F. 264604, approved November 20, 1974, a public hearing was scheduled for 10:00 a.m. on December 12, 1974 before the Council of the City of Saint Paul, said hearing pertaining to the condition of the structure located at 1597 Marshall Avenue, Saint Paul, Minnesota; and WHEREAS, upon facts presented at said hearing consisting of photographs, inspection reports and the recommendation of the Division of Housing and Buildi.ng Code Enforcement, it is found and determined by the City Council that accordir�.g to the records and file�s in t�ta.e office of the Register of Deeds, the last record owners . of the above described property are Matthew N. Zell III and Alys Zell, , and the County of Ramsey has an old age assistance lien against the property; and that it is further determined that the above described building constitutes a hazardous. building within the definition of Minnesota Statutes Section 463.15 for the following reasons: a. The building has had a ma.jor fire which has gutted the interior to such an extent that the building is beyond feasible rehabilitation; c. The buildi ng is unfit for human habitation in its present condition and corrections must be ma.de in compliance with the Building Code and Housing Code of the City of Saint Paul in order to make the same habitable; d. The building constitutes a nuisance and a hazard to the public health, safety and welfare because of its physical dama.ge, dilapidation a�l inadequate ma.intenance; now, therefore, be it RESOLVED, That in accordance with Minnesota Statutes Sections 463.15 through 463. 26, and based upon the foregoing findings of the City Council, the Council of the City of Saint Paul does hereby make the following Order: ORDER 1. The owners of the above described building shall make the same safe and not detrimental to the public peac�, health, safety and welfare by having the said building razed and the materials therefrom removed from the premises within thirty (30) days from the date of the service of this Order; 2. 1Diiless such corrective action is taken to comply with this Order or an answer served upon the City of Saint Paul and filed in the Office of the Clerk of District Court of Ramsey County, Minnesota within twenty (20) days from the date of the service of this Order, a Motion for Summary Enforcement of this Order to raze and remove the said building will be ma.de to the Ramsey County District Court; 3. The owner of record is Niatt Zell III , 1055 Colby Avenue, St. Paul, Minnesota 55116. The legal description of the property is EZ of Lot 8, Block 8 , Co1- lege Park Addition. This building has had a major fire which has gutted the interior of the building to such an extent that we believe the building is beyond feasible rehabilitation. The Housing and Redevelopment Authority does not intend to acquire this building. This building has been vacant since April of 1974 . Inasmuch as the inadequate maintenance, the dilapidated condition and the physical damage outlined above constitute a public hazard and the owner has made no attempt to satisfactorily repair the damage despite our warnings, and the continued vacant and boarded up condition con- tribufies a blighting influence on the neighborhood, it is the recom- mendation of this bureau that this matter be referred to the City Attorney's office for razing and removal through District Court pro- ceedings.
