F. 264809, approved January 2, 1975, a public hearing was scheduled for 10:00 a.m. on Janua.ry 16, 1975 before the Council of the City of Saint Paul, said hearing pertaining to the condition of the structure located at 643 St. Anthony, Saint Paul, Minnesota; and WHEREAS, upon facts presented at said hearing consistittg of photographs, inspection reports and the recommendation of the Division of Housing and Building Code Enforcemen�, it is found and determined by the City Council that according to the records and f iles in the office of the Register of Deeds, the last record owner of the above described property is the Estate of Nannie Overton, Nathaniel L. Hardy, Exeeutor; and that there are no lien- holders of record; and that it is further determined th:at the above described building constitutes a hazardous building within the definition of Minnesota Statutes Section 463.15 for the following reasons: a. The condition of the building is as follows: The building has been gutted by fire. The roof is in poor con- dition and there is evidence of fire at the eaves. The floors have been burned through and the interior of the building is badly damaged or destroyed. The p�umbing fixtures have been removed, the electrical system has been destroyed by the fire and the heating plant has been removed. Approxima.tely 90% of the interior of the building has been destroyed by the fire; c. The building is unfit for human habitation in its present condition; d. The building constitutes a nuisance and a hazard to the public health, safety and welfare because of its physical dama.ge, dilapidation and inadequate ma.intenance; now, therefore, be it RESOLVED, That in accordance with Minnesota Statutes Sections 463.15 through 463. 26, and based upon the f oregoing findings of the City Council, the Council of the City of Saint Paul does hereby make the following Order: ORDER 1. The owner of the above described building shall ma.ke the same safe and not detrimental to the public peace, health, ssfety and welfare by having the said building razed and the ma.terials th.erefrom removed from the premises within thirty (30) days from the date of the service of this Order; 2. Unless such corrective action is taken to comply with this Order or an answer served upon the City of Saint Paul and filed in the Office of the Clerk of District Court of Ramsey County, Minnesota within twenty (20) days from the date of the service of this Order, a Motion for Summary Enforcement of this Order to raze and remove the said building will be ma.de to the Ramsey County District Court; 3. The owner of record is Nathaniel L. Hardy, Special Guardian for Nannie W. Overton. The legal description of the property is Lot 25, Block 11, Butter- field's Syndicate No. l. The building is a two-stary frame dwelling. This building has been gutted by fire. The roof is in poor condition and there is evidence of fire at the eaves. The floors have been burned through and the interior of the building is badly damaged or destroyed. The plumb- ing fixtures have been removed, the electrical system has been des- troyed by the fire and the heating plant has been removed. Approxi- mately 90� of the interior of the building has been destroyed by the fire. The Housing and Redevelopment Authority does not intend to acquire this building. This property has been boarded by the city since December 12, 1974. Inasmuch as the inadequate maintenance, the dilapidated condition and the physical damage outlined above constitute a public hazard and the owner has made no attempt to satisfactorily repair the damage despite our warnings, and the continued vacant and boarded up condition contri- butes a blighting influence on the neighborhood, it is the recommenda- tion o this bueau that this matter be referred tQ the City Attorney' s offi f for razing and removal through District Court proceedings . i. :> Ve uly yo s, � r `S �„_ � nn A.
