Presented By Referred To Committee: Date � Out of Committee By Date ► WHEREAS, a �etition for a referendum on Ordinance No. 15724, entitled 'An Ordinance amending Chapter 310 of the St. Paul Legislative Code pertai�ing to solid waste and city collection of solid waste from residential property" has been filed in the Office of the City Clerk pursuant to Chapter 8 of the Charter; and WHEREAS, the City Clerk has reported to the City Council that the petition contains in excess of 6,000 valid signatures in a communication dated February 5, 1975; and WHEREAS, signatures of eight percent of those who voted for Mayor in the last city election (64, 174 votes cast) would be 5, 134 signatures; now, therefore, be it RESOLVED, that the Council, as required by Section 8.03 of the Charter, hereby determines that the petition is sufficient; anct be it � FURTHER RESOLVED, that, as required by Section 8.05 of the Charter, Ordinance No. 15724 as above entitled is suspended in its operation on the date of passage of this resolution. REGNIER RECEIVED F r� 6 1975 Council Pf�t i�by Htu� Honorable Members of the City Council of the City of Saint Paul : Enelosed herein. is a letter from the City Clerk which, in effect, reports to the City Council that the petition for a referendum pertaining to Ordinance No. 15724, involving solid waste collection in the City of Saint Paul, is sufficient amt�, coat�a�.ns the required number of signatures pur?- suant to the Saint Paul City Charter . It is necessary at this time that the City Council must determine the sufficiency of the petition by resolution. Upon your request, I will draft a resolution determining the sufficiency of the petition based upon the report issued by the office of the City Clerk. Pursuant to Section 8. 05 of the Saint Paul City Charter, once the resolution is passed determining the sufficiency of the petition, the ordinance will be suspended in its ope ration immediately. Said section of the Charter further provides that "if the ordinance is not thereafter entirely repealed, it shall be placed on the ballot at the next elec- tion, or at a special election called for that purpose , as the council shall determine . The ordinance shall not become operative until a majority of those voting on the ordinance vote in its favor. " I would suggest that the Council determine whether or not it wishes to place this matter on the ballot , either at the next election or at a special elec- tion called for the sole purpose of voting on this particular ordinance . In the resolution determining City Hall, Saint Paul, Minnesota 55102 612 298-5121 City Council Page Two February 5, 1975 the sufficiency of the petition, I will include the Council ' s request as to whether the matter should be placed on the ballot for the next election or at a special election. REGNIER To the Honorable Members of the ' City Council of the City of St. �aul: Re: Time When Referendum Proposition Must Be Submitted To Electors (Mandatory Trash Collection Ordinance) , On October 23rd, 1974, the City of St. Paul adopted and approved Ordinance No. 15724 pertaining to solid waste and city collection of solid waste from residential property. Subsequent to October 23rd, 1974, a petition for referendum was filed with the Gity Clerk relative �co this ordinance. The City Council, by resolution, Council File No. 264775, dated December 27, 1974, found the referendum petition to be insufficient. Subsequently, a new .petition was filed with the City Clerk relative to the same ordinance and the City Council, by resolution, Council File No. 265072, dated February 27, 1975, found the referendum pet�_tion to be sufficient. The petition for referendur.i havi_ng been found sufficient, Ordinance No. 15724 is suspenc�ea in its operation pursuant to Section 8.05 of the St. Paul City Cr.arter. On October 7, 1975 the City Council discussed the options which are available to it relative to placing this matter on the ballot for a public v�te. At this meeting the City Council was advised that pursuant to Section 8.05 of the City Charter, it had the authority to repeal the ordinance in its entirety at this ti.m�. The Council was further advised that if it did not determine to call a special election for placing this matter on the ballot, it is mandatory that the election officia�s place this matter on the ballot at the next election, which is the primary election to be held in rSarch of 1976. City Hail, Saint Paul, Minnesota 55102 612 298-5121 , Honorable Members of the City Council of the City of St. Paul Page Two , October 20, 1975 At the October 7, 1975 Council meeting, several members of the Council voiced the opinion that it would be their desire to place this matter on the ballot at the next general election to be held in November of 1976. QUEST ION May the City Council direct the election officials to place Ordinance No. 15724 on the ballot at the general election to be held in November of 1976? oP n�zorr The ti.me when a proposition which is the subject of a referendum petition must be placed on the ballot is governed in the City of St. Paul by a provision contained in Section 8.05 of the St. �aul City Charter, which provides as follows: "Any ordinance upon which a petition is filed, other than an emergency ordinance, shall be suspended in its operation as soon as the petition is found sufficient. The ordinance it not thereafter entirely repealed, it shal.l be placed on the ballot at the next election, or at a special election called for that purpose, as the Council shall determine. " 1 The precise question presented by the facts in this �ase as applied to the above quoted section is whether or not �.he special election which the Council may call must be held prior to th�� next regularly scheduled election after the petition for referendum has been found to be sufficient, which in this case would be the primary election 1. It should be noted that under the previous City Charter in the City of St. Paul, it was provided that an ordinance which was the subject of a petition for referendum would not go into effect " ***until approved by a majority of all the electors voting therein at a gene�al or special city election within the City of St. Paul. " Honorable Members of the City Council � of the City of St. Paul Page Three October 20, I975 in March of 1976. In interpreting this section of the char.ter, for the purpose of answering the above question, we are without the assistance of any Minnesota case law interpreting this particular section or one identical thereto, and we are without the assistance of any Attorney General opinions interpreting this specific provision of our charter. � Basically, there are two Minnesota Supreme Court decisions per- taining to the issue of referendum on city ordinances. In Megnella v. Meinin , 133 Minn. 98 157 N.W. 991 (1967) , the Minne- sota Supreme Court held to be invalid an ordinance which reenacted in substantially the same form provisions of a previous ordinance which had been repealed after a referendum had been filed and determined sufficient as pertains to the original ordinance. The court held that the municipality can only re-pass a new ordi- nance if the second ordinance is essentially different, although covering the same subject matter, and if it is enacted in good faith with no intent to evade a referendum petition. This case would stand for. the proposition that the City of St. Paul could not at this time repeal Ordinance No. 15724 and then reenact an ordinance which is essentially the same for the purpose of evading a referendum petition. The Minnesota Supreme Court, in Anderson v. City of_ Duluth, 279 Minn. 50, 155 N.W. 2d 81 (1967) , found the following procedure followed by the City Council of the City of Duluth to be valid. An ordi- nance was passed by the City Council and a petition for referendum was declared insufficient by the City Council. The City Council of Duluth, not wishinq the ordinance to go into effect without a vote of the people, since the petition for referendum indicated the people so desired, repealed the ordinance and on the same day passed an identical ordinance, which became the subject matter of a new petition for referendum which was declared sufficient. An election was held and the ordinance was approved. In upholding a challenge made to the validity of this second ordinance , the court - found that the Council' s purpose in acting the way it did was to provide the electorate with the opportunity of properly circulating a petition so the matter could be brought on for a vote before the public. The court upheld this action upon a finding that the _,._ ___�..__._.,.._�__,.,..-.� Honorable Members of the City Council of the City of St. Paul Page Four October 20, 1975 City Council acted in good faith and without intending to defeat the referendum provisions of the City Charter and also the court pointed out that the plaintiffs had failed to present any evidence showing or intending to show that they were in any way prejudiced as a result of the fact that the ordinance was sub- mitted to a vote of the people. Neither of the above cited Minnesota Supreme Court decisions deal with the issue of timeliness of placing the matter which is the subject to a referendum petition on the ballot. Upon reviewing decisions on this issue by other jurisdictions, it has been held that time limits set by the charter are absolute in the absence of state law to the contrary and if �he charter does not specify any time limits, the courts will not interfere with the Council' s discretion in setting special elections, unless their action is arbitrary, capricious and unreasonable. State v. Board of Elections of Lucas County, 79 N.W.2d 183 (Ohio 1946) , State v. Jones, 78 N. E.2d 727 (Ohio) . In Ex parte Banta, 78 P.2d 243, 25 Cal. App. 2d 622 (1938) , the city ordinance required that the ordinance be submitted �o a vote of the qualified electors of the city at a special municipal election to be called for that purpose within 40 days from the date of the certificate of the Clerk detennining that the petition is sufficient. In the Banta case, the court held that this charter provision only required that the call for the election be made within the 40 days, but that the election need not be held within 40 days. While holding the special election prior to the next election would in our opinion be a more defensible position to present to a court, based upon the language contained in Section 8.05 of the St. Paul City Charter, nevertheless, it is our opinion that a successful argument can be made to a court that the City Council under Section 8.05 of the City Charter has the authority to call for a special election to be held after the next election and at the same time as a general election in November of 1976. To support this position, we would argue the following : Honorable Members of the City Council of the City of St. Paul Page Five ' October 20, 1975 � 1. The language of Section 8.05 of the City Charter does not unequivocally state that the special election must take place prior to the next regularly scheduled election. It merely provides for an alterna�ive election if the City Council shall so determine. 2 . In applying the "good faith test" , it can be argued that the placing of this matter on the ballot at the next general election in November of 1976 is not intended to delay a vote on the matter, but is merely intended to insure that this proposition is voted upon by the most persons possible, since history shows that more persons vote at the general election than at the municipal primary election. 3. Since the ordinance is not in effect until the matter is voted upon, we are unable to visualize any prejudice ,that will accrue to anyone, particularly the petitioners, if the election is to be held in November of 1976 rather than March of 1976. 4. A matter subject to a special election can be held at the same time as a general election. In an Opinion of the Attorney General, No. 185-B-2, October 13, 1950, the Attorney General for the State of Minnesota held that a special election for voting upon the adoption of an ordinance may be held on the same day as a general election. A "referendum election" was held to include a general elPCtion in State v. Mellick, 68 So. 2d 824 (Florida 1953) . 5. In arguing in favor of a deternnination made by the City Council to hold the referendum election at the time of the general election in November of_ 1976, we would argue that since the City Council, pursuant to Section 7.07 of the City Charter, could repeal the ordinance and reenact it for the purpose of placing it on for a special election of the people at the next general election - . _ _..._;.__.__..,>,.,��,� . ` . . . ^ - . Honorable Members of the City Council of the City of St. Paul Pag e S ix October 20, 1975 in November of 1976, a City Council can designate that a matter which is the subject of a referendum petition be placed on the next general election in November of 1976. It is our suggestion that if the City Council determines to place this matter on the ballot at the next general election to be held in November of 1976, that this office draft a resolution for the City Council, designating the reasons why the matter is beirig placed on the ballot at that time, and that a copy of that resolution be forwarded to the attorney for the petitioners so that a court action can be commenced immediately by such persons, if they wish to challenge the procedure designated by the Council. It is our opinion that a court will be less sympathetic to views of a plaintiff who waited until after the election to challenge the procedure for that election. Courts are hesitant to void an election and the election results because of failure to comply with some specific prerequisites of the law. regarding election procedure, so long as it can be established that the substantive rights of the elector have been safeguarded. See People v. Voorhis, 126 Misc. 118, 212 N.Y. Supp. 523 (1925) . CONCLUSION It is our opinion that the City Council may determine that Ordinance No. 15724 be voted on at the next general election to be held in November of 1976. It is our opinion that this resolution directing election officials to place this ordinance on the ballot at the November 1976 election be passed in the near future, so that if any persons wish to challenge this procedure, they may do so before the next primary election. As you may recall, I have been representing Mr. and Mrs. James Cashill throughout the pendency of their petition to obtain a referendum an the Solid Waste Ordinance. You w�ll furthe� �eca�Z that tr�e Cashills s�mitted appro�im�.teli� 8500 signatures on their Petition last November and you saw fit to throw out approximately 3500 so that the Petition was approxi- mately 125 signatures short. After they went out and obtained another 1000 signatures, you as a council, certified the Petition and apparently decided to have the referendum at the next general election rather than call a special election. Subsequently the City of St. Paul saw fit to propose to the Minnesota State Legi.slature House File No. 1461 (Senate , File No. 1425) . This bill proposed by the City of St. Paul - read in part as follows: "Not withstanding any contrary provision of law, charter or ordinance, the City of St. Paul may directly negotiate and enter into contracts for purpases relating to solid waste management as defined in Minnesota Statutes. . .the contracts may include provisions relating to facilities as defined in Minnesota Statutes, . . .equipment and labor. ° It was my opinion at that time that passage of House File No. 1461 would have negated the Referendum Petition and aZlowed the City of 5t. Paul to implement the Solid Waste Disposal Ordinance withaut a referendum. Therefore at our request the State Legislature added a new section to the proposed law St. PauZ City Council Page 2 :- October 20 , 1975 which read as follows : . "Nothing herein eliminates the requirements se�t by the St. Paul �City Charter regarding a referendum � on any ordinance adopted by the Eity relating to solid waste collection, including the per.ding referendum on Ordinance No. 1572a. " In my opinion House File No. .1461 was an effort to remove fron the voters of St. Paul their opportunity to be heard on the So1id Waste Disposal Ordinance. According to newspaper reports contained in the St. Paul Dispatch on Thurs�ay, Sept�m�sr 11, the Pr�sident of the St. Paul City Council gave his opinion that the referen- dum procedure was too easy to invoke in the City of St. Paul siting the example oi my clients wno obtained enough signa-- tures to require the referendum on the Solid Was�e Grdinance. hir. Apparently the intent is to have the referendum go on the bal�et :�_r_ the ful� of ' 76 , during a Presidential Election, ��?hile the t�innesotans are electing a new United States Senator, and while every State Representative and State Senator in Minnesota are running fo-r re-election. I can only assume Mr. Hozza does not desire to have tnis issue on. the same ballet in which he runs for re- election if he chooses to do so. It seems quite obvious to me that the place for this referendum is on the municipal ballet nex�t spring, cvhen issues of tr�is nature should be dis- cussed by the candidates and -the people allowed to make their decision at that time. � St. Paul City Couneil Page 3 October 20, 1975 , The chronology of the Solid Waste Ordinance and Referendum and the attempts of the Ci.ty Council to avoid or postpone hearing the voice of the people will, I hope, be noted by the vaters of the City of St. Paul. Instead of complying with a letter and the spirit of the referendum procedures contained in � the City Charter, �in my judgment the Council has done every- thing in: its power to thwart and avoid the referendum rights of the vo�ters. I strongly urge the Council to reject any effort to postpone or continue this referendum.
