this time
he would be unable to answer.
Mrs. Showalter asked if there were any plans to widen Suburban.

Mr. McGuire said there is a proposal to extend Suburban across White
Bear Avenue where it will tie into Burns. He said this was west
of the site, but as far as to the east of the site, he was not aware
of any plans.
Mrs, Showalter said the traffic is unbelieveahle there.
Mr. Willits said he was not too anxious to se� a fast food restaurant
come into the area, but unless there is testimony at this hearing
that there is a safety hazard over and above normal, the property is
zoned commercial and the Board could not deny this permit.
Mr. Bryan made a motion to recommend approval of the permit. Mr. Willits
seconded the motion and it carried by a vote of 3 to 1 with Mr. Rupp
voting against the motion. Mr. Rupp said he disagreed with Mr. Willits,
He said regardless of what the zonino laws say, the City had best
find another way to sol�re this problem. Adding more traffic to an area
is not going to solve it.

the City Council for Thursday, June 5, 1975, at 7:30 P.M. in the
Auditorium of the Battle Creek Junior High School at 2121 North
Park I}rive, for the purpose of conducting a public hearing on
the application of �anchise Realty Interstate Corporation for a
permit to install a fast food restaurant on the north side oP
Suburbat� Avenue between Ruth and White Bear Avenue.

Subject: Letter of Protest
Dear Ms. Hunt: McDonald's applicatian
With reference to application by Mc�►onald's for a drive-in
restaurant on Suburban Avenue, which would be located west
of Sun Ray Chrysler-Plymouth near White Bear Avenue, i
v�ish to express my opposition, and do with this letter of
protest,since I am unable to be at the Council Meetings
when they are held during the day.
This matter was considered very thoroughly a few years ago.
I was �t the meeting that evening held at the Sunray Branch
Public Library. To me it seemed there was a unanimous vote
against having a McDonald's restaurant (drive-in) in our area.
I'm sure it hasn't changed, and I hereby protest once more.
I would protESt any type of drive-in in our small neighborhood.
I might also add, when the freeway was builtl„an exit was made
off Ruth Street to the west, but none to the east. I live on
Burns Avenue and we get the brunt of the traffic going east
until it can get back on the freeway -- including the very
heavy trucks.
McDonald's Drive-in or any drive-in would only add to this
me�ace.

Restaurant locating along Suburban Avenue,
S�t. Paul.
This area is already over populated with restaurants
and fast food drive-ins -- at present, there are
fifteen (15) over a distance of less than one mile
along Highway 94 . Traffic is congested because of

and another food outlet would really worsen this
already bad situation.

Court, the Honorable Edward Mulally presiding, on July 29�, 1975,
7ppenheimer, TnTolff, Foster, Shepard and Donnelly and Craig W.
Gagnan aFpearing on behalf of the plaintiff, and Thomas M.
Sipkins appearing on behalf of the defendant.
After due considerat�on of all of the pleadinqs, records,
evidence, and arguments of counsel, and upon the agreement of .
counsel that there is no dispute regarding the facts recited in
plaintiff's complaint, the Court finds there is no genuine issue
as to any material fact, that the state of the law on this issue
is clear, and that defendant's conduct in refusing to issue .

. M E M O R A N D U M
' In this case the plaintiff seeks to annul the denial
by the City Council of an application for a special use permit.
The applicant has complied with all of the requirements and `�
has met all of the standards of the ordinance. The entire
matter closely parallels Twin City Red Barn, Inc. , v. City
of St. Paul, 291 Minn. 548, 192 N.W. 2d 189 (1971) , and was
submitted to this Court for decision on basically the same
type of record as was available to the court in that case.
Here, again, counsel for plaintiff and counsel for the City
apparently are satisfied that the minutes of the proceedings
before the zoning board and the City Council, as well as
pleadings and documents attached thereto, are adequate for
the Court to makes its determination on the issue of whether
the council acted arbitrarily in denying the application.
The law is fully set out in the cases cited by
plaintiff in its memorandum which was filed in support of
its motion for summary judgment and little would be added
by further discussion by this Court. It appears to be clear
that there is no genuine issue as to any material fact and
that the plaintiff is entitled to judgment as a matter of
law. •
