THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORUAIN:
Section 1. That the Zoning Code, Chapters 60 to 64,
inclusive, of the Saint Paul Legislative Code, pertaining to
Use Districts, Height Districts and Rezoning of certain prop-
erties in the City of Saint Paul, as amended, be and the same
is hereby further amended so as to rezone the following des-
cribed property from "B" Residential and Commercial District ,
to Light Industrial, to-wit:
Lots 1 through 18 inclusive, Block 2,
Williams Rearrangement of Block 7 and
part of Block 4, Nelson' s Addition to
the City of Saint Paul;
situate on property located on the sczuth side of York between
Arcade and Mendota in the City of Saint Paul.
Section 2. This ordinance shall take effect and be in
force thirty (30) days from and after its passage, approval and
publication.

Dear Madam:
This is written in response to the petition of Whirlpool Corporation
to rezone, from "B" Residential and Commercial to Light Industrial,
property located on the south side of York between Arcade and Mendota.
This property is further described as follows:
Lots 1 through 18 inclusive, Block 2, Williams Rearrangement
of Block 7 and part of Block 4, Nelson's Addition to the City
of Saint Paul.
This matter was heard by the Board of Zoning on February 21, 1974, at '
which time staff recommended denial of the rezoning.
Mr. Hoeschler, representing the applicant, stated that in petitioning
for the rezoning they are trying to solve the need for off-street
parking. When asked if a P-1 district would be acceptable to them
under the proposed Code, he replied that it would.
Two neighbors appeared in opposition to the rezoning because it would
increase the noise and traffic in the area. One stated he l.ived across
York from this site and he would be staring at a sea of cars.
After discussion regarding the need for this parking, a motion was made
to recommend approval of the rezoning up to a line 15 feet south of the
property line parallel to York. The remaining property would rema.in
in the "B" Residence category, to be used as a landscape buffering area;
and that when the proposed Zoning Code is approved, the entire property
would be placed in the P-1 category. A later motion to amend the '
previous motion to allow ingress and egress onto York was made, seconded, ',
and carried unanimously.

At its meetings on March 8 and March 22, 1974, the Planning Commission
discussed this matter, but no action was taken. Under the provisions ',
of Minnesota Statutes 462.357, Subdivision 4, the gover�ing body may ,
take action on the request without recommendation of the Planning Agency ',
provided sixty days have elapsed from the date of referral of the amend- '
ment without report of the Planning Agency. This matter was referred '
to the Planning Agency on February 1, 1974, and the petitioner has
requested Council consideration.

A. SUFFICIENCY: In a Ietter dated January 31, `1974, the Director, Department af
Finance and Management Services, declared the petition sufficj.ent with the owners �
of 43, or 71.7% of 60 eligible parcels having signed the petition.
B. HISTORY: In 1949, a p�rmit was granted to install and operate an automatic
ice vending station on the southeast corner of Arcade and York. In I953, a permit
was granted to install and operate a filling station on this property. A 28-car
parking lat permit was issued in 1968.
C. PROFOSED USE: The petition dec}.ares the proposed use to be a parking lot.
D, FRONTAGE AND AREA: The site has a frontage of 594.9 feet on York .and a depth
of 125 feet, for an area of 74,362.5 square feet.
E. COMPREHENSIVE PLAN: The Comprehensive Plan recammends one, two, three and four
family residences, town or row houses and walk up apartmeat structur'es, maximum
density - 25 dwelling urtits per net acre.
F. PROPOSED ZONING ORDINANCE: The southeast corner of Arcade and York {Lots 17 and '
18) are proposed to be P-1, Vehicular Parking. The rest of the site is proposed
to be zoned RT-1, Two-Family Residential.
G. AREA• ZONING: The area sauth of �his site is zoned Light and Heavy Industrial. The
frontage along Arcade to Wells is mostly Commercial., and the rest of the area is
predominantly "B" Residential.
H. SITE CONDITIONS: The southeast corner of Arcade and York is developed with a •
parking lot. The rest of the site has one and two family dwellings in fair �
condition.
z. AREA CONDTTIONS: Whirlpool Corporation and parking lots for its employees exist to
the south of, the site. Arcade Street going north is developed commercially. The

Madam President and Gentlemen:
Whirlpool Corporation, as many or all of you are aware, is
desirous of rezoning the property on the south side of York Avenue between
Arcade and Mendota Streets as shown on the accompanying map. This rezoning
would be from "B" Residence and Commercial to Industrial so as to permit
its use for parking purposes. (The portion of the block immediately south
of the sub�ect property is now used for parking by Whirlpool.)
The hearing before the Zoning Board on February 21, 1974 resulted
in the recommendation of approval except that the Zoning Board requested
that k'hirlpool maintain and landscape the north 15 feet of the property
as a buffer zone. In addition, the Board was fearful that an industrial
rezoning would permit Whirlpool to build industrial facilities upon the
property notwithstanding Whirlpool's stated intentions. It does not appear
to us that either of these conditions may be legally imposed under the
existing zoning ordinance. Nevertheless, Whirlpool has assured the Zoning
Board that it will accept a P-1 zoning classification for this property
under the new Ordinance and warrants to you now that the property will
be used for parking purposes only, commencing as soon as legally possible
and until the P-1 classification is effected and higher uses are then
precluded.
Whirlpool has also hired a landscape architect to draw up land-
scaping plans for a fifteen foot buffer zone, and after consultations with
Mr. McGuire of the zoning department, a detailed plan acceptable to the
department has been developed. The cost of this planting scheme is
estimated to be $7,000. In addition, it has been estimated by engineers
working on the parking layout that some 39 parking spaces would be
sacrificed for the 15-foot planting strip.

With this in mind, Whirlpool respectfully requests of the Council
that it now grant preliminary approval of the vacation of the alley abutting
the sub�ect property to the south and grant fee title to this alley to
Whirlpool in exchange for Whirlpool's commitment to maintain the 15-foot
buffer strip.
Secondly, Whirlpool has recently announced ma�or building
expansion plans adjacent to its existing buildings, with construction
scheduled to commence within the next few weeks. Not only will there be
an immediate need for parking facilities for construction workers, but
there will follow shortly thereafter a need for parking space for the
additional employees generated by the expansion.
For these rea.sons, we ask that the Council consider (simultaneously
with the rezoning request) Whirlpool's application for a Special Use Permit
which will allow it immediate use of the property for parking.
Whirlpool's management hopes that the Saint Paul City Council will
continue to look with favor upon its attempts to grow and to provide more
�obs for the residents of Saint Paul, and we urge your supporting votes.

Dear Madam:
This is written in response to the petition of Whirlpool Corporation
to rezone, from "B" Residential and Commercial to Light Industrial,
property located on the south side of York between Arcade and Mendota.
This property is further described as follows:
Lots 1 through 18 inclusive, Block 2, Williams Rearrangement
of Block 7 and part of Block 4, Nelson's Addit�on to the City
of Saint Paul.
This matter was heard by the Board of Zoning on February 21, 1974, at
which time staff recommended denial of the rezoning.
Mr. Hoeschler, representing the applicant, stated that in petitioning
for the rezoning they are trying to solve the need for off-street
parking. When asked if a P-1 district would be acceptable to them
under the proposed Code, he replied that it would.
Two neighbors appeared in opposition to the rezoning because it would
increase the noise and traffic in the area. One stated he lived across
York from this site and he would be staring at a sea of cars.
After discussion regarding the need for this parking, a motion was made
to recommend approval of the rezoning up to a line 15 feet south of the
property line parallel to York. The remaining property would remain
in the "B" Residence category, t� be used as a landscape buffering area;
and that when the proposed Zoning Code is approved, the entire property
would be placed in the P-1 category. A later motion to amend the
previous motion to allow ingress and egress onto York was made, seconded,
and carried unanimously.

At its meetings on March 8 and March 22, 1974, the Planning Commission
discussed this matter, but no action was taken. Under the provisions
of Minnesota Statutes 462.357, Subdivision 4, the governing body may
take action on the request without recommendation of the Planning Agency
provided sixty days have elapsed from the date of referral of the amend-
ment without report of the Planning Agency. This ma.tter was referred
to the Planning Agency on February 1, 1974, and the petitioner has
requested Council consideration.

A. SUFFICIENCY: In a letter dated January 31, '1974, the Di.rector, Department of
Finance and Managemer►t Services, declared the petition sufficient with the oc�mers
of 43, or 71.7°l0 of 60 eligible parcels having signed the petition.
B. HISTORY: In 1949, a permit was granted to install and operate an automatic �
ice vending station on the southeast corner of Arcade and York. In 1953, a germit
was granted to install and operate a filling statian on this property. A 28-car
parking lot permit was issued in 1968.
C, PROPOSED USE: The petition declares the proposed use to be a parking lot.
D. FRONTAGE AND AREA: The site has a frontage of 594.9 feet on York .and a depth
of 125 feet, for an area of 74,362.5 square feet.
E. COMPREHENSIVE PLAN: The Comprehensive Plan recosmaends one, two, three and: four
family residences, town or row houses and walk up apartment structur`es, maximum '
density - 25 dwelling units per net acre.
F. PROPOSED ZONING ORDINANCE: The southeast corner of Arcade and York (Lots 17 ancl ' ,
IS) are proposed to be P-1, Vehicular Parking. The rest of the szte is proposed

Madam President and Gentlemen:
TrJhirlpool Corporation, as many or all of you are aFiare, is
desirous of rezoning the property on the south side of York Avenue between
Arcade and Mendota Streets as shown on the accompanying map. This rezoning
' would be from "B" Residence and Commercial to Industrial so as to permit
� its use for parking purposes. (The portion of the block immediately south
of the subject property is now used for parking by Whirlpool.) �
The hearing before the Zoning Board on �'ebruary 21, 1974 resulted
in the recommendation of approval except that the Zoning Board requested _
that j�'hirlpool maintain and landscape the north 15 feet of the property
as a buffer zone. In addition, the Board was fearful that an industriaZ
rezoning would permit Wllirlpool to build industrial facilities upon the
property notwithstanding Whirlpool's stated intentions. It does .not appear
to. us that either of these conditions may be legally imposed under the
existing zoning ordinance. Nevertheless, Whirlpool has assured the Zoning -
Board that it will accept a P-1 zoning classif�cation for this property
• • under the new Ordinance and warrants to you now that the property will.
be used for parking purposes only, commencing as soon as legally possible
and until the P-1 classification is effected and higher uses are then
precluded.
Whirlpool has also hired a landscape archztect to draw up land-
scaping plans for a fifteen foot buff er zone, and after consultations with
Mr. McGuire of the zoning department, a detailed plan acceptable to the
department has been developed. The cost of this plantin� scheme is
estimated to be $7,000. Yn addition, it has been estimated by engineers :
working on the parking layout that sonze 39 parking spaces caould be
sacrificed. for the 15-foot planting strip. No formal effort has been made
to estimate the value of the land involved.

With this in mind, Whirlpool respectfully requests of the Council'+ -
that 3.t now grant preliminary approval of the vacation of the alley abutting
the subject property to the south and grant fee title to this alley to .
�,Thirlpoal in exchanoe for Whirlpool's commitnent to maintain the 7.5-foot
buffer strip.
Secondly, FJhirlpool has recently announced major building
expansion plans adjacent to its existzng buildings, ��ith construction
scheduled to commence within the next few..weeks. Not only will there be
an immediate need for parking facilities £or construction workers, but
there will follow shortly thereafter a need for parking space for the
additional employees generated by the expansion.
For these reasons, we ask that the Council consider (simultaneously
with the rezoning request) Whirlpool's application for a Special Use Permit
which will allow it immediate use of the property for parking.
Whirlpool's management hopes that the Saint Paul City Council will
continue to look with favor upon its attempts to grow and to provide more
jobs for the residents of Saint Paul, and we urge your supporting votes.

Dear Madam:
This is written in response to the petition of Whirlpool Corporation
to rezone, from "B" Residential and Coirnnerc�al to Light Industrial,
property located on the south side of York between Arcade and Mendota.
This property is further described as follows:
Lots 1 through 18 inclusive, Block 2, Williams Rearrangement
of Block 7 and part of Block 4, Nelson's Addition to the City
of Saint Paul.
This matter was heard by the Board of Zoning on February 21, 1974, at
which time staff recommended denial of the rezoning.
Mr. Hoeschler, representing the applicant, stated that in petitioning
for the rezoning they are trying to solve the need for off-street
parking. When asked if a P-1 district would be acceptable to them
under the proposed Code, he replied that it would.
Two neighbors appeared in opposition to the rezoning because it would
increase the noise and traffic in the area. One stated he lived across
York from this site and he would be staring at a sea of cars.
After discussion regarding the need for this parking, a motion was made
to recommend approval of the rezoning up to a line 15 feet south of the
property line parallel to York. The remaining property would remain
in the "B" Residence category, to be used as a landscape buffering area;
and that when the proposed Zoning Code is approved, the entire property
would be placed in the P-1 category. A later motion to amend the
previous motion to allow ingress and egress onto York was made, seconded,
and carried unanimously.

At its meetings on March 8 and March 22, 1974, the Planning Commission
discussed this matter, but no action was taken. Under the provisions
of Minnesota Statutes 462.357, Subdivision 4, the governing body may
take action on the request without recommendation of the Planning Agency
provided sixty days have elapsed from the date of referral of the amend-
ment without report of the Planning Agency. This matter was referred
to the Planning Agency on February 1, 1974, and the petitioner has
requested Council consideration.
