WHEREAS, Chapter 293 of the Saint Paul Legislative Code was
enacted to regulate the subject of noise in the City of Saint
Paul; and
WHEREAS, §293.11 provides for the granting of vaxiances from
the sound level limitations contained in �293.09, upon a finding
by the City Council that full compliance with Chapter 293 would
constitute an unreasonable hardship on an applicant, other
persons or on the community; and
WHEREAS, Schwietz Saloon, represented by Steven and Maureen
Mariano, owners who have been designated as the responsible
person on the application, has applied for a variance to allow
live music at 956 Payne Avenue, on September 13, 14 and 15, 2001;
and
/,
WHEREAS, applicant is seeking a variance for the hours of
8:30 p.m. to 12:30 a.m. on September 13, 14 and 15, 2001; and
WHEREAS, if applicant is not granted a variance it will not
be able to present the live music; and
WHEREAS, the Office of License, Inspections, and
Environmental Protection has reviewed the application and has
made recommendations regarding conditions for the variance; now,
therefore, be it
RESOLVED, that the Council of the City of Saint Paul hereby
grants a variance to Schwietz Saloon, subject to the following
conditions:
1) The variance shall be for the hours of 8:30
p.m. to 12:30 a.m. on September 13, 14 and
15, 2001.
2) All electronically powered equipment used in
conjunction with the event shall not exceed
90 dBA from 8:30 p.m. until midnight on each
of the dates and shall not exceed 85 dBA from
midnight until 12:30 a.m. on each of the
three dates. Measurement of the sound level
shall be performed at a distance between one
to five feet south of the curbing on the
south side of Case Avenue by the entrance to
the tent.

3) The applicant shall provide personnel and
equipment who shall provide continuous sound
level monitoring between 8:30 p.m. and 12:30
a.m. on all dates to ensure compliance with
Condition #2-
4) Al1 electronically powered equipment, PA
systems, loudspeakers or similar devices
shall be turned off no later than 12:30 a.m.
on September 14, 15 and 16, 2001.

FURTHER RESOLVED, that any violation of the conditions set
forth above on the September 13, 2001 date may result in
revocation of the grant of a variance for the September 14 and
15, 2001, dates, and any violation of the conditions set forth
above during the September 14, 2001 date may also result in
revocation of the grant of a variance for the September 15, 2001
date, in addition to any criminal citation which might issue.

Steve and Maureen Mariano, Owners of Schwietz Saloon, have requested a sound
level variance for live music in an outdoor tent behind the bar at 956 Payne
venue, between the alley and Case Avenue. The music is scheduled on
September 13, 14, & 15, 2001 from 8:30 p.m. to 12:30 a.m. during Harvest
Festival 2001.

Attached is a sound level variance application from Steve and Maureen Mariano, Owners
of Schwietz Saloon, 956 Payne Avenue, to allow live music in a tent on the parking lot
located behind the bar between the alley and Case Avenue. A variance is requested from
8:30 p.m. to 12:30 a.m. on September 13, 14, and 15, 2001 during the Harvest
Festiva12001.
Also attached is a copy of the Public Hearing Notice sent to property owners within 200
feet of 956 Payne Avenue.

Steve and Maureen Mariano, Owners of Schwietz Saloon, have requested a sound
level variance for live music in an outdoor tent behind the bar at 956 Payne
venue, between the alley and Case Avenue. The music is scheduled on
September 13, 14, & 15, 2001 from 8:30 p.m. to 12:30 a.m. during Harvest
Festival 2001.

Attached is a sound level variance application from Steve and Maureen Mariano, Owners
of Schwietz Saloon, 956 Payne Avenue, to allow live music in a tent on the parking lot
located behind the bar between the alley and Case Avenue. A variance is requested from
8:30 p.m. to 12:30 a.m. on September 13, 14, and 15, 2001 during the Harvest
Festiva12001.
Also attached is a copy of the Public Hearing Notice sent to property owners within 200
feet of 956 Payne Avenue.
