WHEREAS, Chapter 293 of the Saint Paul Legislative Code was
enacted to regulate the subject of noise in the City of Saint
Paul; and
WHEREAS, �293.11 provides for the granting of variances from
the sound level limitations contained in §293.09, upon a finding
by the City Council that full compliance with Chapter 293 would
constitute an unreasonable hardship on an applicant, other
persons or on the community; and
WHSREAS, the West End Business Revitalization Corporation
and the West End Business & Professional Association, represented
by Holly Crouse, of theWest End Business Revitalization
Corportion, who has been designated as the responsible person on
the application, have applied for a variance to allow live music
at the property bounded by Kellogg Avenue, 5"' and 7`" Streets, on
August 17 and August 18, 2001; and
WHEREAS, applicant is seeking a variance for the hours of
5:00 p.m. to 10:0� p.m. on Friday, August 17, 2�01 and for the
hours of noon until 10:00 p.m. on Saturday, August 18, 2001; and
WHEREAS, if applicant is not granted a variance it will not
be able to present the live music in conjunction with Capitol
City Days; and
WHEREAS, the Office of License, Inspections, and
Environmental Protection has reviewed the application and has
made recommendations regarding conditions for the variance; now,
therefore, be it
RESOLVED, that the Council of the City of Saint Paul hereby
grants a variance for August 17 and August 18, 2001 to the West
End Business Revitalization Corporation and the West End Business
& Professional Association, subject to the following conditions:
1) The variance shall be.for the hours of 5:00
p.m. to 10:00 p.m. on August 17, 2001 and
between noon and 10:00 p.m. on August 18,
2001.
2) A11 electronically powered equipment used in
conjunction with the event shall not exceed
100 dBA as measured at the closer of the
sound mix or at a distance of 100 feet from
the front of the stage.

3) The applicanC shall provide personnel and
equipment who shall provide continuous sound
level monitoring between 5:00 p.m, and 10:00
p.m. on August 17, 2001 and between noon and
10:00 p.m. on August 18, 2001 to ensure
compliance with Condition #2•
4) All electronically powered equipment, PA
systems, loudspeakers or similar devices
shall be turned off no later than 10:00 p.m.
on both dates.

FURTHER RESOLVED, that any violation of the conditions set forth
above on the August 17, 2001 date may result in revocation of the
grant of a variance for the August 18, 2001 date, in addition to
any criminal citation which might issue.

The West End Business Revitalization Corporation has requested a sound level
arianc,e for live outdoor music on the parking lot by the Armstrong/Quinlan
ouse, across from the Excel Energy Arena. The music is scheduled on August
17, 2001 from 5:00 p.m. to 10:00 p.m., and on August 18, 2001 from 12:00 Noon
to 10c0� p.m., during the Capital City Days festival.
VANTAGES IF APPROVED:
ill place conditions that will limit the sound impact on surrounding
residential and commercial areas.
ISADVANTAGES IF APPROVED:
Persons living or working near the Armstrong/Quinlan House, bounded by West
Seventh Street, West Fifth Street, and Kellogg Blvd., will be able to hear the
sounds from the outdoor music.
ISADVANTAGES IF NOT APPROVED:
The sound level impact on surrounding residential and commercial areas could
e greater with no conditions.

Attached is a sound level variance application from Holly Crouse, representing the West
End Business Revitalization Corp., to allow live outdoor music on the parking lot located
by the Armstrong Quinlan House, across from the Excei Energy Arena. A variance is
requested from 5:00 pm. to 10:00 p.m. on August 17, 2001 and from 12:00 Noon to
10:00 p.m. on August 18, 2001 during the Cagitai City Days Festival.
Also attached is a copy of the Public Hearing Notice sent to property owners within 200
feet of the area bounded by Kellogg Blvd, West Seventh Street and West Fifth Street.

RESOLVED, that the Council of the City of Saint Paul hereby
grants a variance for August 17 and August 18, 2001 to the West
End Business Revitalization Corporation and the West End Business
& Professional Association, subject to the following conditions:
1) The variance shall be.for the hours of 5:00
p.m. to 10:00 p.m. on August 17, 2001 and
between noon and 10:00 p.m. on August 18,
2001.
2) A11 electronically powered equipment used in
conjunction with the event shall not exceed
100 dBA as measured at the closer of the
sound mix or at a distance of 100 feet from
the front of the stage.

3) The applicanC shall provide personnel and
equipment who shall provide continuous sound
level monitoring between 5:00 p.m, and 10:00
p.m. on August 17, 2001 and between noon and
10:00 p.m. on August 18, 2001 to ensure
compliance with Condition #2•
4) All electronically powered equipment, PA
systems, loudspeakers or similar devices
shall be turned off no later than 10:00 p.m.
on both dates.

FURTHER RESOLVED, that any violation of the conditions set forth
above on the August 17, 2001 date may result in revocation of the

17, 2001 from 5:00 p.m. to 10:00 p.m., and on August 18, 2001 from 12:00 Noon

Attached is a sound level variance application from Holly Crouse, representing the West
End Business Revitalization Corp., to allow live outdoor music on the parking lot located
by the Armstrong Quinlan House, across from the Excei Energy Arena. A variance is
requested from 5:00 pm. to 10:00 p.m. on August 17, 2001 and from 12:00 Noon to
10:00 p.m. on August 18, 2001 during the Cagitai City Days Festival.
Also attached is a copy of the Public Hearing Notice sent to property owners within 200
feet of the area bounded by Kellogg Blvd, West Seventh Street and West Fifth Street.
