WHEREAS, the Saint Paul Police Department has entered into an agreement with District Six Plavning Council
(District Six) for police services at the East Consolidated Weed and Seed site (Agreement # 02-11623-C�; and
WHEREAS, District Sig will reimburse up to $21,540 for coordinafion of Police Department issues and
any related overtime services provided at the East Consolidated Weed and Seed site; and
WHEREAS, a 2001 fmancing and spending plan needs to be established for the services provided to
District Six; and
WHEREAS, The Mayor pursuant to Section 10.07.1 of the Charter of the City of Saint Paul, does certify that
there are available for appropriation funds of $21,540 in eacess of those estimated in the 2001 budget; and
WHEREAS, The Mayor recommends that the following addition be made to the 2001 budget:

THIS AGREEMEN"C is made and entered into this first day of November, by and
DISTRICT SIX PLANNING COi7IVCIL, located at 1061 Rice Street, Saint Paul, MN
55117, hereinafter calted "DISTRICT b" and SAIi�'T PALTL POLICE DEPARTD'IEiVT
whose address is 101 EasT 11` Street, Saint Paul, MN 55101, hereinafter calied
"POLICE".
WITNE5SETH:
In consideration ofthe mutual terms and conditions, promises, covenants, and
payments hereinafter set forth, AISTRICT 6 and POLICE agree as follows:
SECTION 1. Scone of Services. The POLICE agree to provide project
coordination of Police Department issues, and any related services, above and beyond the
reDular scope of duty, to the East Consolidated Weed and Seed site, as recognized and
defined in the grant awarded by the State of Minnesota. Such services shall include, but
are not limited to; attendance at East Consolidated Weed and Seed Steerin� Committee
meeting u�henever possible; sufficient staff and/or overtime hours to increase POLICE
presence, good faith efforts toward stren�Yhened police/community relations, and wurk
toward improved community quality of life, as permitted by funds allowed.
POLICE will desi�nate and notify the East Consolidated Steering Committee who
will be responsible for managing the contract for POLICE. This designee will update
Coordinator monthly on the pro�ress of the project operations. The POLICE or the
POLICE desi�nee will be responsible for formulating progress reports, gathering
statistics for evaluatious, and/or other information necessary to assess accomplishment of
the scope of the project strategy as it pertains to the work of the POLICE, and/or as a
condition of the gi�ani a�vard.
SE�'7'LON 2. Time for Completion. The services rendered by the POLICE
shall commence on November I, 2000 and be completec on October 31, Z001. The
POLICE shall consult with or report to the Weed and Seed Coordinator and/or members
of the Steering Committee as needed to ensure fonvard pro�ress of the Weed and Seed
strategy.
SECTION 3. Chan�es in Scope of Sen�ices. The EAS7 CONSOLIBATED
STEER]IVG COMMITTEE or the POLICE may request changes that wouid increase,
decrease, or otherwise modify the "Scope of Services". DISTRICT 6 must be informed
in advance of such changes.
SECTION 4. Bitlin2s a�id PaVments.
A. That for the faithful performance of the POLICE to this AGREEMENT, DISTRICT G
agrees to reimburse the POLICE up to $21,540 for personnel costs for sen�ices

provided. Personne3 costs may include salary at straight tinie or overtime and the cost
of fringe benefits; but in no event may the hourly cost exceed $55/hour. POLICE witl
not bilt over $5,385.00 in any billing period, billed quarterly. Compensation sha11 be
in accordance with the line item budget as stated in exhibit A, which is hereby
incorporated by reference and made part of the contract.
B. POLICE will espend funds in accordance with E�ibit A and will submit a revised
bud�et for approval if Yhere is to be a deviation of more than 10% in any line item.
All contracts are dependent upon Weed and Seed funds, in the absence of Weed and
Seed funds this contract is null and void.
C. Payments shall be made by DISTRICT 6 promptly a$er POLICE's presentation of
invoices for services performed and acceptance of such services bg DISTRICT 6's
authorized representative. Invoices shall be submitted in a format and on a time
scheduie mutually agreed to by DISTRICT b and POLICE, but in no event, less
frequentiy than quarterly.
D. All services provided by POLICE shall be performed to the satisfaction of DISTRICT
6 as determine by the sole discretion of its Authorized ADent and in accordance with
all applicable federal, state and local laws, ordinances, rules and regulations.
E. Payments made pursuant to this contract shall be used only for the actual expenses
incurred in performing and accomplishing the purposes and activities described
herein between the Time for Completion. No cost incurred prior to or after the end of
tl�e contract period will be compensated.
SECTION 5. Discriminntion Policv. At all times, the POLICE shall abide by
Chapter 183 of the Saint PauT Legislative Code in any personnel related policies.
SECTION G. Termination. Either party to this AGREEb�NT may terminate it
by giving no less than thirty(30) days written notice, unless otherwise a�reed by both
parties, of the intent to terminate to the other party. In the event of termination, the
POLICE shall be reimbursed by DISTRICT 6 for a1f services actually, timely, and

date of termination.
SECTION 7. Indenendent Coi�tractm• Status. It is agreed that nothin� herein
contained is intended or should be construed in any manner as creatin� or establishing the
relationship of co-partners between the parties hereto or as constituting POLICE as an
agent, representative or employee of DISTRICT 6 for any purpose or in any manner
whatsoever. POLICE and its employees shall not be considered employees of
DISTRICT 6, and any and al( claims that may or might arise under the Worker's
Compensation Act of the State of Minnesota on behalf of the POLICE employees whfle
so engaged, and any and all ctaims whatsoever on behalf of POLICE employees arisinQ
out of employment shall in no way be the responsibility of DISTRICT 6. Except for the
compensation provided in Section 4 of this AGREEMENT, POLICE employees shall not
be entitied to any compensation or rights or benefits of any kind whatsoever from
DISTRICT 6. Further, DISTRICT 6 shal( in no way be responsible to defend, indemnify
or save harmiess POLICE from liability or judgments arising out of POLICE intentional
or negligent acts or omissions of POLICE or its employees while performin� act 0��

specified by this AGREEMENT.
SECTION 8. DISTRICT 6 Autharized Aa� e_nt DISTRICT 6's Authorized
Agent for the purpose of administration of this contract is its Executive Director.
SECTI(3N 9. A_,ssi�r�ment POLICE shall neither assi�n nor transfer any rights or
obli�ations under this contract without prior written consent of DISTRICT 6
SECTION 10. Accou�king nnd Retention of Booi;s POLICE agrees that its
books, records, documents and accountin� procedures and practices relevant to this
contract shall be subject to examination by DISTRICT 6, the STATE's Authorized A�ent
and the State or Legistative Auditor for a minimum of sis years. Records shali be
sufficient to reflect all costs incurred in performance of this contract.
SECTION 11. R eports POLICE will advise DISTRICT 6 concernins the
contract pro�ress throu�h the submission of reports as required by the Authorized A�ent
and the Executive Office of Weed and Seed.
SECTION 12. Hirin¢ Policies POLICE certifies that it has appropriate hiring
policies and screening procedures for emp(oyees and contractors that will be �vorking
directly �vith youYh and other residents as part of the Weed and Seed strategy.
SECTTON 13. Indemnitv. Police agrees that it shall defend, indemnify and save
harmless DIS'tRICT 6 and its officers, a�ents, servants, and employees from any and all
claims, demands, suits, judgments, costs and expenses asserted by any person or persons
including a�ents or employees of DISTRICT 6 or POLiCE by reason of death or injury to
re �;�n c�r persons or loss or damage to property arising out of, or by reason of, any
ne�ligent act, omission, operation or work oFPOLICE or its employees while engaged in
the execution or performance of services under this AGREEMENT. On ten days written
notice from DTSTRICT 6, POLICE wili appea; and defend all lawsuits against
DISTRICT' 6 growing out of such injuries or damages.
SECTION 14. Amendment of AEreement. The AGREEMENT may be
amended Uy further mutual written agreement of the parties thereto. DISTRICT 6 must
be informed and consulted with, regarding all amendments.
SECTION 15. Coniract Administration. In order to coordinate the sen•ices of
the POLICE with the activities of the Weed and Seed initiative so as to accomplish the
purposes of the contract, the Weed and Seed Coordinator shall manage this contract on
behalf of DISTRICT 6 and the East Consolidated Steerin; Commattee, and serve as a
liaison between DISTRICT 6 and POLICE.

SECTION 15. Coniract Administration. In order to coordinate the sen•ices of
the POLICE with the activities of the Weed and Seed initiative so as to accomplish the
purposes of the contract, the Weed and Seed Coordinator shall manage this contract on
behalf of DISTRICT 6 and the East Consolidated Steerin; Commattee, and serve as a
liaison between DISTRICT 6 and POLICE.

WHEREAS, the Saint Paul Police Department has entered into an agreement with District Six Plavning Council
(District Six) for police services at the East Consolidated Weed and Seed site (Agreement # 02-11623-C�; and
WHEREAS, District Sig will reimburse up to $21,540 for coordinafion of Police Department issues and
any related overtime services provided at the East Consolidated Weed and Seed site; and
WHEREAS, a 2001 fmancing and spending plan needs to be established for the services provided to
District Six; and
WHEREAS, The Mayor pursuant to Section 10.07.1 of the Charter of the City of Saint Paul, does certify that
there are available for appropriation funds of $21,540 in eacess of those estimated in the 2001 budget; and

THIS AGREEMEN"C is made and entered into this first day of November, by and
DISTRICT SIX PLANNING COi7IVCIL, located at 1061 Rice Street, Saint Paul, MN
55117, hereinafter calted "DISTRICT b" and SAIi�'T PALTL POLICE DEPARTD'IEiVT
whose address is 101 EasT 11` Street, Saint Paul, MN 55101, hereinafter calied
"POLICE".
WITNE5SETH:
In consideration ofthe mutual terms and conditions, promises, covenants, and
payments hereinafter set forth, AISTRICT 6 and POLICE agree as follows:
SECTION 1. Scone of Services. The POLICE agree to provide project
coordination of Police Department issues, and any related services, above and beyond the
reDular scope of duty, to the East Consolidated Weed and Seed site, as recognized and
defined in the grant awarded by the State of Minnesota. Such services shall include, but
are not limited to; attendance at East Consolidated Weed and Seed Steerin� Committee
meeting u�henever possible; sufficient staff and/or overtime hours to increase POLICE
presence, good faith efforts toward stren�Yhened police/community relations, and wurk
toward improved community quality of life, as permitted by funds allowed.
POLICE will desi�nate and notify the East Consolidated Steering Committee who
will be responsible for managing the contract for POLICE. This designee will update
Coordinator monthly on the pro�ress of the project operations. The POLICE or the
POLICE desi�nee will be responsible for formulating progress reports, gathering
statistics for evaluatious, and/or other information necessary to assess accomplishment of
the scope of the project strategy as it pertains to the work of the POLICE, and/or as a
condition of the gi�ani a�vard.
SE�'7'LON 2. Time for Completion. The services rendered by the POLICE
shall commence on November I, 2000 and be completec on October 31, Z001. The
POLICE shall consult with or report to the Weed and Seed Coordinator and/or members
of the Steering Committee as needed to ensure fonvard pro�ress of the Weed and Seed
strategy.
SECTION 3. Chan�es in Scope of Sen�ices. The EAS7 CONSOLIBATED
STEER]IVG COMMITTEE or the POLICE may request changes that wouid increase,
decrease, or otherwise modify the "Scope of Services". DISTRICT 6 must be informed
in advance of such changes.
SECTION 4. Bitlin2s a�id PaVments.
A. That for the faithful performance of the POLICE to this AGREEMENT, DISTRICT G
agrees to reimburse the POLICE up to $21,540 for personnel costs for sen�ices

provided. Personne3 costs may include salary at straight tinie or overtime and the cost
of fringe benefits; but in no event may the hourly cost exceed $55/hour. POLICE witl
not bilt over $5,385.00 in any billing period, billed quarterly. Compensation sha11 be
in accordance with the line item budget as stated in exhibit A, which is hereby
incorporated by reference and made part of the contract.
B. POLICE will espend funds in accordance with E�ibit A and will submit a revised
bud�et for approval if Yhere is to be a deviation of more than 10% in any line item.
All contracts are dependent upon Weed and Seed funds, in the absence of Weed and
Seed funds this contract is null and void.
C. Payments shall be made by DISTRICT 6 promptly a$er POLICE's presentation of
invoices for services performed and acceptance of such services bg DISTRICT 6's
authorized representative. Invoices shall be submitted in a format and on a time
scheduie mutually agreed to by DISTRICT b and POLICE, but in no event, less
frequentiy than quarterly.
D. All services provided by POLICE shall be performed to the satisfaction of DISTRICT
6 as determine by the sole discretion of its Authorized ADent and in accordance with
all applicable federal, state and local laws, ordinances, rules and regulations.
E. Payments made pursuant to this contract shall be used only for the actual expenses
incurred in performing and accomplishing the purposes and activities described
herein between the Time for Completion. No cost incurred prior to or after the end of
tl�e contract period will be compensated.
SECTION 5. Discriminntion Policv. At all times, the POLICE shall abide by
Chapter 183 of the Saint PauT Legislative Code in any personnel related policies.
SECTION G. Termination. Either party to this AGREEb�NT may terminate it
by giving no less than thirty(30) days written notice, unless otherwise a�reed by both
parties, of the intent to terminate to the other party. In the event of termination, the
POLICE shall be reimbursed by DISTRICT 6 for a1f services actually, timely, and

date of termination.
SECTION 7. Indenendent Coi�tractm• Status. It is agreed that nothin� herein
contained is intended or should be construed in any manner as creatin� or establishing the
relationship of co-partners between the parties hereto or as constituting POLICE as an
agent, representative or employee of DISTRICT 6 for any purpose or in any manner
whatsoever. POLICE and its employees shall not be considered employees of
DISTRICT 6, and any and al( claims that may or might arise under the Worker's
Compensation Act of the State of Minnesota on behalf of the POLICE employees whfle
so engaged, and any and all ctaims whatsoever on behalf of POLICE employees arisinQ
out of employment shall in no way be the responsibility of DISTRICT 6. Except for the
compensation provided in Section 4 of this AGREEMENT, POLICE employees shall not
be entitied to any compensation or rights or benefits of any kind whatsoever from
DISTRICT 6. Further, DISTRICT 6 shal( in no way be responsible to defend, indemnify
or save harmiess POLICE from liability or judgments arising out of POLICE intentional
or negligent acts or omissions of POLICE or its employees while performin� act 0��

SECTION 8. DISTRICT 6 Autharized Aa� e_nt DISTRICT 6's Authorized
Agent for the purpose of administration of this contract is its Executive Director.
SECTI(3N 9. A_,ssi�r�ment POLICE shall neither assi�n nor transfer any rights or
obli�ations under this contract without prior written consent of DISTRICT 6
SECTION 10. Accou�king nnd Retention of Booi;s POLICE agrees that its
books, records, documents and accountin� procedures and practices relevant to this
contract shall be subject to examination by DISTRICT 6, the STATE's Authorized A�ent
and the State or Legistative Auditor for a minimum of sis years. Records shali be
sufficient to reflect all costs incurred in performance of this contract.
SECTION 11. R eports POLICE will advise DISTRICT 6 concernins the
contract pro�ress throu�h the submission of reports as required by the Authorized A�ent
and the Executive Office of Weed and Seed.
SECTION 12. Hirin¢ Policies POLICE certifies that it has appropriate hiring
policies and screening procedures for emp(oyees and contractors that will be �vorking
directly �vith youYh and other residents as part of the Weed and Seed strategy.
SECTTON 13. Indemnitv. Police agrees that it shall defend, indemnify and save
harmless DIS'tRICT 6 and its officers, a�ents, servants, and employees from any and all
claims, demands, suits, judgments, costs and expenses asserted by any person or persons
including a�ents or employees of DISTRICT 6 or POLiCE by reason of death or injury to
re �;�n c�r persons or loss or damage to property arising out of, or by reason of, any
ne�ligent act, omission, operation or work oFPOLICE or its employees while engaged in
the execution or performance of services under this AGREEMENT. On ten days written
notice from DTSTRICT 6, POLICE wili appea; and defend all lawsuits against
DISTRICT' 6 growing out of such injuries or damages.
