An administrative ordinance
amending Ordinance 14903, as amended,
authorizing and directing the Purchasing
Agents of the City of Saint Paul to sell
certain cemetery grave sites owned by
the City and located in Oakland Cemetery
WHEREAS, the Council by Ordinance 14903 authorized selling
of City owned cemetery lots located in Oakland Cemetery for the
svm of $40.00 for each grave; and
WHEREAS, the Valua.tion Engineer has reported to the Council
that the fair ma.rket value of each grave is $70.00; and
WHEREAS, the Council has been requested to increase the
sale price of each grave site not already sold; now, therefore,
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. Z'h.at Ordinance 14903, as amended, be and the
same is hereby further amended so as to authorize the sale and
conveyance of all remaining city-owned graves located in Oakland
Cemetery for the sum of $70.00 for each grave, and the proper City
officers are authorized to execute the necessary deeds and docu-
ments of conveyance.
Section 2. This ordinance shall take effect and be in force
thirty (30) days from and after its passage, approval and
publication.

The sub3ect grave sites were authorized to be sold by the City Council
per Ordinance No. 14903, C. F. 255�+0! adopted and appraved Sept�mber
9, 1971, a copy of which is attached for yaur reference. Subsequently,
sales �ere stop�ed pendin� the resolution of a lega]. proble�m conc�rni.ng
one of the sales. Since it has been four years since the lrast apprsisa].
of the grave sites, I wauld reco�mten�l an increase in the appraised value
of.the sites f'rom $�t�0.00 to $70.00, based on the incr�sed values oF the
grave sites as submitted by the O�k3�and C�metary Association.
In vie�r of the foregoing, I receamnend the attached ordir�nce authorizing
the sale of the grave sites be approved by yo�u Por submission tc Council.

Several of the lots were sold bnt the procedure �s �to�p�ped due to
legal proble�►s resul�ing frcm � sale to oae VanBusldrk (aee August 15th
me�ono attached).
The VanBuskirk prnblem has been resolved as per Council File Nwa,ber
264146 attached. We now can proeeed with the disposal of the be�lance of
the lots, ha►ever, since a great deal oP time Yias e]apsed� a camplete
revie� of the nv�nber of lots for sale, their locatio�, aa�d their market
v�lue, wauld ap�ar to be in order. Wc know fram previeua correapcmdence
that the Valuation Engineer as well as the Council xere involved in
establishi�g the origi�al fig�re.

, debates generated several humorous human iriterest accounts in
the local newspapers . Both rlcCarty ��nd Isaacs left of£ice the
next week.

FIarold Speak of the Purchasing De�>artment wrote to Mr. VanBuskirk
explaining that he wished to c1E�ar the k�ooks on this sale. He
r.equested that Mr . VanBuskirk �it_tier pay the balance of $120
by January l , 1973 , or pick up a reftir��d of his $2.00. Mr. Vannuskirk
did not follow either of these courses.

The claim was rejected by Mer.ry D}�er of the City Attorney' s office
and she sent bac}: to him his $200 notinc� that he could still
purchase 5 lots for that amount if lie still desired.

Mayor Cohen' s office .
II. Comment
According to records of the Purchasing Depart�^Qnt, four other
parties entered into agreements to I�urchase a total of 25 lots
at the advertised price of $25 each during the period Niarch 1
to March 5 , 1971 , the time at �,;hich Mr . Van�uskirk made his
oriqinal downpayrlent . In each case, these pureHasers later paid
the pr_ice of $40 as authorized by the Council and Quit Claim Deeds
were executc�d .

This is in contrast to the cost the city has already experienced
in employee time s��nt in cic�al inc� with this problem. It is

� It. has been sugg�sted to me that the Council action in designating
the sale price at $40 rath:�r than $25 was in lar.ge part a practical
joke directed at Ger.ald Is��acs . I don' t know how reliahle this
is I�ut i_f it is true, the cor;t�, c�f t.his ptactical joke both to
the city in manhours anc� to Mr . Van}3u_kirk i.n mental angttish has
been enormou� .
Mr. VanBuskirk at this p�i.nt -i s 81 ��f:;�r s ald . He is blind, in
frail health and has recently sastained a broken neck. It seems
clear to me that the time has come tu resolve this matter. once
and for all and it certainly is �,lear in view of Mr. VanBuskirk ' s
condition that t�me is of the c�ssence.
I have spoken with 111 Hestor , an ��ttorney for Senior l�dvocates,
and with Donald Stanton o1 th� Z'urchasing Department. I believe
that both of these mPn woula be willing to join with the OfFice
o£ Consumer ?lffairs in ur.:�tinq a sE,ecial cauncil ordinance autho-
ric�.in the sale of these lot� to ?�1r . Van�3uskirk at $25 each.
