MINUTES OF THE PUBLIC HEARING BEFORE THE BOARD OF ZONING
ON THURSDAY, FEBRUARY 6, 1975, AT 3:00 P.M.
PRESENT: Mme. Showalter, Messrs. Bryan, Hucmner, Willits, and Rupp of the
Board; Mr. Iannacone, Assistant City Attorney; Mr. McGuire and
Mrs. Beseman of the Planning Department Staff.
CARDINAL INVESTMENT COMPANY (7738) : An application for a permit to install
a 95-car parking lot on property located on the southeast corner of Lower
Afton Road and McKnight.
Mr. McGuire gave the staff report and showed slides of the site. He stated
there were some concerns on part of the Traffic Engineer's and minor problems
with the Sewer Design Division in terms of drainage. The Building Department
reported that the setback is 56 feet, which would eliminate the use of 3 stalls
on each side. The Traffic Engineer would eliminate 2 stalls, which would
make a reduction of 8 parking spaces in order to accomplish the parking lot.
There were requests from the Traffic Engineer relating to physical placement
of the islands. He also reported there is a county road on both sides of the
site along Lower Afton Road, the developer should provide a paved shoulder for
ease of entry to the site. Contingent upon the developer working out the
problems with the various City Departments, staff's recommendation was for
approval of the permit.
Mr. Willits asked if there would be a boulevard area, and also why they could
not use the first 3 parking spaces.
Mr. McGuire stated that it should be landscaped. With reference to the re-
duction of parking spaces, he said that in the setback area, parking can occur
only in the half of the area closest to the structure. They have to rera�_n
an open space of 27 feet.
Mr. Willits asked if they were required to have a fence because of the adjacent
residential property.
Mr. McGuire reported there was no requirement for a fence but there is a
requirement for some buffering in terms of distance. He stated that the
Board might indicate this as a recommended condition. The cars will be down
below the general grade, and there should not be any conflict.
Mr. Willits said a fence would keep paper and debris from blowing across to
the residential development to the south.
Harold Shear, representing the apglicant, r.eported that a fence would not be
practical. The apartment parking lot is between the proposed commercial and
the apartment building and it would be a substantial expense to put a fence
there. The developer is also the owner af the apartment project and maintence
would be much easier without a fence. The apartment developer was particularly
interested in having this development there and a fence would not be desirable
in this case.

Cardinal Investment Company -2- February 6, 1975
Granger Whitney, Langer Construction Company, reported that he had inquired
in the Building Department and the Department of Public Works and there
were no real problems. He said the Building Department setback require-
ment is a matter of interpretation, and it will have to be establishad
what the setback for Lower Afton Road will be so that the black top fronting
McKnight and Lower Afton Road will not have to be reconstructed. He also
stated that as far as where the islands will be placed, certain traffic
patterns will have to be set up.
Joe Perontka, Engineer from the County Office, asked if there were any
entrances onto McKnigl�t Road, and was told there were two. He stated these
would have to be approved by the County. He was interested only in the
entrances.
Mr. Willits asked if they had to be authorized by the County first.
Mr. McGuire said the Traffic Engineer has looked at McKnight and saw no
problem with respect to this intersection. They will not get County approval
unless it is first approved by the City.
Mr. Hummer inquired about the number of parking spaces in relation to the
new Zoning Code.
Mr. McGuire said that even with the reduction of 8 parking spaces the developer
would exceed the required number of spaces for the building area. It is a
permitted use in the district.
Mr. Willits ma,de a motion to recommend approval contingent upon the requirements
of the various City departments. Mr. Bryan seconded the motion and it carried
unanimously.

Dear Madam:
This is written in response to the application of Cardinal Investment
Company for a permit to install a 95-car parking lot on property located
on the southeast corner of Lower Afton Road and McKnight. This property
is further described by the legal description on file.
This matter was heard by the Board of Zoning on February 6, 1975. Con-
tingent upon the developer working out concerns of the various City
departments, staff's recommendation was for approval of the permit.
The Board discussed with the developer the landscaping of the site and
the possibility of a fence on the southern portion of the site.
Mr. Joe Perontka, Engineer for the County, explained that the two entrances
onto McKnight would have to be approved by them after the City approved
them.
A motion was made to recommend approval of the permit contingent upon the
plan meeting the requirements of the various City departments. The '
motion was seconded and carried unanimously. �
Plans received February 13, 1975, meet design standards.

A. HISTORY: The western 201 feet of this property �vas rezoned to Commercial
in June of 1960. The eastern 10 feet was rezoned to Commercial in August
of 1971a
B. AREA ZONING: The subject site is part of a larger parcel on the southwest
corner of McKnight and Lower Afton Road which is zoned Commercial. A '
sizeable tract about 200 feet north of Lotoer.Afton Road is .zoned "C" �
Residential. There is a "C-1" Residential District southwest of this site.
The remainder of the area is zoned "A" Residentiale
C. DESIGN STANDARDS: Revised plans received February 13, 1975, meet design
standards.
D. FROiVTAGE AND AREA: The site has frontages of 281.61 feet along McKnight
Road and 211.00 feet along Lower Afton Road. The area of the site is approx-
