11 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the

That the petitioner's, their successors and assigns shall pay $500.00 as an administrative fee for
this vacation which is due and payable within 60 days of the effective date of this resolution.
That a permanent utility easement shall be retained within the vacated area to protect the interest
of Xcel Energy Company.
That a permanent utility easement shall be retained within the vacated area to protect the interest
of Qwest Communications, Inc.
That a permanent utility easement shall be retained within the vacated azea to protect the interest
of A.T. & T. Broadband, Inc.

2 6. That the petitioners, their successors and assigns agree to indemnify, defend and save harniless
3 the City of Saint Paul, its officers and employees from all suits, actions or claims of any character
4 brought as a result of injuries or damages received or sustained by any person, persons or
5 property on account of this vacation or petitioners' use of this properry, including but not limited
6 to, a claim brought because of any act of omission, neglect, or misconduct of said petitioners or
7 because of any claims or liability arising from any violation of any law or regulation made in
8 accordance with the law, whether by the petitioners or any of their agents or employees.

10 7. That the petiUOners, their successors and assigns shall, within 60 days of the effective date of this
11 resolution, file with the City Clerk an acceptance in writing of the conditions of this resolution
12 and shall, within the period(s) specified in the terms and conditions of this zesolution, comply in

property described as follows:
That part of the alley in Block 12, Hayden Heights Addition lying
easterly of the northerly extensions of the west line of Lot 4,
southerly of the westerly extension of said Lot 4, and northerly of
the north line of Lot 5, all in said Block 12.
It is our understanding that all of the utility easements will be retained. Please be
informed that Xcel Energy has no objection to the described vacation, provided,
however, that our easement rights remain untouched. We have had our CSDR look at
the properry and found that we have distribution facilities located on the vacation tract.

The Department of Public Works has completed a review of the above-referenced proposal and has
no objections to the vacation of the requested portion of this alley as shown on the attached map. The
north-south portion of the atley abutting Lots 1 through 4 is unimproved and unassessed, although it is
driveable.
It would be preferable to vacate the entire north-south portion of the alley abutting Lots 1 through 4.
But, since that is not feasible, the Department of Public Works has no objections to vacating only the
portion abutting I,ot 4, for the following reasons:
L The vacation will not alter the current use of the remaining portion of alley abutting L.ots 1 through 3.
2. The remaining portion of alley will be less than 120 feet, which is short enough that an alley turn-
around is unnecessary.

That a permanent utility easement shall be retained within the vacated area to protect the interest
of Qwest Communications, Inc.
That a permanent utility easement shall be retained within the vacated azea to protect the interest
of A.T. & T. Broadband, Inc.

6 to, a claim brought because of any act of omission, neglect, or misconduct of said petitioners or

t am writing in response to your request to an alley vacation over, upon or under
property described as follows:
That part of the alley in Block 12, Hayden Heights Addition lying
easterly of the northerly extensions of the west line of Lot 4,
southerly of the westerly extension of said Lot 4, and northerly of
the north line of Lot 5, all in said Block 12.
It is our understanding that all of the utility easements will be retained. Please be
informed that Xcel Energy has no objection to the described vacation, provided,
however, that our easement rights remain untouched. We have had our CSDR look at
the properry and found that we have distribution facilities located on the vacation tract.

The Department of Public Works has completed a review of the above-referenced proposal and has
no objections to the vacation of the requested portion of this alley as shown on the attached map. The
north-south portion of the atley abutting Lots 1 through 4 is unimproved and unassessed, although it is
driveable.
It would be preferable to vacate the entire north-south portion of the alley abutting Lots 1 through 4.
But, since that is not feasible, the Department of Public Works has no objections to vacating only the
portion abutting I,ot 4, for the following reasons:
L The vacation will not alter the current use of the remaining portion of alley abutting L.ots 1 through 3.
2. The remaining portion of alley will be less than 120 feet, which is short enough that an alley turn-
around is unnecessary.

property described as follows:
That part of the alley in Block 12, Hayden Heights Addition lying
easterly of the northerly extensions of the west line of Lot 4,
southerly of the westerly extension of said Lot 4, and northerly of
the north line of Lot 5, all in said Block 12.
It is our understanding that all of the utility easements will be retained. Please be
informed that Xcel Energy has no objection to the described vacation, provided,
however, that our easement rights remain untouched. We have had our CSDR look at
the properry and found that we have distribution facilities located on the vacation tract.

The Department of Public Works has completed a review of the above-referenced proposal and has
no objections to the vacation of the requested portion of this alley as shown on the attached map. The
north-south portion of the atley abutting Lots 1 through 4 is unimproved and unassessed, although it is
driveable.
It would be preferable to vacate the entire north-south portion of the alley abutting Lots 1 through 4.
But, since that is not feasible, the Department of Public Works has no objections to vacating only the
portion abutting I,ot 4, for the following reasons:
L The vacation will not alter the current use of the remaining portion of alley abutting L.ots 1 through 3.
2. The remaining portion of alley will be less than 120 feet, which is short enough that an alley turn-
around is unnecessary.
