F. 264941, approved February 3, 1975, a public hearing was scheduled for 10:00 a.m. on February 20, 1975, before the Council of the City of Saint Paul, said he�ring pertaining to the condition of the structures located at 738 East Fourth Street, Saint Paul, Minnesota; and WHEREAS, upon facts presented at said hearing consisting of photographs, inspectio� reports and the .recommendation of the Division of Housing and Building Code Enforcement, it is found and determined by the City Council that according to the records and files in the office of the Register of Deeds, the last record owner of the above described property is Donna Oerter, and the St. Paul Board of Water Commissioners has a lien against the property; and that it is further determined tha.t the above described buildings constitute hazardous buildings within the definition of Minnesota Statutes Section 463.15 for the following reasons: a. The condition of the dwelling is as follows: The building has been badly burned and gutted by fire. The windows, doors, interior trim, studs and joists have been badly burned. The building is boarded but the roof is part�burned through and the building is open to the weather; c. The building is unfit for human �iabitation in its present condition; d. The building constitutes a nuisance and a hazard to the public health, safety and welfare because of its physical dama.ge, dilapidation and inadequate ma.intenance; now, therefore, be it RESOLVED, That in accordance with Minnesota Statutes Sections 463. 15 through 463. 26, and based upon the foregoing findings of the City Council, the Council of the City of Saint Paul does hereby ma.ke the following Order: ORDER 1. The owner of the above described buildings shall make the same safe and not detrimental to the public peace, health, safety and welfare by having the said buildings razed and the ma.terials therefrom removed from the premises within thirty (30) days from the date of the service of this Order; 2. Unless such corrective action is taken to comply with this order or an answer served upon the City of Saint Paul and filed in the Office of the Clerk of District Court of Ramsey County, Minnesota within twenty (20) days from the date of the service of this Order, a Mo�ion for Su.mma.ry Enforcem�nt of this Order to raze and remove the said buildings will be made to the Ramsey County District Court; 3. Fourth St. File No. 2671 Honorable Council: • The Division of Housing and Building Code Enforcement is hereby submit- ting its report on the condition of the structures at the location re- ferred to above. The owner of record is Mrs. Donna Oerter, 741 E. Third Street, St. Paul, Minnesota 55106 . The legal description of the property is Lot 24 , Block 34 , Lyman Dayton' s Addition to Saint Paul. This dwelling has been badly burned and gutted by fire, the windows, doors , interior trim, studs and joists have been badly burned. The building is boarded but the roof is partly burned through and the building is open to the weather. Due to the extensive damage, we believe the building is be- yond feasible rehabilitation. Inasmuch as the conditions outlined above constitute a public hazard and the owner has made no attempt to satisfactorily repair the damage despite our warnings, and the continued vacant and boarded up condition contrib- utes a blighting influence on the neighborhood, it is the recommendation of this bureau that this matter be referred to the City Attorney' s office for razing and removal through District Court proceedings.
