WHEREAS, Mazkethouse Condominium has submitted for City Council approval the attached registered land survey
for subdivision of part of Lot 2, Block 44, Kittson's Addition to Saint Paul, located northeast of E. Fifrh and Broadway
Streets; and
WHEREAS, the appropriate City departments have reviewed the registered land survey and found that it meets the
requirements of Chapter 67 of the Zoning Code; and
WHEREAS, the registered land survey constitutes a lot split under Chapter 67 of the Zoning Code, and the proposed
lot split was approved by the Planning Administrator on June 14, 2001, as provided under §67306 and §67.705 of the
Zoning Code; and
WHEREAS, Ramsey County is requiring a registered land survey before recording this lot split because it is torrens
property and the subdivision is creating complex legal descriptions; and
WHEREAS, §508.47(4) of Minnesota Statutes requires that registered land surveys shall be approved in the manner
required for the approval of plats, which under §505.03 of Minnesota Statutes includes approval by the City Council,
which approval shall be endorsed on or attached to the registered land survey;
NOW, THEREFORE, BE IT RESOLVED, that the City Council accepts and approves the attached registered land
survey for subdivision of part of Lot 2, Block 44, Kittson's Addition to Saint Paul, located northeast of E. Fifth and
Broadway Streets.

The registered land survey is for a lot that is part of a lazger site being released by MnDOT. Part of the site is being
used for a dog park, and part will be used by Mazkethouse Condominium for needed parking. Ramsey County is
requiring an RLS because L,ot 2 is torrens property and the subdivision is creating complex legal descriptions. The
lot split has been approved by the Planning Administrator as provided in the Zoning Code, and a public hearing is
not required. Minnesota Statutes require City Council approval of registered land surveys.
ADVANTAGES IF APPROVED:
Mazkethouse Condominium will be able to record the lot spiit and move ahead with their project to provide needed
parking.
DISADVANTAGES IF APPROVED:
