REGNIER MEMORANDUM T0 : Members of the City Council of the City of Saint Paul FROM: Daniel L. Ficker '" Assistant City Attorney SUBJECT: Claim of Viola M. Wicke The claim of Viola M. Wicke aroseut of a falldown at Como Zoo on August 9, 1972, when she stepped on a piece of broken sidewalk and broke a bone in her right foot. As a result of the aecident, she was disabled until the latter part of October, 192, and she lost approximately j00.00 in wages and expended 185.00 for medical treat- ment. My investigation reveals that the sidewalk where the fall occurred was in a defective conditionat the time of the fall, and the city had notice of the defects . It is my opinion that Mrs. Wicke would prevail if the matter was brought to trial, and a reasonable jury verdic would be in the range of 2, 500.00 to 3,000.00. There- fore , I believe a settlement of her claim for 1, 100. 00 is reasonable and I would recommend your approval. DLF:bl City Hall, Saint Paul, Minnesota 55102 612 298-5121
