this vacation which is due and payable within 60 days of the effective date of thls resolution.

24 brought as a result of injuries or damages received or sustained by any person, persons or property

26 claim brought because of any act of omission, neglect, or misconduct of said petitioners or
27 because of any claims or liability arising from any violation of any law or regulation made in
28 accordance with the law, whether by the petitioners or any of their agents or employees.

After meeung with the petitioners, the Department of Public Works has reconsidered it's position
on the proposed vacation of Hadley Street and no longer objects to this vacation.
Hadley is shown as a street in the Highwood Plan, and the Comprehensive Sewer Plan shows a
sanitary main proposed in Hadley Street. The property to the south of the area to be vacated is
now owned by the St. Paul Parks Department and is designated as a pazk preserve. This property
will not be developed and there is sufficient access to the pazk from Winthrop. We have
contacted Pazks and they verified that llus property will not be developed and that they have no
need for this portion of Hadley as a public right-of-way.
Tn addition, all other pazcels in this azea will continue to have access from other streets.
Therefore, since the vacation wil] not land-]ock any pazcels, and Hadley St. no longer needs to be
reserved for futute development of the pucel to the south, the Department of Public Works no
longer objects to the vacation, subject to the following:

address to a Winthrop Street address.

That part of Hadley Street that abuts the fiollowing lots: Lo#s 17, 18, 19,
20 and 21, Block 17, Burlington Neights, Division No. 2., County of
Ramsey, State of Minnesota.
It is the intent of this petition to request the vacation of Hadley Street beginning at
the intersection of Howard Street and Hadfey Street to the paved portion ofi Hadley
street.
2. 6chibit A is a copy of the plat mat showing the approximate requested area to be
vacated. The dark shaded area is an existing easement ,
Exhibit B is a copy of a larger area pfat mat showing the area of Hadiey Street to be
vacated
3. The property on the south side of the proposed vacated property was recentiy
purchased owed by the City of Saint Paui, and it is the understanding of your
petitioners that the city plans a city park for the area.
4. Your petitioners intend to clean up, plant trees, and generally landscape the portion
of the vacated area that abuts their property. Petitioners wilt not be requesting any
subdivision or other development as a result of this vacation.

The Depaz[ment of Public Works has completed a review of the above referenced vacation proposal
and recommends this street not be vacated.
This is an unimproved street. In December 1996 the Ciry Council approved the vacation of a poztion
of this block of Hadley Street, abutting Lot 20, Block 17, Burlington Heights Division No. 2. This was
done as a temporary vacation to accommodate an existing encroachment. The vacation is for the life of
that structure only, and reverts back to City right-of-way upon demolition of the structure. We allowed
this as a compromise because we did not want to permanently release our right-of-way in this block of
Hadley Street. See attached survey.
Also In 1996 Mr. Ojeda requested the vacation of the unimproved portion of Howard 5treet just north
of Hadley to allow additional azea for construction of single family homes. His request was approved
by City Council in April 1997. At that time our reason for allowing the vacation request was because
there was still the option of improving Hadley Street, if needed for sewer and access to the ll 19 acre
tract of land on the south side of Hadley. See attached map and memo from me dated November 4,
1996.
Hadley is shown as a street in the Highwood Plan and the Comprehensive Sewer Plan for the azea
proposes a sanitary main in Hadley Street. Therefore, due to the above factors, the Department of
Public Works recommends denial of their vacation petition.

Vacation of Howard St. abutting Lots 12-15, Block 15,

The Department of Public Works has completed a review of the above referenced
vacation proposal and has the following comments or concerns.
1. The petitioner has recentiy extended the Howard Street improvements to serve the
parcel at the northeast corner of Howard and unimproved Hadiey Street. Attached is
a copy of the recent construction plan. A 15 foot boulevard is to be retained beyond
the end of improved Howard. There is a discrepancy between the lot lines shown on
the piat map and the lot lines shown on the construction plan. Since the discrepancy
would only create a larger boulevard rather than a smaller one, this should be
acceptable.
2. Because of the unusual shape of the proposed vacated area, the City surveyor has
concerns about how the vacated street wouid be split and how that split will be
described.
3. The topography of unimproved Howard Street would probably suggest that it wiil
not be improved through to Point Douglas Road. But, there is an 11.19 acre tract of
developable land south of the proposed vacation. Slopes from the south end of
Howard to this property are not so severe, that it may be feasible to extend Howard
further to the south to serve this property, aithough sewer would not be extended
through this portion of Howard. Sewer to serve this tract of land couid be brought in
from the portion of Howard St. west of this property or from Springside at the southeast
corner of the property.

Therefore, because there are other options for access and public improvements to
serve the property south of the proposed vacation, the Department of Public Works
has no objections, provided the property owner to the south is adequately notified of
this vacation proposal, and provided a 15 foot boulevard is retained.

After meeung with the petitioners, the Department of Public Works has reconsidered it's position
on the proposed vacation of Hadley Street and no longer objects to this vacation.
Hadley is shown as a street in the Highwood Plan, and the Comprehensive Sewer Plan shows a
sanitary main proposed in Hadley Street. The property to the south of the area to be vacated is
now owned by the St. Paul Parks Department and is designated as a pazk preserve. This property
will not be developed and there is sufficient access to the pazk from Winthrop. We have
contacted Pazks and they verified that llus property will not be developed and that they have no
need for this portion of Hadley as a public right-of-way.
Tn addition, all other pazcels in this azea will continue to have access from other streets.
Therefore, since the vacation wil] not land-]ock any pazcels, and Hadley St. no longer needs to be
reserved for futute development of the pucel to the south, the Department of Public Works no
longer objects to the vacation, subject to the following:

of the City Qf Saint Paul to vacafe the public land described below:
That part of Hadley Street that abuts the fiollowing lots: Lo#s 17, 18, 19,
20 and 21, Block 17, Burlington Neights, Division No. 2., County of
Ramsey, State of Minnesota.
It is the intent of this petition to request the vacation of Hadley Street beginning at
the intersection of Howard Street and Hadfey Street to the paved portion ofi Hadley
street.
2. 6chibit A is a copy of the plat mat showing the approximate requested area to be
vacated. The dark shaded area is an existing easement ,
Exhibit B is a copy of a larger area pfat mat showing the area of Hadiey Street to be
vacated
3. The property on the south side of the proposed vacated property was recentiy
purchased owed by the City of Saint Paui, and it is the understanding of your
petitioners that the city plans a city park for the area.
4. Your petitioners intend to clean up, plant trees, and generally landscape the portion
of the vacated area that abuts their property. Petitioners wilt not be requesting any
subdivision or other development as a result of this vacation.

The Depaz[ment of Public Works has completed a review of the above referenced vacation proposal
and recommends this street not be vacated.
This is an unimproved street. In December 1996 the Ciry Council approved the vacation of a poztion
of this block of Hadley Street, abutting Lot 20, Block 17, Burlington Heights Division No. 2. This was
done as a temporary vacation to accommodate an existing encroachment. The vacation is for the life of
that structure only, and reverts back to City right-of-way upon demolition of the structure. We allowed
this as a compromise because we did not want to permanently release our right-of-way in this block of
Hadley Street. See attached survey.
Also In 1996 Mr. Ojeda requested the vacation of the unimproved portion of Howard 5treet just north
of Hadley to allow additional azea for construction of single family homes. His request was approved
by City Council in April 1997. At that time our reason for allowing the vacation request was because
there was still the option of improving Hadley Street, if needed for sewer and access to the ll 19 acre
tract of land on the south side of Hadley. See attached map and memo from me dated November 4,
1996.
Hadley is shown as a street in the Highwood Plan and the Comprehensive Sewer Plan for the azea
proposes a sanitary main in Hadley Street. Therefore, due to the above factors, the Department of
Public Works recommends denial of their vacation petition.

The Department of Public Works has completed a review of the above referenced
vacation proposal and has the following comments or concerns.
1. The petitioner has recentiy extended the Howard Street improvements to serve the
parcel at the northeast corner of Howard and unimproved Hadiey Street. Attached is
a copy of the recent construction plan. A 15 foot boulevard is to be retained beyond
the end of improved Howard. There is a discrepancy between the lot lines shown on
the piat map and the lot lines shown on the construction plan. Since the discrepancy
would only create a larger boulevard rather than a smaller one, this should be
acceptable.
2. Because of the unusual shape of the proposed vacated area, the City surveyor has
concerns about how the vacated street wouid be split and how that split will be
described.
3. The topography of unimproved Howard Street would probably suggest that it wiil
not be improved through to Point Douglas Road. But, there is an 11.19 acre tract of
developable land south of the proposed vacation. Slopes from the south end of
Howard to this property are not so severe, that it may be feasible to extend Howard
further to the south to serve this property, aithough sewer would not be extended
through this portion of Howard. Sewer to serve this tract of land couid be brought in
from the portion of Howard St. west of this property or from Springside at the southeast
corner of the property.

Therefore, because there are other options for access and public improvements to
serve the property south of the proposed vacation, the Department of Public Works
has no objections, provided the property owner to the south is adequately notified of
this vacation proposal, and provided a 15 foot boulevard is retained.

After meeung with the petitioners, the Department of Public Works has reconsidered it's position
on the proposed vacation of Hadley Street and no longer objects to this vacation.
Hadley is shown as a street in the Highwood Plan, and the Comprehensive Sewer Plan shows a
sanitary main proposed in Hadley Street. The property to the south of the area to be vacated is
now owned by the St. Paul Parks Department and is designated as a pazk preserve. This property
will not be developed and there is sufficient access to the pazk from Winthrop. We have
contacted Pazks and they verified that llus property will not be developed and that they have no
need for this portion of Hadley as a public right-of-way.
Tn addition, all other pazcels in this azea will continue to have access from other streets.
Therefore, since the vacation wil] not land-]ock any pazcels, and Hadley St. no longer needs to be
reserved for futute development of the pucel to the south, the Department of Public Works no
longer objects to the vacation, subject to the following:

That part of Hadley Street that abuts the fiollowing lots: Lo#s 17, 18, 19,

Ramsey, State of Minnesota.
It is the intent of this petition to request the vacation of Hadley Street beginning at
the intersection of Howard Street and Hadfey Street to the paved portion ofi Hadley
street.
2. 6chibit A is a copy of the plat mat showing the approximate requested area to be
vacated. The dark shaded area is an existing easement ,
Exhibit B is a copy of a larger area pfat mat showing the area of Hadiey Street to be

3. The property on the south side of the proposed vacated property was recentiy
purchased owed by the City of Saint Paui, and it is the understanding of your
petitioners that the city plans a city park for the area.
4. Your petitioners intend to clean up, plant trees, and generally landscape the portion
of the vacated area that abuts their property. Petitioners wilt not be requesting any
subdivision or other development as a result of this vacation.

The Depaz[ment of Public Works has completed a review of the above referenced vacation proposal
and recommends this street not be vacated.
This is an unimproved street. In December 1996 the Ciry Council approved the vacation of a poztion
of this block of Hadley Street, abutting Lot 20, Block 17, Burlington Heights Division No. 2. This was
done as a temporary vacation to accommodate an existing encroachment. The vacation is for the life of
that structure only, and reverts back to City right-of-way upon demolition of the structure. We allowed
this as a compromise because we did not want to permanently release our right-of-way in this block of
Hadley Street. See attached survey.
Also In 1996 Mr. Ojeda requested the vacation of the unimproved portion of Howard 5treet just north
of Hadley to allow additional azea for construction of single family homes. His request was approved
by City Council in April 1997. At that time our reason for allowing the vacation request was because
there was still the option of improving Hadley Street, if needed for sewer and access to the ll 19 acre
tract of land on the south side of Hadley. See attached map and memo from me dated November 4,
1996.
Hadley is shown as a street in the Highwood Plan and the Comprehensive Sewer Plan for the azea
proposes a sanitary main in Hadley Street. Therefore, due to the above factors, the Department of
Public Works recommends denial of their vacation petition.

1. The petitioner has recentiy extended the Howard Street improvements to serve the
parcel at the northeast corner of Howard and unimproved Hadiey Street. Attached is
a copy of the recent construction plan. A 15 foot boulevard is to be retained beyond
the end of improved Howard. There is a discrepancy between the lot lines shown on
the piat map and the lot lines shown on the construction plan. Since the discrepancy
would only create a larger boulevard rather than a smaller one, this should be
acceptable.
2. Because of the unusual shape of the proposed vacated area, the City surveyor has
concerns about how the vacated street wouid be split and how that split will be
described.
3. The topography of unimproved Howard Street would probably suggest that it wiil
not be improved through to Point Douglas Road. But, there is an 11.19 acre tract of
developable land south of the proposed vacation. Slopes from the south end of
Howard to this property are not so severe, that it may be feasible to extend Howard
further to the south to serve this property, aithough sewer would not be extended
through this portion of Howard. Sewer to serve this tract of land couid be brought in
from the portion of Howard St. west of this property or from Springside at the southeast
corner of the property.

Therefore, because there are other options for access and public improvements to
serve the property south of the proposed vacation, the Department of Public Works
has no objections, provided the property owner to the south is adequately notified of
this vacation proposal, and provided a 15 foot boulevard is retained.
