The rehabilitation or demolirion of the structure to be completed within five (5) days after the date of the Council Hearing; and WI�REAS, a hearing was held before the Saint Paul City Council on Wednesday, January 24, 2001 and the testunony and evidence including the action taken by the Legislative Hearing Officer was considered by the Counci2; now therefore BE IT RESOLVED, that based upon the testimony and evidence presented at the above referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order concerning the Subject Property at 495 Sherburne Avenue: That the Subject Property comprises a nuisance condirion as defined in Saint Paul Legislative Code, Chapter 45. 2. 3. 4. 5. 6. That the costs of demolition and removal of this building(s) is esrimated to exceed three thousand dollazs ($3,000.00). That there now exists and has existed multiple Housing or Building code violations at the Subject Property. That an Order to Abafe Nuisance Building(s} was sent to the then known responsible parties to conect the deficiencies or to demolish and remove the building(s). That the deficiencies causing this nuisance condition have not been corrected. That Division of Code Enforcement has posted a placard on the Subj ect Property which declares it to be a nuisance condition subject to demolition. That this building has been routinely monitared by the Citizen Service Offices, Division of Code Enforcement, Vacant/Nuisance Buildings. 8. That the lrnown interested parties and owners aze as previously stated in this resolution and that the notification requirements of Chapter 45 have been fulfilled. ORDER The Saint Paul City Council hereby makes the following order: 1. The above referenced interested or responsible parties shall make the Subject Property safe and not detrimental to the public peace, health, safety and welfare and remove its blighting influence on the community by rehabilitating this structure and conecting all deficiencies as prescribed in the above referenced Ordar to Abate Nuisance Building(s) in accordance with all applicable codes and ordinances, or in the alternafive by demolishittg and removing the stnzcture in accordance with all applicable codes and ordinances. STAFP PRESENT: Steve Magner, Code Enforcement. Resolution ordering the owner to remove or repair the building at 721 Payne Avenue. If the owner fails to comply, Code Enforcement is ordered to remove the building. (Steve Magner gave photographs to Gerry Strathman} No one appeared to represent tlus property. Steve Magner reported this building is a one-story, metaUwood frame, brick/stone commercial shucture. The building was Condemned in September, 2000, by Fire Prevention, and it has been vacant since September 22, 2Q00. The current owner is James and Clarence Bailey. There have been no suminary abatement notices issued, but the roof is collapsed into the building. An inspection was conducted on November 9, 2000, and a list of deficiencies which constitute a nuisance condition was developed and photob aphs were taken. An Order to Abate a Nuisance Building was issued on November 16, 2000 with a compliance date of December 4, 2000. The property remains in a condition that comprises a nuisance as defined by the Legisiative Code. Vacant building fees are due. Real estate t�es aze unpaid in the amount of 1,794.59. The estimated mazket value of the property is $65,000. A Code Compliance inspecrion has not been applied for. Bond has not been posted. The estimated cost to repair is $80,000; estimated cost to demolish, $5,000 to $6,000. The owner has contacted Code Enforcement through an attorney and is seeking the ciiy to raze tl�e structure and abate the nuisance. Gerry STratlimaa recommended, at the request of the properry owner, laying over to the January 16, 2002 Legisiative Hearing and the Februaty 7, 2001 City Council Meeting. There have been four sununary abatement notices issued to secure the dwelling, remove fire debris form tke yazd, and to remove snow and/or ice &om the public sidewatk. An inspection was conducted on November 2, 2000, and a list of deficiencies which constitute a nuisance condition was developed and photographs were taken. An Order to Abate a Nuisance Building was issued on November 9, 2000 with a compliance date of November 27, 2000. The esrimated market value of the properry is $43,000. A Code Compliance inspection has not been appiied for. Bond has not been posted. In response to Mr. Stratlunau's question if there has been any communication with the owner, Mr. Magner responded there is three parties involved with this property. The original fee owner, Warren and Shazon Sudmeier, contacted Code Enforcement and do not have any interest in the properry. The contract buyer, Trinidad and Zindy Cedillo, contacted Code Enforcement and do not haue any interest in the property. Code Enforcement has not had any contact from the mortgaga company. Gerry Strathman recommended approval of the order to remove or repair within five days. Resolution ordering the owner to remove or repair the building at 45 Winona Street West. If the owner fails to comply, Code Enforcement is ordered to remove the build'zng. Division of Code Enforcement has issued an order to the then known responsible parties to eliminate this nuisance condition by correctinb the deficiencies oz by razing and removing this building(s).
