The basis for the recommendation is as follows: Sgt. Michael Simmons is responsible for monitoring compliance by the pawn shops in the city with the ordinance requirements for documenting pawn transactions. While checking items taken in on pawn by Cash-N-Pawn, located at 490 �V. University Avenue, on February 13, 2001 and February 14, 2001, Sgt. Simmons found an item reported stolen in a garage burglary in St. Paul. On Apri120, 2001 he requested the videotapes of the pawn traasactions and �vas told that they did not exist. The store manager he spoke to stated that the tape on the VCR had ended on February 13, 2001 and was not changed for a forty-five minute period, during which one of the transactions took place. Additionally on March 24, 2001, the VCR had been broken for three days and no recording had been done. Saint Paul Legislative Code §344.04(a)(6)i. reyuires that each transaction be videotaped. The matter �vill then be scheduled for a hearing before the St. Paul City Council to determine what penalty, if any, to impose. On the other hand, if you wish to dispute the above facts, I will schedule an evidentiary hearing before an Administrative Law Jud�e (ALJ). If you wish to have such a hearing please send me a letter stating that you are contesting the facts. ' Pawn shops are re�ulated by City Ordinance 344.00. Ordinance 344.04 (a)(6b) &(3) (i) states that all Pawn shops are required to video tape all transactions and maintain a dated copy of this recording for four months or 120 days. Cash-n-Pawn 4, 490 W. University, 651-227-5080, did the following. On 2-13- 2001 at 1629 hours, they took in a Craftsman Snowblower under transaction number 012177. On 3-24- 2001 at 1423 hours, they took in a Diamondback 12 speed bike under transaction number 012356. The customer in both of these transaction was Brown, Antonio, 7-7-64. While checking these items thru NCIC, I found that the bike was stolen in a garage burglary in St. Paul, repo¢ed under CN- O1-05�935. The snowblower comes back cleaz at this time. On 4-20-01 I called Cash-n-Pawn and talked to Mgr. James Ganzer, Ganzer told me that he could not show me a tape for either of the above 2ransac[ions. The basis for the recommendation is as follows: Sgt. Michael Simmons is responsible for monitoring compliance by the pawn shops in the city with the ordinance requirements for documenting pawn transactions. While checking items taken in on pawn by Cash-N-Pawn, located at 490 �V. University Avenue, on February 13, 2001 and February 14, 2001, Sgt. Simmons found an item reported stolen in a garage burglary in St. Paul. On Apri120, 2001 he requested the videotapes of the pawn traasactions and �vas told that they did not exist. The store manager he spoke to stated that the tape on the VCR had ended on February 13, 2001 and was not changed for a forty-five minute period, during which one of the transactions took place. Additionally on March 24, 2001, the VCR had been broken for three days and no recording had been done. Saint Paul Legislative Code §344.04(a)(6)i. reyuires that each transaction be videotaped. ' Pawn shops are re�ulated by City Ordinance 344.00. Ordinance 344.04 (a)(6b) &(3) (i) states that all Pawn shops are required to video tape all transactions and maintain a dated copy of this recording for four months or 120 days. Cash-n-Pawn 4, 490 W. University, 651-227-5080, did the following. On 2-13- 2001 at 1629 hours, they took in a Craftsman Snowblower under transaction number 012177. On 3-24- 2001 at 1423 hours, they took in a Diamondback 12 speed bike under transaction number 012356. The customer in both of these transaction was Brown, Antonio, 7-7-64. While checking these items thru NCIC, I found that the bike was stolen in a garage burglary in St. Paul, repo¢ed under CN- O1-05�935. The snowblower comes back cleaz at this time. On 4-20-01 I called Cash-n-Pawn and talked to Mgr. James Ganzer, Ganzer told me that he could not show me a tape for either of the above 2ransac[ions. Simmons found an item reported stolen in a garage burglary in St. Paul. On Apri120, 2001 he requested the videotapes of the pawn traasactions and �vas told that they did not exist. The store manager he spoke to stated that the tape on the VCR had ended on February 13, 2001 and was not changed for a forty-five minute period, during which one of the transactions took place. Additionally on March 24, 2001, the VCR had been broken for three days and no recording had been done. Saint Paul Legislative Code §344.04(a)(6)i. reyuires that each transaction be videotaped. ' Pawn shops are re�ulated by City Ordinance 344.00. Ordinance 344.04 (a)(6b) &(3) (i) states that all Pawn shops are required to video tape all transactions and maintain a dated copy of this recording for four months or 120 days. Cash-n-Pawn 4, 490 W. University, 651-227-5080, did the following. On 2-13- 2001 at 1629 hours, they took in a Craftsman Snowblower under transaction number 012177. On 3-24- 2001 at 1423 hours, they took in a Diamondback 12 speed bike under transaction number 012356. The customer in both of these transaction was Brown, Antonio, 7-7-64. While checking these items thru NCIC, I found that the bike was stolen in a garage burglary in St. Paul, repo¢ed under CN- O1-05�935. The snowblower comes back cleaz at this time. On 4-20-01 I called Cash-n-Pawn and talked to Mgr. James Ganzer, Ganzer told me that he could not show me a tape for either of the above 2ransac[ions.
