Gentlemen:
The undersigned has made application for rezoning and a
Special Use Permit for the property referred to above,
for a Burger King Restaurant.
The undersigned respectfully requests the City Council
to consider granting a variance to permit access ta a
driveway leading from Farrington Street to the subject
property (all as shown on the attached plat plans) .
We understand that Section 60. 05f (2) of the St. Paul
Legislative Code prohibits vehicular ingress and egress
onto a street which is used "primarily for access to
abutting residential property" . Assuming that Farrington
Street fits in this category, the requested variance
would be required for the attached plan.

Dear Madam:
This is written in response to the application of Burger King Corporation
for a permit to install and operate a fast food restaurant on the north-
west corner of University Avenue and Farrington Street. This property
is further described by the legal description on file.
This matter was heard by the Board of Zoning on September 5, 1974. At
this time staff reported that the plan meets design standards; however,
it shows access to a predominantly residential street. Staff's recommen-
dation was for denial of any waiver of an access onto a residential street,
but recommended approval of a site plan showing two accesses onto University
Avenue.
Mr Dave Truesdell, representing Burger King, said there would be no problem
with this change.
After discussion regarding an easement for an adjoining property, a motion
was made to recommend approval of the permit with the understanding that
the plan meet the engineering requirements with no driveway onto the
residential street. The motion was seconded and carried unanimously.
Plans received February 10, 1975, meet design standards.

A. HISTORY: In 1948 a permit was issued for a driveway to a frailer sales lot.
In 1962 one lot on Farrington between University and Sherburne was rezoned
to Commercial, In 1966 a petition was submitted and subsequently withdra�m
to rezone the 1ot i�nediately to the north of the previously rezoned lot.
In 1966 an appeal to extend conunercial use northward one lot was granted,
The City Council approved the rezoning of this property from Light Industrial,
Com.�nercial and "C" Residential on August 1, 1974.
B. AREA 'LONING: University Avenue frontage is zoned Light Industrial,
Sherburne and Aurora Avenues frontages are primarily "C" Residential, North
of Sherburne is zoned "B" Residential.
C. DESIGN STANDARDS: Revised plans received February 10, 1975, meet design
standards.
D. FRONlAGF ArID AREA: The site on University has a frontage of 200 feet and
a depth of 11?_.25 feet, for an area of 22,450 square feet, The lot on
