PAUL, MINNESOTA, AND ITS CONSIDERATION FOR APPROVAL OF THE PROPOSED ASSESSMENTS FOR THE CONSTRUCTION OF THE MARYLAND- ABELL AND PARK-IVY STORM SEWER IMPROVEMENTS WITHIN SAID CITY OF ST, PAUL WHICH ASSESSMENTS ARE TO BE CONSIDERED BY THE CITY COUNCIL ON TUESDAY, APRIL l, 1975. NOTICE OF PROTEST TO THE CITY COUNCIL OF THE CITY OF ST. PAUL, MINNESOTA: You and each of you are hereby notified that the Soo Line Railroad Company, being aggrieved, does hereby protest the action of the City Council and does file this Notice of Protest with the City Clerk of said City and the grounds upon which this protest is based are as follows: I. That it is an owner of railroad property in the City of St. Paul, Minnesota described as follows: Soo Line Plat �k3, part of Lot I southwesterly of a line 100 feet northeasterly at right angles from and parallel with Center Line of main track of Railroad across Lot A also, part of Lot A north- easterly of said right-of-way main track across said Lot A. II. That said above described property is located within the storm sewer improvement district and is proposed to be assessed in the amount of $2,670.00, III. The Soo Line Railroad has not experienced any drainage prohlems insofar �.s this right-of-way property is concerned, therefore, the storm sewer improvement will not benefit its property. IV. That any assessment against the Soo Line Railroad Company's above described property would result in depriving the pro- testant of said property without due process of law in viola- tion of Section I of the Fourteenth Amendment to the United .. , . a States Constitution and in violation of the Constitution of Minnesota. V. That the Soo Line Railroad Company respectfully requests that the City Council exclude its property from any benefits of the above improvement. VI. This protest is limited to the tract described in Para- graph I above. The Soo Line does not protest the proposed assessment as it relates to other of its tracts of land located within the Improvement District, Dated this lst day of April, 1975.
