This property is further described as follows: Lots 26 and 27, Block 2, Rosedale Park. This matter was heard by the Board of Zoning on December 19, 1974. Staff reported the Traffic Engineer stated no access to the alley would be permitted and the Department of Public Works recommended that if the predicted traffic volumes increase to a point at which congestion and problems occur on the right of way, the City would retain the right to close down the proposed gas station operation. Staff's recommendation was for approval with reservation because there were already two gas station facilities at the corner. Several neighbors expressed the opinion that there was no need for another gas station at this corner. After brief discussion about the City's right to revoke the gas station permit, if traffic volume or business increased, the Board made a motion to recommend approval of the permit subject to the request of the Traffic Engineer. PRESENT: Mme. Showalter, Messrs. Hummer, Willits, Bryan and Rupp of the Board; Mr. Erickson, City Architect; Mr. McGuire and Mrs. Beseman of the Planning Department Staff. INTER-CITY OIL OF AMERICA (7733) : An application for a permit to install a filling station on property located on the northeast corner of Cleveland and Grand. Mr. McGuire gave the staff report and showed slides of the site. He reported the Traffic Engineer stated no access to the alley would be permitted and the Departmex�t of Public Works recommended that if the pre- dicted traffic volumes increase to a point in which congestion and problems occur on the City right-of-way, the City retains the right to close down the proposed gas station operation. There was no opposition from the other City de�artments and the Planning Staff recommendation is for approval although there was some reservation because there are two gas station facilities at that intersection. Stanley Biggin, representing the applicant, said he had nothing to add at this time. Walter Low, 2037 Lincoln, who lives one block from the location, stated this is essentially a residential area and there have been three gas stations on t]ne corner for some time. The need for a gas stati,on is not there. He said he hoped the Board would take the same view here as on the previous one. It's essentially residential and there is no demonstrated need for a gas station. Mrs. Showalter read a letter from Carl Fogelberg, 2032 Summit Avenue, stating there are two gas stations on the corner and another one would not be re- quired or desirable. Mr. Rupp said the site is properly zoned; a Special Use Permit for this use is permitted within the district. Mr. Bryan asked about the City revoking the permit at a later date. Mr. McGuire said the Traffic En�ineer stated that if at a future date the traffic volume increased or business increased, the City would retain the right to close down the station. Mr. Rupp said the Board would make the same recommendation to the Southland Corporation. The site is large enough to allow the required parking. A motion in favor of it would have to include the request of the Traffic Engineer, that the Council give that the proper amount of weight. Mr. Willits asked if there were any talk in relation to the guarantee period. He said it does not give the property owner any protection. In March of 1974, an administrative permit was approved to install a 10-car parking lot for a 7-Eleven convenience store. B. AREA ZONING: Grand Avenue going west to Finn is zoned "C" Residential for one block, then "A" Residential. The rest of the area is zoned "C" Residential. C. DESIGN STANDARDS: Revised plans received November 14, 1974, meet design standards. D. FRONTAGE AND AREA: The site has a frontage of 100 feet on Grand Ave. and 150 feet on Cleveland, for an area of 15,000 square feet. E. SITE CONDITIONS: A 7-Eleven store is presently under construction on the site. F. AREA CONDITIONSc The corner of Cleveland and Grand is commercially developed, with gasoline stations on two corners and a food store, etc. on the southwest corner. Christ Child School lies on the corner of Cleveland and Summit. The rest of the area is developed residentially with mixed single and multiple family structures. G. STAFF RECOMMENDATION: Installation of gasoline pumps on the site makes the proposed facility subject to special use permit regulation as a "filling station", and thus certain design standards must be met according to ordinance. The proposed addition of pumps on an administratively approved parking facility has raised considerable question. A meeting with the petitioner, the Traffic Engineer and Zoning Staff to review the proposal for this location was held December 10, 1974, in the Planning Department Offices. After considerable discussion regarding the proposed layout of the pump facilities, their relationship to drives and established parking spaces, probable volume of business and commodity pricing, a determination was made that such an installation could be worked out on this site with minor adjustments in the location of the pumpso The property is approgriately zoned for the proposed uses, Contingent upon meeting the design specifications and concerns of Traffic Engineers in the Department of Public WTorks, the staff recommends approval of the Special Use Permit. 9.
