WAEREAS, the State of Minnesota, House of Representatives,
presently has pending before it House File No. 1722, relating to
transportation� more specifically increasing the excise tax on
gasoline and gasoline substitutes and creating a Minnesota State
Transportation Fun.d, whieh bill also contains section.s dealing
speci�ically with the manner of eonstructing roadways within the
City of Saint Paul� sueh roadways dealing specifically with the
route described herein as Interstate 35E through the City of
Saint Paul ; and
WHEREAS, H. F. 1'722 specifically designates that ortion of
Interstate 35E from West Seve nth Street (Route No. 111� to the
intersection of Pleasant Avenue and Kellogg Boule�ard in the
City of Saint Paul to be a part of the trunk highway system;
however, construction is to be limited to a four—lane parkway
- facility with limited aceess, with no ph.ysical connection .to be
,allowed with Interstate 94 (�oute No. 392) ; and
Wf�REAS, in 1972, the City of Saint Paul, by Reaolution of
the City Council�, sought relief in the federal court_calling for
a te�ination of the interstate highway project until further
public hearings could be held and until an environmental report
oould be �repared pursuant to federal law, now, therefore , be it
RESOLVED� by the Council of the City of Saint Paul� that the
City Council strongly urges that the design and location of roadways
and highways within the City of Saint Paul be left to the final
determination by the City of Saint Paul, while complying with
federal and state environmental and safety standards .

WHEREAS, in `��945, the City of Saint Paul first expressed its
desire for an inte�,x�state highway to be constructed along Pleasant
Avenue as part of t�e national system of interstate highways, pur—
suant to the Federal�Aid Highway Act of 1944; and
WI�REAS, in 1956 �nd 195'7, hearings were held in the City of
Saint Paul relating to he design and loeation of such an inter-
state highway through th City of Saint Paul; and
WHEREAS, in 1969 and 971, the City of Saint Paul took action
approving the preliminary 1 yout of the design and loeation of
said interstate highway thro gh the City of Saint Paul; and
WBEREAS, in 1972, the Cit of Saint Paul , by Resolution of
the City Council, sought relie in the federal court calling for
a termination of the interstate ighway project until further
public hearings could be held an until an environmental report
could be prepared purauant to fed al law; and
WHEREAS, �ih the present time , innesota Statutes, Seetion
161. 12, designates Interstate 35E to be a trunk hs�ghway labeled
Route No. 390; and
WHEREAS, the portion of Route No. 90 which is of particular
concern to the City of Saint Paul exten s north-northeast from
West Seventh Street (State Highway Route No. 111) through the
City along Pleasant Avenue until re achin the Capitol Approaoh
area, where it joins Interstate 94 (Route No. 392) , such portion
lying within the City of Saint Paul consis ing of approximately
3.5 miles in length; and
WHEREAS, any construction within this d signated corridor
is subject to a stipulation for settlement, U,ivil Aetion No.
3-'72-218, in the United States District Court'� District of

any action on the �egment of 1-35E as dftscribed herein until an en-
vironmental impact '`�tatement is prepared pursuant to federal law
and until public hea`�ings are held pursuant to federal rules and
guidelines ; and
WHEREAS, the City� Saint Paul has consistently been of the
opinion that the design a d location of all highways through the
City of Saint Paul, inclu 'ng that portion of I-35E described
herein, must be the subject of local control while complying with
all neeessary federal and st te laws and regulations pursuant
thereto; and

WHEREAS� H.F. 1722 designate� as part of the trunk highway
system a new corridor running along Shepard Road in the City of
Saint Paul to a�ppoint north of the Lafayette Street Bridge and
then northwesterly �to a point on the presently existing I-35E
south of Maryland Av�nue in the City of Saint Paul; and

WHEREAS, a prelim'na.ry study indicates that the construc-
tion of a trun.k highway to run along Shepard Road to a point
north of the Lafayette reet Bridge and then northwesterly to
a point south of Maryland� Avenue would not be feasible due to
topography, alignment and '�an-made constrain.ts with the proposed
highway to be loeated in a �lood plain, while also necessitating
the relocation of approximat�ly 6 to 10 industrial facilities;
and

WHEREAS, the designation d� the portion of I-35E (under
proposed amendment to be known s Legislative Route No. 335)
would only qualify for federal f�nds under a program whereby
30 percent of the cost of the pro�ram would be paid for by the
local authorities ; and
WHEREAS, the State of Minnesot , through its Highway Depart-
ment, has indicated a lack of funds o participate in parkway
development, thus requiring the City f Saint Paul to provide
the full 30 percen t matching money; n w, therefore , be it
RESOLVED, by the Council of the Ci�ty of Saint Paul :
1. That the Saint Paul City Counci� opposes state legislation
which designates a portion of Interstate \35E proposed to run through
the City of Saint Paul to be limited to a�four-lane parkway facility ,
as specified in H. F. No. 1722.

2. That the City of Saint Paul hereby opposes the designa-
tion of Shepard Road in the area north of the Lafayette Street
Bridge (proposed Route No. 333 and 334) as a trunk highway system.
3. That the City of Saint Paul he reby requests the Legislature
of the State of Minnesota to amend H. F. No. 1722 by deleting there-
from Section 16(3) ; the amendment in Section 17 pertaining to Route
No. 390, and Seetion 18.
4. The City of Saint Paul, by requesting these amendments
to H. F. No. 1722, expresses its desire that the design and loeation
of roadways and highways within the City of Saint Paul be lef t to
the final determination. by the City of Saint Paul, while complying
with federal and state environmental and safety standards.
5. That the City Council hereby finds that those provisions
of H. F. No. 1722 relating to Legislative Route No. 335, 333 �d
334 are inimical to the best interests of the City of Saint Paul
and contrary to the social and eeonomic development of the City
of Saint Paul.
6. Any and all previous re�olutions pertaining to this
highway project which were adopted by the Saint Paul City Council
are hereby rescinded and repealed. insofar as such resolutions
conflict with this resolution.
