In connection with the sub�ect im�provement, the Council of the City of Saint Paul initially heard. arguments regarding the advisability and desirability of these matters on September 18, 1974. The Suam�.ry of Engineering Recom- mend,ation on the Advisability and Desirability of the i�pravements is included as Exhibit "A". Based on the testimony at said hearing, the m�tters were referred to the Public Works Coam►ittee oP the Council for a tour oP the site and recovanendation with lay-over to pctober 16, 1974. To a11aw a.d.ditional time, the matter was flarther laid over to November 21, 197�+. On November 21, 197�+, Counci.lma,n Hozza reported that four alternatives exist to the proposed axea development and suggested that the matters be laid over indefinitely, so that the Valuation Engineer may assemble all pertinent ci,ata on the proposed improvements and la.nd develvpment and report same to the City Council within a two month period and, at that time, a clate would again be set for formal hearing on these matters. , Enclosed. here�with is iqy report on the Improv�ment of STREET. Openin�, Widening and. Extending DARLEI� STREET to a 60' width including cul-de-sac as necessary. Also, acquirir� or condemning ea.sements for slopes, euts and fills on adjacent lands for purposes of grading L1ARI,E� STREET f�om Upper Afton Road to the north. 2. Grade and Surface, construct concrete Curb and Gutter on DARLENE STREET from Upper Afton Roe�d north to the cul-de- sac. 3. Construct Sanitary Se�rer in DARLEIQE STREET. These i.mprovement orders were initiated by a petition signed by one of two property ahmers affected. Said petitioner is desirous of developing eight p7�atted vacant residential lots. The a�wner of the other property affected by subject irapxovement i.s not desirous of developing at this time. This affected property consists of a large unplatted. residential tract containing approxi�tely 138,7� square feet and is improved with a single residence and appurtenances. The Department of Public Works has ftiirni shed this office four alternative street improvement plans and�or development proposa,ls for this area. The esti- mated costs, proposed. financing and basic characteristics for each of these alternates is as follaws: ALTERNATE I�. 1 - Refer to Plan 1 This proposal consists of limiting the opening and the street and se�w�er construction on DARLENE STREET from Upper Afton Road to approximately 300 feet north. The unplatted lands on the west side for the north 200' would be low to the street and would also require extensive pump systems for sewer connection or an alternate sewer system for development. ALTERNATE N0. 3 - Refer to Plan 3 This alternate provides for opening and street and se�rer construction for a short length cul-de-sa.c in addition to the opening and street and sewer construction of platted DARLEI� STREET as in Alternate No. 2; arn1, as such, the standard sewer services axe provided for all the properties cywned by the two affected parties. COMPARISON OF ALTERNATNES Alternate 1 provides for the minimum amount of street improvement work to initiat� development. This proposal would seve�ely hinder the eventual possi- bility of serving the remainin� properties of the two awners involved, beca.use the cost of sanitary and storm se�wers would be apportioned against a lesser amount of assessable property. It is Yqy opinion that the distribution of the development costs would be more equitable with a more complete plan for the -�- area; hawever, Alternate Plan 1 does provide for the initial phase of develop- ment for these praperties and may be considered as a campromise proposal. Alternate Plan 2 would pravide for the �il,l development of the platted proper- ties but creates some serious sanitary sewer and storm sewer problems in connection with said development. Sump pumps for sanitaxy sewer connections on the northerly 3 lots of the platted land would be required. This is considered undesi.rable. It is �r opinion that this alternate is the least desirable of the pro�posals. A1.terna.tes 3 and 4 are similar. They vary only in connection with the layout for street and cul-de-sac location. The extent of the improvements pro�posed. under these alternates would serve the entixe vacant lands of the two affected awners. If development of the area is to be underta.ken, it is my opinion that the interests of the City of St. Pau1 and affected awners would be best served by approval of one of these pla.ns or similar alterr�.tive. I ha.ve prepared a modified proposa.l (refer to Plan 3B) similar to Alternates 3 and 4 which atterncpts to limit the land required. for street right-of'-way and reduces, if possible, the extent and. cost of the sewer and street construction. This plan requires the vaca.tion of a portion of platted Da.rlene Street and a rep].atting of the north 3 lots and accrued vacated street, possib],y as shown on said plan. Since the vwner of the westerly uriplatted property is not desi.rous of developi.ng his property at this time the plattin� of said land could be deferred.. It would be des3xable, hcs�rever, that the necessary street right-of way and se�wer easements be dedicated at this time. In vie�w of the circumstances of previous street plattings, property ownership, land improvemen-ts and sanitary se�rer design, the sanitary se�w�er construction cost -5- is unusu,ally hi�h and this office would reco�mend tha.t the sanitary sewer assessment rate be set at $12.00 per assessable foot. Darlene Street Improvement. Chairman Hozza asked for the presen- tation. �ir. Roy Bredahl, Valuation Department, advised that four proposals have been subuLitted by the Public Works Department to build a new, partially dedicated street north of Upper Afton Road. The first proposal provides for a short section amounting to approximately 250' north, �ohich would allow for the minimum amount of development of the properties on the east and west sides of Darlene Street. Darlene Street has been platted for 500' north of Upper Afton Road to serve the properties on the east side, which include eight platted lots. On the west side, which is anticipated to be platted, is another 30' of street to serve the property on the west side of the ex- isting plat. The second alternative proposed was a full cul-de-sac for the full 500` to serve all of the 8 platted lpts and would also serve the im- nediately abutting property on the west side to the length of that platted street, sewers and other utilities to be included. Alternatives 3 and 4 were similar in that they proposed to develop Darlene Streat for the full length of the properties, all 8 lots; but they added a cul-de-sac going to the west wnich would attempt to serve all of the non-pl.atted property under the o4m ership of the Dixon parcel. The sewer costs are the least and the grnding costs become the least in this case because of the grades and the way the plats are. Mr. Bredahl stated that it was his opinion that tliis proposal would serve the minimum amount of property. Alternative 2 is the extension of the cul-de-sac for the full. 8 platted lots, including the sewer. Because of the grades and contours, there are prob- � lems with the sewers. The sanitary sewer becomes quite high �n eZevation to � the abutting properties, pump stations are required in the baSements to properly serve these properties if they were ever to connect to these sewers. Therefore, it does create an extra cost for the northerly four properties on the east and for the majority of the properties if they were to develop on the west side of � this particular proposal. Mr. Bredahl stated that he did not think Alternative ' 2 was a good proposal. , � Alternative 3B, which is a combination of Alternatives 3 and 4, was proposed o create the least amount of acquisition and least amount of property for the� street , at the same time serving all the properties involved. : This proposal pro- vides for building an all-gravity, closed sanitary sewer and also provides for the grading of the property that would serve all the lands involved by the two owners. Mr. Tedesco aslced if Mr. Bredahl's recomr.iendation was Alternative 3 or 4 and i�ir. Bredahl advised his reco�nendation would be for Alternative 3B which is somewhat of a modification of both Alternatives 3 and 4. He said this proposal woul.d provide for the vacating of the very northerly 100' of Darlene STreet that has been platted and then to open Darlene Street with a right angle cul-de-sac to ttiis configuration; this would provide for the least amount of property to be dedicated for streets. It would require some re-platting of some lands but would provide for� the greatest potential development in the use of land for residential development. Had Darlene Street been built at right angles to Upper Afton it could have been served with the least amount of problems with the sanitary sewer flow, Mr. Bredahl concluded. Property o�Jner Emily Peterson spoke, stating that she is the owner of the property east of Darlene Street and that Alternative 3B looks like a good one to ' her. r1r. Patrick Gallagher spoke, stating he is the attorney representing Mrs. Peterson. Mr. Arnold Dixon spoke, advising he ,is the property owner to the west of Darlene Street. He stated he felt he would be assessed almost two-thirds of the cost and is not interested in the platting of the street. : Mr. Dunford asked rir. Bredahl if he had worked out the assessments. Mr. Bredahl stated the assessments would not be levied until �� after the work is completed and then they could be set up on a 20-year, 6% simple interest basis. Mr. Roedler asked for background information on the development. Mr. Gallagher stated the land was ori znall Mr. and r1rs. Peterson and the rest of the plat has since been�developed96Darlene Street is on the very eastern edge of the plat and the original source of the problem is the plat was accepted with only a 30' dedication for Darlene Street rather than the 60' needed for a full street. It is only the easterly 7 lots that remain undeveloped. Ttao years ago in 1973 Mrs. Peterson petitioned the Council to open the street and install the water and sewer � • referred the matter to the Public LdorksJcommittee andSthentthe ValuationCD part- ment was requested to provide a report. Mr, Dunford stated an alternative would be to construct a porktion of Darlene Street from Upper Afton Road to include all � of Lot 4 on the northerly end and to develop a turn-around and not build the cul-de-sac at this time; however, a storm sewer would have to be built. Mr. Tedesco asked about Mr. Dixon's property. Mr, Dunford advised it would be more expensive on the whole to do two small parts; however, there is an ad- vantage to building it ttiis way at this time over building just the short section proposed in Alternative 1. Mr. David Dixon asked how much it is going to cost the city itself for this plan and whether or not the city would recover this cost under Alternative 3B. Mr. Bredahl advised as follows: City Aid $4,940 for grading �� „ $1,900 for sanitary sewer Total $6,840 Mr. Dixon stated the proposal as presented shows city aid on sewer to be $9,700. It was e�plained that city aid varies. Mr. Bredanl advised the total. cost for everything for. Alternative 3B amounts to $61,660. The proposed financing was $24,260 for the Peterson property, $30,560 for the Dixon ro ert city' $fi,840. NIr. Dixon questioned these figures. Mr. Bredahl anscaeredain view of the circumstances of previous street plattings, property ownership, land im- provements, and sanitary sewer design, the sanitary sewer construction cost is unusually hi.gh. That is why, Mr, Bredahl explained, we are recommending that the city set a fixed unit price for the sanitary sewer and provide for additional aid. In answer to rir. David Dixon's question pertaining to the city recovering , � its costs, Mr. Bredahl said it was his opinion that the city would, since the development of the land which will occur because of the inprovements of the proper- ties would raise the land values and the taxes returned would be far in e�:cess of '� (� •• �� . d dj i`t';, ,,.t 4F i' what the city`s contribution would be. Mr. TedeSco asked Mr. Dixon if there is any plan proposed that Mrs. Peterson likes that he felt he could live with. Mr. Dixan stated he is not interested, period. Mr. Tedesco asked if rir. Dixon wanted the property developed and Mr. Dixon answered he did not. : �*�Chairnan Hozza asked the pleasure of Che committee. Mr. Roedler stated he '� ��9� felt that taking into consideration the equity of both parties, Alternative 3B would iusuensely benefit others and so moved for a motion to make the recommenda- tion be£ore �'he full council. Chairman Hozza said the reco�endation would come back to the full council and there would be a public hearing. Since there was no further discussion, Chairr.�a.n Hozza asked for a vote on the motion. Motion carried. Chairrian �Iozza asked t�ir. Donovan to set a date for the public hearing, and Mr. Donovan said the hearing could not be set before five or six weeks. Chairman Hozza asked if Mr. Donovan's office would notify the property owners and Mr. Donovan replied in the affirmative. COMPARISON OF ALTERNATNES Alterna.te 1 provides for the minimum amount of street improvement work to initiate development. This proposal would sevezely hinder the eventual possi- bility of serving the remaining properties of the two owners involved, because the cost of sanitary and storm sewers would be apportioned against a lesser amount of assessable property. It is rr�y opinion that the distribution of the development costs would be more equita,ble with a more com�lete plan for the � • . . � � -�.- ,��� "� area; however, Alternate Plan 1 does provide far the initial phase of deve��F ment for these properties and may be considered as a campromise proposal. Alternate Plan 2 would provide for the full development of the platted proper- ties but creates some serious sanitary sewer and storm sewer problems in connection with said development. Sump pumps for sanitarv sewer connections on the northerly 3 lots of the platted land woul,d be required. This is considered undesirable. It is my opinion that this alternate is the least desirable of the proposals. Al.ternates 3 and 4 are similar. They vary only in connection with the layout for street and cul-de-sac location. The e�tent of the improvements proposed �ander these alternates would serve the entire vacant lands of the two affected awners. If development of the area is to be undertaken, it is �y opinion that the interests of the City of St. Pa.u1 and affected owners would be best served by approval of one of these plans or similar alternative. I have prepared a modified proposal (refer to Plan 3B) similar to Altexna�es 3 and 4 which a�tempts to limit the land required for street right-of-way and reduces, if possible, the extent and cost of the sewer and street cons-truction. This plan requires the vacation of a portion of pla�ted Darlene Street and a replattin� of i;he north 3 lots and accrued vacated street, possibly as shawn on said plan.
