This is written in response to the application of Southland
Corporation for a permit to install a 9-car parking lot on
property located on the northeast corner of Payne and Lawson.
This property is further described as follows:
Lots 16, 17 and 18, Block 7, Arlington Hills Addition.
This matter was heard by the Board of Zoning on May 1, 1975.
Staff recommended approval of the permit, noting that the
Phalen Area Community Council and the Payne Avenue Development
District Task Force had reviewed and approved of their
proposal.
After brief discussion, a motion to recommend approval of the
permit carried unanimously.
Plans received Ma.rch 3, 1975, require minor modification for
approval.

ON THURSDAY, MAY l , 1975� AT 3:00 P.M. "
PRESENT: Mme. Showalter� Messrs. Bryan, Willits� Humner and Rupp of the Board;
Mr. McCloskey� Assistant City Attorney; Mr. McGuire and Mrs.
Beseman of the Planning Staff.
SOUTHLANO CORPORATION (7759) : An application fo� a permit to instail a 9-car
parking lot on property located on the northeast corner of Payne and Lawson.
Ms. Holly Stoerker gave the staff presentation and showed siides of the site.
Revised plans were requested on April 3, 1975, and as of this date have not
been received. She reported that the Payne Avenue Development District Task Force
had marked this site for acquisition, but had subsequently sought other property
for thet purpose. The Neighborhood Group for that area and developer have gone
over the revised plans and do approve. Staff's recommendation for the permit is for
approval .
Mr. David Schak, representing the applicant, stated they plan to build a 30 by
80 foot buiiding, which they are now in the process of revising.
Mr. Rupp asked if there were self-service gas pumps o� the plan, and was told
there was no room. Mr. Rupp said neither the Board nor City Council will hopefully
continue to accept this type of operation where the plans are revised while
they are still under construction.
Mr. Bryan said there was not room for gas pumps as the site is too small .
Mr. A1 Block� Housing and Redevelopment Authority, presented information to
the Board members stating that the Payne Avenue Task Force does support this
business at this site.
Landscaping was discussed among the Board members.
A resident asked if there was any i�put among the residents about putting in
such a business.
Mr. Rupp said legal notices were sent out to property owne�s who are required
by law to be notified. The Board is assuming there is no opposition or they
would certainly be there today.
Mr, Willits asked if it c.ould be inciuded in the motion that no additional gas
pumps would be installed i� the future.
Mr. McCloskey, Assistant City Attorney, said it would not be proper to put a
contingency on this perrnit.
Mr. Bryan made a motion to recommend approva) of the permit. Mr. Hummer
seconded the motion and it �arried unanimousiy.

Attached to this latter are copies of previous correspondence, dated November 8,
1974, and April 29, 1975, regarding development recommendations for Payne Avenue.
My purpose in sending you this letter is to reiterate the support of the Payne
Avenue Development District Task Force of the proposal for a 7-Eleven Store and
related parking on Payne Aveaus.
I would like to point out a concern of the Task Force in providing this statement
of support without having final assurance that the revised plans for our own �
Payne Avenue parking lot will be ahlE .to proceed. It is my understandinr� that
the community deveZopment funds tor this propo�al have na�,� b��:� approvad by
RUD and that a public hearing pertaining to the acquisition of the properties
that are� needed for the development district parking lot at Payne and Case is
scheduled for June 10, before City Council.

On November 8, 1974, the Payne Avenue Development District Task Force presented
' a number of recor,unendations to you for redevelopment in our comrnercial area. • •

Subsequent to our report to the �layor and Council, funds were identified for in-
clusion in Community Developnent Year I for ttiese two parking lots. This was
. ultimately approved by the i:ayor and Council and would have permitted us .to
implement Sta�e I of the development reco�nmendations. :
Recently, 7-Eleven has asl:ed for perMission to build a new store on one of the �
two sites previously recoum�ended far part;in„ at Payne and Lawson. The construc-
tion of a new store on Payne Avenue �•�ould obviously be an asset to com�nercial
activities on the Avenue. In addition to this, the discount bakery operation on
rhP second site at Pavne and Sims appears to be a healthy, on-going business on
Payne Avenue.. � -
On April 23, the Payne Avenue DevelopMent District Task Force met to reconsider -
� all of the proposals for parking. By unanimous vote of the members present, it
was recommended that we delete the St�ge I proposal, which action would permit
the T-Eleven Store construction to proceed and the baicery could remain in opera-
tion; and to imple^�ent Stage II and III of our specific developr�ent recommendations
included in our letter of :dovember 3, 1974 to the *iayor and Council.
� Therefore, we are requestin� your approval to transfer the use of the $100,0G0
(which is in contingenc3� until other means of financing are explored) to our
' Stage III proposal whicn includes the acquisition of three buildings at Case , .
and Payne and the redevelopment into parking usG. These funds should be sufficier.t
to implement this pro�ram.
If we gain your approval of this revision of aur plan, Che Pa�me Avenue llevelopnent .

A, HISTORY: On July 15, 1938 the Council g ranted a permit to operate a used
car lot at this location. In May of 1954 the Council granted a permit to
remodel a filling station at this site and to install and operate a customer
parking lot in conjunction with said station. During September of 1974
application was made by Mericon Corporation for a permit to install an 11-car
parking lot in conjunction with a building to house a 7-11 food store and one
additional retail business. The file was closed in March of 1975 for lack of
further ,a.ction on the part of the applicant.
B. AREA ZONING: The subject property is part of the strip cammercial zone along
Payne Avenue. The surroun.ding areas on either side of Payne are predominantly
"B" Residential.
C. DESIGN STANDARDS: The Fire Department and the Traffic and Accident Division
have no objection to the plan. The Building Department reported that the
pole sign must be setback 19 feet on Lawson. The Department of Public Works
has requested that no access or loading operations be permitted from the
existing alley and that if a self-service gas station is to be installed on
this site, this information should be shown on. the plan. The Sewer Engineer
reports that starm water should drain overland and no direct storm conne�tions
would be allowed because the sewers in the area are all combined. The Traffic
Engineer reports that the most northerly proposed driveway onto Payne Avenue.
must be 26 feet wide. The north curb line of Lawson should be constructed as
shown on the site plan. The corner radius should be 10 feet and a pedestrian
ramp constructed in the sidewalk quadrant accordino to Minnesota Highway
Department Standards.
D. FRONTAGE AND AREA: The site has frontages on Payne Avenue of 125 feet and
109 feet along Lawson, for an area of 13,625 square teet.
E. SITE CONDITIONS: The site currently is vacant with a steep slope to the `
alley on the nor�h and the single family home to the east.
F. AREA CONDTTIONS: The lots to the north across the alley are occupied by a
boat sales store. Directly west across Payne is a doctors office with adjacent
parking. Directly south across Lawson is a VFW Hall. The area surrounding
this commercial strip is developed with one and two family hotnes ,
G. STAFF RECOMMENDATION: This site was design.ated by the Payne Avenue Develop-
ment District Task Force as a general parking lot for the surroundino commercial
area. This group has recently agreed to seek other property in the area for
acquisition for this purpose and has reconanended approval of Southland's
development plans. The staff therefore is recommending approval of the permit
application of Southland Corporation contingent ugon revision of the plan as
requested above.
