RESOLVED, That upon and pursuant to the pertinent appeal,
under the Zoning Code, by Joan Bosard, owner of the subject
real esta.te, situate in the City of Saint Paul and described
as:
Lot 8 and North 12 feet of Lot 9,
Block 1, Warren and McDowell's
Subdivision of Block 4, Rogers and
Hendrick's Acre Lots;
that th�e provisions of said Zoning Code hereby are determined
and varied as and to the extent necessary therefor and the
parking requirements for said premises are hereby relaxed so
as to construct an attached single car garage to a newly con-
structed single family dwelling, subject to the condition that
said appellant, and her successors and assigns, otherwise, shall
make due compliance with all applicable provisions of municipal
ordinances, state statutes and rules and regulations of public

This is written in response to the appeal of Joan Bosard to relax
parking requirements on property located on the west side of Dale
between Cottage and Wheelock. This property is further described
as follows:
Lot 8 and North 12 feet of Lot 9, Block 1, Warren and
McDowell's Subdivision of Block 4, Rogers and Hendrick's
Acre Lots.
This matter was heard by the Board of Zoning on November 7, 1974,
at which time staff recommended approval of the appeal because of
the unusual topography of the lot. '
After brief discussion, a motion to recommend approval of the appeal
carried unanimously.

1) The intended 41' driveway, as shown in the enclosed
blueprint, offers more space for off—street parking
than has any other house on the block. An excep—
tion may appear to be the house next door; however,
it has separate housekeeping facilities upstairs and
could be considered a two—family dwelling.
2) The existing off—street parking of other nearby
homes is not in any instance withiM what is consid—
ered a set—back area.
3) The additi�.garage door (as presently required) ,
if ever put to use, would prevent the house from
having a walk—out basement� which the house and
land are ideally suited for, a.nd thereby prevents
use of the property for which it was intended.

A. HISTORY: There is no zoning history for this site.
B. PP.OPOSAL: The proposal is to construct an attached single car garage to
a newly constructed single family dwelling.
C. VARIANCE: The Code requires two off-street parking spaces for a singl�
family dwelling. These spaces must be located within the sethack
required for the home. The legal setback for the home is 27 feet, The
distance from the setback line to the front of the garage is 15 feet,
or 5 feet short of the footage required.
D. AREA ZO�iING: The area i.s predominantly "A" Residential with several
sma.11 Commercial zones.
E. SITE CONDITIONS: The site contains a newly constructed home with attached
garage. The rear yard area is substantially below the grade of other
rear yards in the block.
F. AREA CONDITIONS: The area contains mostly single family homes in good
condition, A park and a parochial school and chureh exist in the block
to the north.
