Dear Madam:
This is written in response to the patition of Glen R. Triviski, Sr.
to rezone, from "A" and "B" Residential to Commercial, property
located on the southwest corner of Davern and Munster. This property
is further described as follows:
East 1/2 of North 1/2 of Lot 2, and North 1/2 of Lot 1,
Block 9, Homecro€t Addition.
This ma.tter was heard by the Board of Zoning on February 20, 1975.
Staff recommended approval of the rezoning subject to the fact that
at the time of the passage of the Proposed Zoning Code, this would
be designated a P-1 District.
After discussion among the Board members and the applicant�s
attorney regarding the need for parking there and the staff's proposal
to designate this a P-1 District, a motion was ma.de to recommend
approval with the stipulation that it be designated a P-1 District at
the time of adoption of the new Zoning Code. The motion was seconded
and carried unanimously.

MINUTES OF THE FUBLIC HEARING BEFORE THE BOARD OF ZONING
ON THURSDAY, FEBRUARY 20, 1975, AT 3:00 P,M.
PRESENT: Mme. Showalter, Messrs. Bryan, Hummer, Willits and Rupp of the
Board; Mr. Iannacone, Assistant City Attorney; Mr. McGuire
and Mrs. Beseman of the Planning Department Staff.
GLEN R. TRIVISKI, SR. (7751) : A petition to rezone, from "A" and "B"
Residential to Commercial, property located on the southwest corner of
Davern and Munster.
Mr. McGuire gave the staff report and showed slides of the site. He
reported that staff's recommendation is for approval of the rezoning subject
to the fact that at the time of the passage of the Proposed Zoning Code,
this would be designated a P-1 District, which would restrict the use to
parking only. The petitioner would acquiesce to this without any protest
at the time of the passage of the new Ordinance.
Gerald Frisch, attorney for the petitioner, said the neighborhood is in
favor of the property being developed in this way, because of the congestion
of cars on the streets. He said the LeClare property adjoins the property
in question, and they are appearing in opposition.
Mr. Rupp asked if the petitioner was willing to agree to this being designated
a P-1 District at the time of the adoption of the new Ordinance.
Gerald Frisch stated he �vould discuss this with his client.
Itaymond LeClare, 1715 Graham, asked if this property was rezoned, if it
would devalue his property, and was told there was that potential.
Gerald Frisch said he discussed this matter with Mr. Triviski and he is
willing to accept a P-1 District designation for this property without any
opposition.
Mr. LeClare asked if t here are any plans on how the parking lot will look.
Mr. McGuire said the applicant will be required to submit plans which will
be reviewed by the various City departments and will be subject ta another
public hearing. The parking lot wi11 be required to meet specific design
standards before a permit can be issued. It will include the design.ation
of driveways, parking stalls, adequate setback, and some screening for r�ead-
light glare and a visual break.
Mr. Willits asked if this was a verbal agreement.
Mr. Rupp stated that this ma.tter wi11 go before the Planning Commission
and then before the City Council.

C. PROPOSED USE: The petition states the purpose of the rezoning is for installation
