PAUL POLICE SUPERVISORY GROUP � ` ARTICLE 1 - PURPOSE: The bnployer and the St. Fa.ul Police Supervisory Group (SPPS) agree that the purpose of entering into this AGREII�NT is to: A. Achieve orderly and peeceful relations, thereby establishing a system of uninterrupted operations and the hi�hest level of perforsaance that is consistent with the well being of all concerned. _ . B. Establish the fhll and complete understa.nding of the � portions concerning the tezms and conc�i.tions of this AGREEMENT. : C. Establish procedures to orderly a.nd peacef�.i71y resolve � disputes as to the agplication of interpretation of this AGR�IT. - D. Place in written form the parties' agreement upon terms and conditions of employment for the duration of this AGR�'N'i'. ARTICLE 11 - DEFIPIITIOtTS: A. • St. Paul Police Supervisory Group (SPPS) B. Employer: The City of St. Paul � C. SPPS - St. Paul Deputy Chiefs of Police D. Employee: A member of the SPPS Bargaining Unit � • ' ARTICLE 111 - �COGNITIOR: A. The EMPIAYER recognizes the SPPS as the exclusive ������ ' representative for the purpose cf ineeting and negotiating the tezats a.nd conditions of employment for supervisory Police Department personnel. - B. In the event the Et�IAYFR and the SPPS are unable to agree as to the inclusion or exclusion of a new or modified �ob position, the issue shall be submitted to the Bureau of Mediation Services for determination. ARTICLE N - E.MPIAYER AUTHORITY: . The SPPS recognizes the preroga.tives of the ENIPIA�R to operate and , manage its affairs in all respects in accordance with applicable laws . aad regulations of appropriate authorities. The prerogatives and . authority which the II��LO�R has not officia�ly abridged, delegated or modified by this AGRE���1VT are retained by the ENSPIAYFR. ARTICLE V - EP��IAYEE r12TD SPPS RIGHTS - GRIEVAtrCE PROCEDURE . A. DEF'INITION OF GRIEVAI'�CE: • A Grieva.nce is defined as a dispute or disagreement as to the interpretation or application of the specific terms and conditions of the AGRE�. It is specifically understood that any matters governed by civil service rules or statutory provisions shall not be considered grievances and sub�ect to the � grievance proecdure hereinafter set forth. No disciplinary action which may be appealeri to a civil service or merit system - . authority will be considered a grievance and sub�ect to the grievance procedure herein. � . �. � � B. SPPS REPRESEI9TATIVES: ����7�� The EMPIrO�R will recognize represerita.ti�es desi�ated by the . SPPS as the grievance representatives of the barga.ining vnit . having the duties and reponsibilities established by this � Article. The SPPS shall notify the EMPIA7�R in writing of.the names of such SPPS representatives and of their successors ♦rhen so designated. - C. PROCESSING OF GRIEVANCE: It is recognized and accepted by the SPPS and the EMP?A�R tbat the processing of grievances as hereina.fter provided is limited by the �ob duties and responsibilities of the II�'IAYEE and ' shall therefore be accomplished during normal working hours only � when consistent with such ENSPIAYEE duties and responsibilities. The aggrieved EM1'IAYEE and the SPPS shall be allowed a reasonable amount of time without loss in pay when a grievance is inves�igated and presented to the EN�LOYER during normal working hours provide� the F�PIAYEE and the SPPS representative have notified and received the approval of the designated supervisor �ho has determined that such absence is reasonable and would not be detrimental to the work programs of tl�e EMPLOYER. D. PROCEDURE: Grievances, as defined by Section A shall be resolved in con- �ormance with the followin� procedure: �Step 1. The selection of an arbitra.tor shall be made in accordance with the "Rules . Governing the Arbitration of Grievances" as established by the Public Employment Relations Board. � E. ARBITRATOR'.S : �UTHORITY • 1. The arbitrator shall have no right to amend, modif�, nullify; ignore, add to, or subtract from the terms and conditio�� o� the AGREEMENT. The arbitrator shall consider and c:ecide only the specific issue(s) submitted in writing by the EMpLOYER and the SPPS, and shall have no authority to make a decision � . on any other issue not so submitted. 2. The arbitrator shall be without power to ma.ke decisons contrary to or inconsistent with or modifying or varying in any , wa,y the application of laws, rules or regula.tions having the force and effect of law. The arbitrator's decision shall be submitted in writing within thirty (3�� �ys following the close of the hearing or the submission of briefs by the parties, whichever is later, unless the parties agree to an extension. The � � decision shall be based sole on the arbitrator's inte retation ��5864 �,Y rp or application of the express terms of this AGREII�1'� and to the . � facts of the grieva.nce presented. 3• The fees and expenses for the arbitrators' services and proceedings shall be borne equally by the EMPIAYER snd the � SPPS, provided that each party shall be responsible for eompensating its own representatives and witnesses. If either party desires a verbatim record of the proceedings, it may cause such a record to be made, providing it pays for the record. If both parties desire a verbatim record of the proceedings, the cost shall be shared equally. � . � F. 41AIVER: If a grievance is not presented within the time limits set forth above, it shall be considered "waived". If a griewance' is not appealed to the next st�p within the specified time limit or any agreed extension thereof, it shall be c.onsidered settled � on the basis of the EMPLOYER'S last answer. If the II�IAYER � does not answer a grievance or an appeal thereof within the specified time limits, the SPPS may elect to treat the grievance as denied at that step and immediately appeal the grievance to the next step. The time limit on each step ma.y be extended by mutual written agreement of the employer and the SPPS in each step. � G. RECORDS• Al1 documents, communciations and records dealing With a � grievance shall be filed separately from the personnel files of the inwlved EMPIAYEE(S). . , - i - �� � - ���� �,�E: � c6586� This AGREEMEI�T ia sub�ect to the laws of the United States, the � State of Minnesota and the City of St. Paul. In the event aay provision of this AiGREEMElYT shall be held to be contrary to law by 8 court of competent 3urisdiction from whoae final �udgment or decree no appeal has been taken xithin the time provided, such provisions shall be voided. All other provisions shall continue in 11i11 force and ePfect. The voided provision may be renegotiated at the written request oP either party. ARTICLE VII - UMFORM AI�I,OWANCE , The 1972-base of one hundred eighty ($180.00) dollars as s � . clothing allowance on a voucher system will be increased on � January l, 1971t and each year thereafter on the basis of a- year�y study of the increased cost of the defined uni.form. The 1972 . base cost of the uniforms are defined in Appendix A. ARTICLE VIII - LEGAL SERVICES: Eyccept in cases of malfeasance in office or willtLl or wanton neglect of duty, the EI�IA7�R shall defend, save harmless and indemnify an E[�LOYEE, and�or hia estate, againat ar�y claim or demand, whether groundless or otherwise, arising out of an alleged ect or omissioa occuring in the performance and scope of the EA+�I,pYEE'S duties. . ARTICLE IX - SAF'ETY: E'MPLOYER and Er+�IAYEE shall cooperate in the enforcement of all epplicable regulations for the enforcement of �ob safety. IP an II�LOYEE feels that his work duties or responsibilities require such II�'L07�E to be in a situation that violates federal or state safety . . ���8fi�� standards, the matter shall. be immediately considered by the . . IIKPLOYER. If such matter is not satisfactorily ad�justed, it ma,y become the sub�ect of a grieva.nce and will be processed in accorda.nce with the g:ievance procedure set forth herein. ARTICLE X - INStJI��;CE: A. The II�ff'LOYER will continue for the period of this • AGREEt� to provide for EI�IAYEES such health and life insurance benefits as aze provided by E[�LpYER at the ' time of execution of this AGREIIKENT. B. In the event of the death of an active employee or an early retiree, the dependents of such employee or retiree shall� have the option within thirty (30) days to continue the current hospitalization and medical benefits, including such improvements as may be made from time to time, which said dependents previous�y had, at the premium applicable, to dependents of active employees. It is f�rther understood that coverage shall cease in the . event oP: � • l. Subsequent remarriage of the surviving spouse of the deceased employee or retiree. _ � _ � � � � ���8�� 2. The employment oP the surviving spouse where hospitalization � and medical insurance covera.ge is obta.ined thro�.� a group program provided by said employer. It is f�rther understood, however, that in said event, the surviving spouse shall have the right to maintain City hospitalization and medical insurance coverage for the first ninety (90) days of said employment. 3.
