MAYOR , i' �''S k �"t �nr �9t t C /= �� � �'-o .� I.AWRENGE D, COHF.Y M"'Y°II July 29, 1975 Council President David Hozza and Honorable Members of the City Council City of Saint Paul, Minnesota Dear President Hozza and Council Members: I am returning to you with my veto C.F. 265803 passed by your honorable body July 25, 1975, dealing with the transfer of off-sale liquor license 2744 from Hawkeye Liquor, Inc. , to Stuart Oil Company, 225 Grand Avenue. The principal question dealt with during the deliberations of the Council License Committee and the City Council was that of whether the applicant would, in fact, maintain the legal requirement of separate building facilities for joint operation of an off-sale liquor store and a gasoline service station. This license would be a first of its kind in Saint Paul, thus creating a new policy. This sort of change should not be implemented without substantially more input from city departments and the public. However, I feel there are many other questions that deal more directly with the health, safety and welfare of the community which are unanswered and therefore, this license should be denied at this time. Council members stated to the effect during hearings that the era of prohibition is over -- an observation with which I may totally agree. But I must remind your body that the city is bound to uphold liquor control laws, archaic as some of them may be. 22 , , . ., � ' . � , Members of the City Council July 29, 1975 Page 2 Generally, as the city attorney pointed out, issuance of this license is a "judgment call, " just as is nearly any license dependent upon administrative review and Council approval. In making this judgment, however, I ask the Council to consider the following. The hastily revised building plans submitted leave doubts as to the control of access for use of rest rooms, which are in the same area as liquor storage. Service station accessories, such as oil, would be stored in the same proximity. A 24-hour gas station operation, combined with off-sale liquor sales, is rife with possibilities for violations of liquor laws -- such as sale to minors and sale after legal hours -- in an area of Saint Paul that already has crime problems. In summary, the orderly process of licensing must require as its final determinant whether there would be any community betterment or detriment. In this case, there is little evidence pointing toward betterment and many questions that, when answered, could conclude an overall detriment. Pursuant to that request, a field study and office review of the proposed use of the subject site has been conducted. The following findings are a result of the investigation. The subject property was originally constructed to house a gasoline service station and a convenience food store operation. Closing of the facility was either a result of business failure at the location, or the decision of a major oil company to terminate all of its outlets in Minnesota. The facility was vacant for about 1� years. The site is presently partially used for a self-service gasoline station and storage. The area around the site is one of mixed land use of varying age and condition. To the east lies the Ramsey Playground property being considered for sale to United Hospitals. To the north along Thompson Street there are three frame structures currently utilized for housing. Further to the north� across Thompson Street is the Lindsay School site. West of the subject site is a small structure housing a wholesale candy and tobacco company, two frame structures used as a multi-family residence, and a duplex, and open tand purchased for right-of-way by the State of Minnesota. To the south, across Grand Avenue, the land use pattern is also mixed, containing a Mobil Gasoline Service Station, a small canmercial structure housing a facility called the :. Personal Awareness Education Center and some older frame structures constructed and utilized for housing. There is also open "right-of-way" land to the southwest. The relative condition of structures in the area is mixed, with the commercial structures appearing to be the youngest and generally the best maintained facilities in the area. The housing in the area appears to be suffering from the adversity of the use mixtures and related traffic, etc. Staff is concerned with a number of factors effecting the utilization of this site for an off-sale liquor facility in combination with a self-service gasoline station. The City of St. Paul Legislative Code, Chapter 308� Section 26 prohibits the location of a liquor facility in such manner that the main entry is within 300 feet of a school , church, or synagogue. In addition, State law 421 Wabasha Street, Saint Paul, Minnesota 55102 (612)-298-4151 0 ` Rose Ann Mix ' August 26, 1975 Page 2 prohibits location of off-sale facilities within 1 ,000 feet of any facility under the ". . .supervision and control , in whole or in part, of the Canmissioner of Pubiic Welfare or the Cortxnissioner of Corrections." The proposed facility lies within a few feet of the 300 foot distance from the Lindsay School , and well within 1 ,000 feet of Shorevlew Treatment Center (355 Sherman) which may well be under partial control of the State Comrnissioner of Public Welfare. While we are unable to clearly state the intent of the legislative authors of the laws and ordinances cited� it is apparent that they sought reasonable separation of these types of uses. In the general case, liquor stores and gasoline service stations are both generators of automobile traffic and provide the opportunity for increased congestion. Staff is generally opposed to the use of service station structures for combination uses such as convenience food with gasoline, etc. With the potential traffic generation of a liquor store and gasoline service or self service, and the high number of vacant facilities of similar nature owing to the recent and probably continuing "energy crunch" Staff feels that the issuance of this license may set a dangerous precedent with regard to future utilization of similar vacant facilities in other areas of the City. While full utilization of this specific site by the addition of an off-sale liquor facility is viewed by the applicant as a substantial improvement to the site and the area generally, Staff feels that increased potential for traffic generation and congestion wil ) have an adverse effect on remaining residential uses in the immediate surrounding area. It is therefore the recommendation of the Planning Staff that the application for transfer of the off-sale liquor license from Hawkeye Liquor, Inc. to Stuart Oil Company, 255 Grand Avenue, be denied by the City Council . Also, the presentation must include legal opinions regarding the method of operation on the same piece of land with a self.-service qasoline stati.on to prove full compliance with statutes control_ling such use . � Mr. Stuart presently owns eleven service stations , seven of which � are in Minnesota and four in �^7isconsin. Al1 of these stations ' � are self-service operations . Experts will testify that it is :, >� impossible for anyone purchasing gasoline to also enter the liquor �� store unless and until he comoletes his gasoline purchase and moves .;� his car to an adjoining parking lot. Also , there is a separate ;,; building for the cashier for the gasoline operation; there is no �� connection between the two buildings which two separate businesses � are operated. � . . I did not receive a copy of that Zetter. In it Mr. Parranto indicated that the plan rejected by the License Cocrnnittee was drawn in accordance with the "recommendations" of the City Attorney' s staff. This language creates the impression of approval or participation in the preparation of their application, or that we recommended they do or not do certain things. That is a totally in- correct impression and we at no point urged or recommended the applicants do or not do anything. Perha.ps Mr. Parranto misunderstood my interpretation of the ordinance and various attorney general opinions as being a recommendation of some kind, but it is difficult to see how that could be.
