File # �\ � S'Lf/ .''rreen Sheet # � U�� 1 � i WHEREAS, a Norice of Violation was sent to Capitol Wine & Spirit on Wednesday, July Z 12, 2001 advising that adverse action was being recommended against all licenses held by 3 Family Liquor S Corporation d/b/a Capitol Wine & Spirit for the premises located at 531 Rice 4 Sireet in Saiat Paul (License ID# 91884) based upon the caztcellation of the liquor liabiliry 5 insurance far the establishment; and 9 10 11 12 13 � 16 17 18 19 20 21 23 WHEREAS, the Notice advised the licensee that LIEP had recently received no6ce that insurance was canceled as of December 17, 2000 and had verified that there had been no reinstatement, and had hand-delivered a letter to the establishment advising that there should be no sale of alcohol until liquor liability was in place; and WHEREAS, the Licensee contacted the City Attomey's Office and acknowledged the lapse in insurance, stating that he had no notice of it unriI the LIEP office informed him, and further the Licensee provided proof of current liquor liability insurance effective July 16, 2001; and WHEREAS, Licensee did cease selling alcohol ixnmediately upon receiving notice from the Office of LIEP of the lapse; and WHEREAS, the tength of the lapse in insurance from December 18, 2000 until July 16, 2001 is a serious vioIation and the presumptive penalty for a first time violation involving a lapse in_ liauor liability insurance is a ten-day suspension; now therefore, be it � CITY OF SAINT PAUL, NIINNESOTA �S
