WI3EREAS, Minnesota Statutes 1974, Section 488A.20,
Subd. 4 (e) provides that each municipality within which
a violation of a statute or ordinance has taken place will
receive one—half of all fines or penalties collected in
the Ramsey County Municipal Court, and the other half will
be received by the County of Ramsey; and
WHEREAS, the Ramsey County Board of Commissioners, by
Resolution No. 75-052 adopted January 20 , 1975, requested
the Ramsey County Delegation to the i975 Minnesota State
Legislature to endorse and seek enactment of legislation
whereby all revenue generated by the Ramsey County Municipal
Court be paid directly to Ramsey County; and
WHEREAS � the City of Saint Paul is in reoeipt of a report
prepared by the County of Ramsey in support of its Resolution
No. 75-052, which report speeifies that the total a�propria-
tion fo� Ramsey County Municipal Court for 1975 is 2, 305,450,
and that the total estimated revenue from the Municipal Court
is �1�994,402; and
WHEREAS, thi.s same report submitted by the County of
Ra.msey states that the entire cost of �2, 305 ,450 must be
paid by the County of Ramsey and that other municipalities
are relieved of the finaneial burden of supporting the
courts and thus receive a windfall estimated at �82g,000;
and
WI3EREAS, in actuality, revenues received from fines ,
penalties or fees generated within the Ramsey County Municipal
Court which in.ure to the benefit of the City of Saint Paul
are not, in fact, a '�windfall, " but, rather, such revenues
are less than the actual expenditures incurred by the City

WHEREAS, it is estimated that the City of Saint Paul will
reeeive as revenue from the Ramsey County Municipal Court,
from fines , fees and penalties, between �620,000 and �648�000;
and
WHEREAS, the estimated s975 expenses of the City of Saint
Paul in generating this revenue from the Ramsey County Municipal
Court are as follows :
(a) Salaries , costs and miscellaneous expenses
incurred by the office of the City Attorney
for the City of Saint Paul in preparing
complaints and prosecuting petty misdemeanors
and misdemeanors �or violations occurring
witY�in the City of Saint Paul, an amount
� of approximately �255,Q00.
(Upon adoption of the proposed Rules of
Criminal Procedure for courts in the
State of Minnesota, it is estimated that
the additional cost to the City Attorney
will be approximately �137,000. )
(b) Estimated cost for the year i975 for the
Saint Paul Police Department in initiating
cases and appearing as wif�nesse� in criminal
cases involving petty misdemeanors and
misdemeanors in the City of Saint Paul
is ���000.

(c ) Estimated cost for parking meter collectors
for the City of Saint Paul in the year 1975
is �30, 902.
(d) By virtue of state law, the City of Saint
Paul is required to pay one-half of the ex-
penses cf repairing, heating and maintaining
the Saint Paul City Hall and Ramsey County
Court House Building, within which the
greater part of the Ramsey County Municipal
Courts operate .
(e ) All proceedings involving city health,
building, housing, zoning and license code
violations are precipitated by action
taken by City of Saint Paul inspectors ,
who are paid solely by the City of Saint
Paul.
and
WHEREAS, the above facts evidence that the expenses in-
curred by the City of Saint Paul in generating revenue within
the Ramsey County Municipal Court far exceed the revenues
received by the City of Saint Paul from fines, fees, penalties
and forfeitures collected in that Court; and
WHEREAS , under the present status of the law, the City
of Saint Paul sustains a further inequitable treatment in
that the City Attorney' s office processes and prosecutes all
misdemeanor violations brought by the Minnesota Highway Patrol

for violations occurring within the City of Saint Paul, and
the City of Saint Paul receives no revenue from such fines
resulting therefrom; and
WHEREAS, under the law as it presently exists , the Gity
of Saint Paul sustains a further inequity in that the City of
Saint Paul receives no revenues from forfeiture of bail an.d
bonds, despite the fact that the actions precipitating the
bail and bond were primarily the actions of City inspectors,
City police , City parking meter collectors , or the City
Attorney' s office ;
Now, Therefore , be it
RESOLVED, that the Council of the Gity of Saint Paul
opposes legislation which would provide that all revenue
generated by the Ramsey County Municipal Court be paid
directly to Ramsey County; and be it
FURTHER RESOLVED, that the City Counc il of the City of
Saint Paul respectfully requests the Ramsey County Delegation
to the 1975 Minnesota State Legislature to refuse en dorseme nt
of legislation which would provide that all revenue generated
by the Ramsey County Municipal Court would be paid directly
to Ramsey County.
