WHEREAS� The Council of the City of Saint Paul, upon petition
of Ma.rrel and Marjorie Ha.thaway, et al. , by Resolution C. F.
263808, approved July 3, 1974i vacated a portion of a public
alley in Block 4, Edmund Rice s Fourth Addition, subject to certain
terms and conditions contained therein; and
WHEREAS, In accordance with Section 228 .05(e) of the Saint
Paul Legislative Code, the Council did by Resolution C. F. 263995,
approved August 2, 1974, granted a thirty-day extension to the
petitioners to comply with the said terms and conditions; and
WI�REAS� The City Clerk reported to the City Council tha.t the
terms and conditions set forth in Resolution C. F. 263808 have not
been complied with and in accordance with Section 228.08, the
- Council should adopt a resolution rescinding of the vacation of
alley resolution; now, therefore, be it
RESOLVED, That the Council of the City of Saint Paul for the
reason set forth above and in accordance with Section 228 .08 of the
Saint Paul Legislative Code does hereby rescind vacation of alley
resolution� C. F. 263808, said resolution vacating that portion
of the alley in Block 4, Edmund Rice' s Fourth Addition, lying be-
tween the South line of Case Avenue and the extended North line of
the South 10 feet of Lot 16, in Block 4, Edmund Rice' s Fourth
Addition, and the City Clerk is hereby `8irected to transmit a copy
of this r,esolution to the petitioners and to all affected City
Departments .

ing vacation of alley resolution, C. F. 263808. You
� should prepare a report to the City Council in accor-
dance with Section 228 . of the Legislative Code, speci-
fying wha.t conditions of the vacation of alley resolution
tha.t have not been complied with. You should also note
tha.t copies of this rescinding resolution is required
to be sent by you to the petitioner and all affected
City Departments . The affected City Departments, I be-
lieve, would be the Department of Public Works, Finance,
Valuati ns .

Honorable City Council:
The City Council, on July 3, 1974, e.dapted a resolution C.F. 263808
granting the petition of Marrel and Mar�orie Hathaway for the vaca-
tion of an alley in Block �+, Edmund Rice's Fourth Addition. On
August 2, �974, the City Council adopted a resolution C.F. 263995
granting a 30 da�y extension to the petitioners to comply with the
terms and conditions of the resolution.
Please be advised that as of this date, the petitioner has not com-
plied with any of the terms or conditions of these resolutions.
