RESOLVED, that the Council of the City of Sai,nt Paul
hereby ratifies and approves the action of the Saint Pau1 Board of
Appeals and Review at its meeting of January 14 , 1975, granting a
basement waiver from the Saint Paul Legislative Code, Section 54. 13(a)
pertaining to ceiling height requirement and Sect�on 54. 14 (a) pertai,na�ng
to light and ventilation requirement so as to permit basement occupancy,
on condition that repairs designated on Survey List, dated 11/27/74 ,
are completed by 11/20/75 for code compliance .

Rec{uest for waiver from St. Paul Legislative Building Code requirements
regarding basement apartment ceiling as too low and improper light and
ventilation of floor area.

PROCEEDINGS :
A4r . Wolkowicz said there are 13 units in his building , housing about
60 people. He requested a waiver on a basement unit where the ceiling
height is not high enough to comply with code requirements . He also
asked a waiver on the requirenent that there be l00 of the floor space
in window area. The bedroom in basement apartment had more than 100 ft .
of floor space but the windotia area was only 6 sq. ft .
Mr . Staffenson said the required height was 7 ft. 6 in. , and the ceiling
in the apartment was only 6 ft . 9 in.
Mr . Rvy said there are other items listed on the Survey, but Mr. Wolkowicz
is in process of taking care of them.
Mr. Tieso noted that the report called for new electrical service .
Mr . Wolkowicz said that for financial reasons he did nat feel he could
have a new service installed, but he had contracted with J . J . Moore ,
an electrician, to change the 15-amp service in such a way as to eliminate
overloading .
Mr . Tieso said this would only be a temporary solution, and it would be
better to spend more now to install a neia electrical service ,as it
would have to be done eventually .
Mr. Staffenson said his department would check with Electrical Inspector
George Smolik to see if permits ilere issued and whether the inspectors
were satisfied with the type of �aork bein� done .
BOARD ACTION :
Chairman Wozniak moved that a variance be granted on the basement
occupancy , subject to Mr . Wolko�aicz ' completing all the items listed
on the inspection of November 27 , 1974 . T4r. Tieso seconded. MOTION
PASSED AND SO ORDERED.
