01-796Council File # __�L��� RESOLUTION CITY OF SAINT PAUL, NIINNESOTA Presented By Referred To CneenSheet# 1fl3�t0 S �, Committee: Date WHEREAS, Chapter 293 of the Saint Paul Legislative Code was enacted to regulate the subject of noise in the City of Saint Paul; and WHEREAS, �293.11 provides for the granting of variances from the sound level limitations contained in §293.09, upon a finding by the City Council that full compliance with Chapter 293 would constitute an unreasonable hardship on an applicant, other persons or on the community; and WHSREAS, the West End Business Revitalization Corporation and the West End Business & Professional Association, represented by Holly Crouse, of theWest End Business Revitalization Corportion, who has been designated as the responsible person on the application, have applied for a variance to allow live music at the property bounded by Kellogg Avenue, 5"' and 7`" Streets, on August 17 and August 18, 2001; and WHEREAS, applicant is seeking a variance for the hours of 5:00 p.m. to 10:0� p.m. on Friday, August 17, 2�01 and for the hours of noon until 10:00 p.m. on Saturday, August 18, 2001; and WHEREAS, if applicant is not granted a variance it will not be able to present the live music in conjunction with Capitol City Days; and WHEREAS, the Office of License, Inspections, and Environmental Protection has reviewed the application and has made recommendations regarding conditions for the variance; now, therefore, be it RESOLVED, that the Council of the City of Saint Paul hereby grants a variance for August 17 and August 18, 2001 to the West End Business Revitalization Corporation and the West End Business & Professional Association, subject to the following conditions: 1) The variance shall be.for the hours of 5:00 p.m. to 10:00 p.m. on August 17, 2001 and between noon and 10:00 p.m. on August 18, 2001. 2) A11 electronically powered equipment used in conjunction with the event shall not exceed 100 dBA as measured at the closer of the sound mix or at a distance of 100 feet from the front of the stage. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 3) The applicanC shall provide personnel and equipment who shall provide continuous sound level monitoring between 5:00 p.m, and 10:00 p.m. on August 17, 2001 and between noon and 10:00 p.m. on August 18, 2001 to ensure compliance with Condition #2• 4) All electronically powered equipment, PA systems, loudspeakers or similar devices shall be turned off no later than 10:00 p.m. on both dates. o\ -'�q� FURTHER RESOLVED, that any violation of the conditions set forth above on the August 17, 2001 date may result in revocation of the grant of a variance for the August 18, 2001 date, in addition to any criminal citation which might issue.
