WHEREAS, The Council, pursuant to the provisions of Section 12. 09 of the Saint Paul City Charter and the Public Employees Labor Relations Act of 1971, as amended, recognizes the Professional Employees Association as exclusive representative for those classes of positions within the City of Saint Paul certified by the Bureau of Mediation Services under Case No. 74-PR-207-A for the purpose of ineeting and negotiating the terms and condi.- tions of employment for all full-time personnel in the classes of positions as set forth in the agreement between the City and the exclusive representa.- tives hereinabove referenced; and WHEREAS, The City through designated representatives and the exclu- sive representatives have met in good faith and have negotiated the economic terms and conditions of employment for the year of 1974 for such personnel, as are set forth in the Memoranduxn of Agreernent between the City and exclusive representatives; now, therefore THE COUNCIL OF THE CITY OF SAINT PAUL DOE5 ORDAIN; Section 1. That all of the terms and conditions set forth in said Memorandum of Agreement shall take force and effect retroactively to January 5, 1974, i.n accordance with the expressed intent and agreement of the Council contained in Council File Numbers 262768 and 262851. Section 3. That any other Ordinance, rule or regulation in force when said agreement takes effect, i.nconsistent with any provision of the terms and conditions of said agreement, is hereby repealed. In full settlement of 1974 negotiations, the parties hereto have agreed as fol�owe: l. All salaries shall be increased by eight percent (8%) retroactive ta Janttary 5., 1974, 2. Notwithstanding the salary increase hereinabove set forth and the fringe imgsove- menta previonslp adopted, it is agr.eed that the litigatioa_es#a�liahing t�e associa� tionts right to binding arbitration, which is the subject of a.a apptal before the Supreme Court of the State of Minnesota, ahall not be affected, nor ahall the Eity assert these settlements as a basis for making such litigation moot. 3. It is further understood that previous agreements relative ta fringe improvements sha.Il remain in effect and shall not be affected by thia settZement.
